1990.09.25_TC_Minutes_Workshopt ~_ !~"-- TOWN OF HIGHLAND BEACH, FLORIDA Minutes of Meeting of Town Commission WORKSHOP MEETING Tuesday, September 25, 1990 1: 30 _P .M. Mayor Joseph A. Boulay called the Workshop Meeting of the Town Commis- sion of the Town of Highland Beach, Florida, to order at 1:30 P.M. in the Commission Chambers at Town Hall. Others present were Vice Mayor Bill Paul, Commissioners Marvin A. Waldman, Betty Sean Stewart and Harold C. Chambers. Also in attendance were Town Attorney Thomas E. Sliney, Town Manager Mary Ann Mariano, Town Clerk Anne M. Kowals and members of the general public. ADDITIONS, DELETIONS OR ACCEPTANCE OF AGENDA The Agenda, amended to include four items under the Town Manager's Report, was accepted upon MOTION by COMMISSIONER STEWART/COMMISSIONER CHAMBERS. The MOTION carried unanimously. 90.1 Public Comments and Requests: Ms. Margaret Leonard of 4511 South Ocean Boulevard, questioned if Town • Manager Mariano received figures from Delray Beach and Boca Raton with regard to fire rescue services. The Town Manager advised that figures were received from Delray Beach; the Boca Raton figures are anticipated at the end of October. 90.2 Boards and Committees Mayor Boulay noted no vacancies exist on any of the Town Boards and Committees at this time. The Mayor further noted there was no correspondence received from any Town Boards or Committees. 901.3 Proposed Ordinances and Resolutions 1. AN ORDINANCE OF THE TOWN OF HIGHLAND BEACH, FLORIDA, AMENDING SECTION 9-12.1 {b) (6) OF SECTION 9-12.1 ENTITLED "SATELLITE TELEVISION ANTENNA SYSTEMS" OF THE CODE OF ORDINANCES OF THE TOWN OF HIGHLAND BEACH PROVIDING FOR SCREENING FROM VIEW. During brief discussion of the proposed ordinance, the Town Attorney noted that a sentence was added to paragraph 6, under Satellite Antenna Systems, dealing with the Community Appearance Board. The intention is that, to the extent possible without interfering with normal reception, the antenna be screened from view from the roads and adjacent properties with the exception of the Intracoastal Waterway. It was the consensus that this matter be placed on the October 3, 1990 Regular Meeting Agenda for first reading. n Town Commission Workshop Meeting Minutes September 25, 1990 Page 2 of 6 2. AN ORDINANCE OF THE TOWN OF HIGHLAND BEACH, FLORIDA, AMENDING SECTION 5.01 (B) OF ARTICLE V OF THE CHARTER OF THE TOWN OF HIGHLAND BEACH, SECTION 5.01 ENTITLED "AUTHORITY TO ENACT; PROCEDURE; EXECUTION; POSTING; EMERGENCY ORDINANCES" AND AMENDING THE FIRST PARAGRAPH OF RULE N0. 10 OF SECTION 2-6 OF THE CODE OF ORDINANCES ENTITLED "RULES OF PROCEDURE" OF THE TOWN OF HIGHLAND BEACH, TO ELIMINATE THE REQUIREMENT THAT PROPOSED ORDINANCES BE READ IN FULL ON THE FINAL READING. Following discussion of the proposed ordinance, it was the consensus to include same on the Agenda for the October 3, 1990 Regular Meeting of the Town Commission for first reading. 89.15 Discussion re preliminary master flan for park behind Town Hall submitted by Urban Design Studios Town Manager Mariano noted that she advised Jo Ellen Leisinger of all the concerns the Town Commission had and it was the general feeling that the Town should not have to pay the additional money. Ms. Leisinger questioned if the Town could pay $500. towards the $1,500. invoice and discuss the balance when Urban Design is called on to do additional work. Following discussion of the matter, it was the consensus of the • Town Commission to continue the discussion of this matter at the October Workshop Meeting. In the discussion relating to the proposed park behind Town Hall, it was noted that the residents have had at least two months in which to note their comments (on the writing tablet provided) at Town Hall when they reviewed the proposed park plans on display in the Administration Building. The park issue, along with said comments, will be on the Agenda for discussion at the October Workshop Meeting of the Town Commission. MISCELLANEOUS - ITEMS LEFT OVER 1. Status of Building Development in Town The Status of Building Development in Town, a report prepared by the Building Official, was received as information by the Town Commission. 2. Minutes for approval at October Regular Meeting The three sets of Minutes to be submitted for approval at the October Regular Meeting were reviewed. 3. Discussion re proposed ~olic,y for government access Channel 12 Mayor Boulay noted that we are awaiting response from the Planning Town Commission Workshop Meeting Minutes September 25, 1990 Page 3 of 6 C~ J Board, the Board of Adjustment and the Code Enforcement Board regarding a request for Member input concerning the televising of Town Boards Meetings. Commissioner Chambers, noting the Town Commission is the governing body which has a right to implement policy, questioned if the Town Commission will be guided by the responses from the Town's Advisory Boards. Commissioner Waldman, recognizing that input from the various Town Boards is necessary, stated that the Commission should adhere to the Boards' wishes. Following discussion of this matter, the Town Com- mission directed the Town Clerk to phone each member of the three Boards mentioned above to receive their input and report same to the Town Com- mission at the October 3, 1990 Regular Meeting. REPORTS - TOWN COMMISSION Vice Mayor Bill Paul No report. Commissioner Marvin A. Waldman No report. Commissioner Betty Jean Stewart Commissioner Stewart requested the Town Commission have a memo sent to the Financial Advisory Board asking that they look into the amounts of money appropriated to various telephone sections and work with the Chief Finance Officer to find out how these amounts are arrived at and perform an analysis of phone bills for the last six months. The Commissioner further requested the resulting report be provided to the Town Commission (within sixty days) for their December Meeting. Commissioner Stewart, citing a notice to potential applicants for 1990- 91 Litter Prevention Grants from Clean Florida Commission, was advised that the Town of Highland Beach would probably not qualify for the grant which would match the grant funding dollar for dollar. Further, this grant is predicated on community need based on local income and living standards being considered, with needy communities having priority. At this point, Commissioner Waldman, noting it government to purchase the Hoffmann Tract and to the Town of Highland Beach as Recreation Ar Attorney (with the Mayor and Town Manager) sub letter to the proper governmental agency. Commissioner Chambers questioned if the Town Commission would object to a professor (with students who are working for extra credits) from Florida Atlantic University attending Town Meetings to operate the Town's T. V. camera and sound equipment. Following brief discussion, it was the consensus that this matter be placed on the Agenda for the October 3, 1990 Regular Meeting for further consideration. When Commissioner Chambers commented that he would like no public discussion regarding Town litigation, it was noted that the Town Attorney is reticent to discuss such matter publicly. With regard to the Commissioner's inquiry concerning cellular phones for the Police Department, it was stated that information has been requested and the Chief Accounting Officer, Police Chief and Town Manager are looking into the matter. Mayor Joseph A. Boula • Mayor Boulay extended thanks to Mr. Jose Echeverria (Russell Drive resi- dent) and his group for a fine job with regard to the beach cleanup that took place in Highland Beach this past weekend. The Mayor noted receipt of a letter dated September 21, 1990 from South Florida Water Management District to the Town of Highland Beach pertain- ing to the Town's application regarding the withdrawal permit. This matter will be placed on the Agenda for the October 3, 1990 Regular Meeting of the Town Commission. REPORTS - TOWN ATTORNEY Town Attorney Sliney, reporting on the pending Town litigation, noted receipt of correspondence from Attorney Trantaus, representing Mrs. Lucia Milani, dated August 21, 1990. The Town Attorney further noted that Town Manager Mariano submitted a memo on August 31, 1990 with cor- respondence and copies of settlement stipulation between Milani and the Town of Highland Beach executed in 1984. Following a brief fact finding discussion of the matter, it was the consensus of the Town Commission that Attorney Sliney respond to Attorney Trantaus advising the matter was reviewed at the Workshop Meeting; however, no decision has been made--we will advise when a decision is made. REPORTS - TOWN MANAGER Town Manager Mariano reported that Senior Planner Jim Park of Gee & rJ ~'~. Jenson will be in attendance at the October Workshop Meeting of the fio~n ~``' ~~"... i Town Commission Workshop Meeting Minutes September 25, 1990 Page 5 of 6 Commission to make a presentation on their findings with regard to the Bike Path. The Town Manager advised that information regarding recycling (postcards from Solid Waste Authority) were delivered this date to the single family residences; the Mid-September Newsletter is scheduled to be delivered by Wednesday (9/26/90); containers with additional information are to be delivered on Wednesday and Thursday (9/26 and 9/27). Town Manager Mariano noted receipt of a letter from CSA Marine Services stating that their diver inspection of the 14" water main across the Intracoastal Waterway revealed same is in excellent condition--no leaks, no damage, no corrosion. The Town Manager requested the Town Commission give consideration with regard to the inclusion of additional Intra- coastal piping. The Town Manager noted that if direction is given prior to the October Meeting of the Financial Advisory Board, said Board may be able to take same into consideration as they review the water rates. A proposed resolution with accompanying responses regarding Palm Beach Countywide Planning Council's "Potential Interjurisdictional Incompatibilities" was submitted by the Town Manager to the Town Commis- . Sion for review prior to the October 3, 1990 Regular Meeting with a view of adopting the resolution for transmittal to the Council. Town Manager Mariano cited the September 25, 1990 Sun Sentinel article regarding six firms accused of chlorine conspiracy. The Town Manager noted that the Town purchases chlorine through a group that includes Boca Raton and Delray Beach, which group is looking into this matter. Town Manager Mariano noting there is no report on what kind of revenue the Town may expect should the Attorney General's suit results in a favorable decision, advised such information will be relayed to the Town Commission as soon as it is received. The Town Manager advised a drainage problem had been reported by Mr. Dubin at 1100 Highland Beach Drive and noted this situation is not unique in the Town of Highland Beach, particularly in this area where the properties are elevated and water does not drain out into the street. Commissioner Stewart noted that if Mr. Dubin's driveway was not so solid, he would have better drainage in that area. Following discussion, it was the consensus that the Code Enforcement Officer investigate the situation to determine if it creates a health hazard.
