PUBLIC HEARING/SPECIAL MEETING

Tuesday, January 17, 1989 5:01 P.M._
Mayor Betty Jean Stewart called the advertised Public Hearing/Special
Meeting of the Town Commission, Town of Highland Beach, Florida, to
order in the Commission Chambers at Town Hall at 5:01 P.M. Others
present were Vice Mayor John J. Basso, Commissioners Robert F. Scholz
and Marvin A. Waldman. Commissioner Doris R. Rome was absent.
Also in attendance were Town Attorney David K. Friedman, Town Manager
Mary Ann Mariano, Deputy Town Clerk Anne M. Kowals and members of the
general public.
Mayor Stewart noted that the advertised Public Hearing/Special Meeting
was called to receive public input and consider the adoption of the
following:
1. AN ORDINANCE OF THE TOWN OF HIGHLAND BEACH, FLORIDA, RETITLING
SECTION $ OF CHAPTER 30, HIGHLAND BEACH CODE OF ORDINANCES;
AMENDING SECTION 8.1 TO REQUIRE A PERMIT TO DEMOLISH A
STRUCTURE; AMENDING SECTION 8.2 TO PROVIDE THAT ITS REQUIRE-
MENTS PERTAIN TO APPLICATIONS FOR SITE PLAN REVIEW; AND TO
ELIMINATE CERTAIN REQUIREMENTS; RENUMBERING SECTION 10 AS
SECTION 8.3 AND AMENDING SAME TO AMEND EXISTING SITE PLAN RE-
VIEW REQUIREMENTS AND TO PROVIDE FOR CERTAIN ADDITIONAL RE-
QUIREMENTS; RENUMBERING SECTION 8.3 A5 SECTION 8.4 AND AMEND-
ING SAME TO REVISE THE PROCEDURE FOR THE PROCESSING AND
APPROVAL OF PLANS FOR MULTI-FAMILY DWELLING UNITS, SINGLE
FAMILY DWELLING UNITS, AND RENOVATIONS, ADDITIONS AND ALTER-
ATIONS; RENUMBERING SECTION 8 AS SECTION 9 AND AMENDING ITS
TITLE; RENUMBERING SECTION 8.4 AS SECTION 9. 1; RENUMBERING
SECTION 8.5 AS SECTION 9.2 AND AMENDING SAME TO PROVIDE ADDI-
TIONAL REQUIREMENTS PERTAINING TO EXPIRATION OF BUILDING
PERMITS; RENUMBERING SECTION 8.6 AS SECTION 9.3; RENUMBERING
SECTION 8.7 AS SECTION 9.4 AND AMENDING SAME TO PROVIDE FOR
ISSUANCE OF 'NOTICE OF VIOLATION' AND 'CITATION' BY THE BUILD-
ING OFFICIAL/CODE ENFORCEMENT OFFICER FOR CODE VIOLATIONS; RE-
NUMBERING SECTION 8.8 AS SECTION 9.5; RENUMBERING SECTION 9 AS
SECTION l0; PROVIDING FOR AN EFFECTIVE DATE.
After reading the Ordinance by title only, Mayor Stewart requested
comments from members of the audience.

It was noted that there were some typographical and minor changes that
were reviewed prior to this hearing that must be inserted in the
Ordinance.
Town Manager Mariano requested the Town Commission clarify "demolition".
The Town Manager noted that the Town has an Ordinance requiring a permit
for demolition; the Town has a land clearing Ordinance; and, stringent
Standard Building Code requirements for demolition must be followed when
a building is demolished. Town Manager Mariano further noted that, in a
discussion with the Planning Board, it was not the Planning Board's
intention to require site plan approval on total demolition.
Commissioner Waldman noted that demolition could result in damage to
adjacent property therefore it should require site plan review by the
Planning Board and the Community Appearance Board (the more Town Members
aware of the matter, the better). The Members were in agreement with
Commissioner Waldman and it was the consensus of the Town Commission
that the Ordinance should not be amended relative to site plan approval
for demolition.
When the Town Manager questioned if the fee for the site plan review for
demolition will be waived, Attorney Friedman advised that the Town could
reduce the fee for such site plan review.
Mr. Philip Colman, Highland Beach resident/developer, commented that to
require site plan approval from the Planning Board for demolition is not
logical because demolition is done under strict regulations. Prior to
obtaining a demolition permit, you must indicate who is doing the job
and you must have someone who is qualified to determine if the demoli-
tion is being done properly; that is why you have a Building Department
and inspections. The Town should not burden the Planning Board with an
item that they are not capable of handling, continued Mr. Colman.
The Town Commission continued with the review of the proposed Ordinance
and noted the necessary additions and corrections. Regarding 9.2 -
Expiration of Building Permit, Mr. Colman suggested that the 6 months
period (the length of time in which the permit is valid) is not fair; it
should be a 12 months period for the permit to be valid before a
developer seeks renewal. In the discussion of building permits, Commis-
sioner Waldman noted that the Ordinance provides for two extensions if
cause is sufficient. The Town Attorney advised the these provisions for
extensions are based on the Standard Building Code which allows a permit
to be valid for two years because in that two year period there could be
a zoning change which would require a new permit and compliance with the
new zoning. Mr. Colman commented that it would not be unfair and
unreasonable for the time period to be extended by another six months.
• Following substantial discussion, it was the consensus of the Town
Commission that the proposed Ordinance should be left as submitted.

MOTION was made by COMMISSIONER WALDMAN/VICE MAYOR BASSO to adjourn the
Public Hearing of the Town Commission.
Mayor Stewart adjourned the Public Hearing at 5:55 P.M.

The Special Meeting of the Town Commission of the Town of Highland
Beach, Florida, was called to order in the Commission Chambers at Town

The proposed Ordinance was read in its entirety. MOTION was made by
VICE MAYOR BAS50/COMMISSIONER WALDMAN to adopt the Ordinance as read. A
roll call vote resulted in "AYE" votes cast by the four Town Commission
Member present at this Special Meeting.

Mayor Stewart acknowledged receipt of the Planning Board's transmittal
of the Comprehensive Plan and noted that the Town Commission is required
to hold advertised Workshop Meetings for the purpose of reviewing the
elements of the Comprehensive Plan. It was the consensus of the Town
Commission that the first advertised Workshop Meeting should be
scheduled for Monday, February 6, 1989, at 9:3f~ A.M.
The Agenda for the Special Meeting having been addressed, MOTION was
made by COMMISSIONER WALDMAN/COMMISSIONER SCHOLZ to adjourn same.
Mayor Stewart adjourned the Special Meeting of the Town Commission at
6:38 P.M.
