Minutes of Meeting of Town Commission
SPECIAL MEETING
Thursday, May 10, 1990 9:30 A.M.
Mayor Joseph A. Boulay called the Special Meeting of the Town Commission
of the Town of Highland Beach, Florida, to order at 9:30 A.M. in the
Commission Chambers at Town Hall. Others present were Vice Mayor Bill
Paul, Commissioners Marvin A. Waldman, Betty Jean Stewart and Harold C.
Chambers.
Others in attendance were Town Attorney David K. Friedman, Town Manager
Mary Ann Mariano, Town Clerk Anne M. Kowals and members of the general
public.
Mayor Boulay noted this Meeting was called for the purpose of discussing
the request by Concordia Investments for access to sales models at Villa
Mare/Villa Costa by prospective clients and discussion of the code
recodification.
The Agenda for this Special Meeting of the Town Commission was approved
upon MOTION by COMMISSIONER CHAMBERS/COMMISSIONER WALDMAN. Same carried
without objection.
It was the consensus of the Town Commission that this Special Meeting be
adjourned at approximately 11:15 A.M.
The Town Seal, mounted on the wall behind the dais in the Commission
Chambers, was noted by the Town Commissioners who were pleased with the
appearance of the Seal.
1. DISCUSSION RE CONCORDIA INVESTMENTS' REQUEST FOR ACCESS TO
SALES MODELS AT VILLA MARE/VILLA COSTA BY PROSPECTIVE CLIENTS
Mayor Boulay advised that, as requested at the last Town Commission
Meeting, Concordia Investments submitted to the Town certain documents
for the protection of the Town in connection with the showing of their
sales models.
Mr. Colman noted that he, at the request of Town Attorney Sliney, also
submitted a "hold harmless" letter to the Town. It was further noted by
Mr. Colman that his insurance policy expires on December 31, 1990.
Upon Commissioner Stewart's arrival at 9:50 A.M., Mayor Boulay informed
the Commissioner as to what transpired prior to her arrival.
At this point, COMMISSIONER CHAMBERS/VICE MAYOR PAUL made a MOTION that
the Town Commission approves a certificate of occupancy, for sales use
• only, with regard to Concordia Investments' request for access to sales
models at Villa Mare and Villa Costa by prospective clients be approved

now, effective June 15, 1990, based on continuous insurance coverage.
The continuous insurance coverage includes coverage by the policy issued
to Concordia Investments by Highlands Insurance Company, and continued
insurance coverage through the issuance of a permanent Certificate of
Occupancy. The insurance coverage must be consistent with letter of May
8, 1990 submitted by Simons & Rose, signed by Melvin L. Shapanka, to Mr.
Philip Colman.
The roll call vote resulted as follows:
Commissioner Waldman "AYE" Vice May Paul "AYE"
Commissioner Chambers "AYE" Commissioner Stewart "AYE"
Mayor Boulay "AYE"
It was noted that the approval was granted; however, the certificate of
occupancy will not be issued until the Building Official has an adequate
chance to inspect the properties for all safety factors.
2. DISCUSSION RE CODE RECODIFICATION
• Mayor Boulay, noting the Town Manager's Memorandum of December 20, 1989,
regarding the Town Code Recodification, turned the Meeting over to Town
Manager Mariano. The Town Manager advised that the Memorandum, which is
self explanatory, contains a 'Conference Memorandum' that outlines the
substantive changes that will be made in the Town Ordinances. It was
the consensus of the Town Commission that this outline should be used
for the review of the code recodification.
Commissioner Chambers commented that he read through the code recodifi-
cation and there is no particular area that he wanted to discuss; it
looks appropriate and it is everything it should be.
When Commissioner Waldman commented that there is no Town Code regarding
elevators, it was noted that this matter may be addressed in the
Southern Building Code. Commissioner Waldman suggested this matter be
checked out with neighboring cities to see what requirements they have
relative to elevators. The Town Manager will research this matter.
Town Manager Mariano advised that the no laws or ordinaces were changed;
those superceded by state law were omitted. The recodification was read
to make sure they did not leave out any words. The Town Attorney
reviewed the recodification to be sure the statutes were not omitted or
incorrectly stated. The intent of the code, as originally adopted, re-
mains the same. If the Town Commission feels something was superceded
by the state law, they may want to address the matter to satisfy the
Town Commission before the code recodification draft is returned to the
. Municipal Code Corporation.

The Town Manager further advised that when the code was first adopted,
it was according to alphabetical order; the recodification tries to
clarify things by putting all land regulations and building in one
chapter thereby making it easier to disseminate the information to the
public.
Town Manager Mariano informed the Town Commission that Chapter 30
(Zoning) was not included in the price of the recodification as the Town
was going through the Comprehensive Pland. The Town Manager noted that
the Town may have to look at the Town Charter.
The Town Manager advised the Town Commission that there will be a
section that will be a 'code comparative section' that will tell you
what it was in the old code (a cross-reference).
The Town Commissioners, reviewing the Section titled "Animals" agreed
that same Section 5-5 should remain as is (i.e. the sentence proposed to
be inserted before the last sentence is to be cancelled).
Following a discussion of the Section titled "Beaches and Boats", the
Members touched briefly on low flying airplanes and were advised that
• the Federal Aviation Association regulates the air space; therefore,
this Section will be deleted as per the "Conference Memorandum".
The Town Commissioners, reviewing the code recodification according to
the outline of the "Conference Memorandum" completed the partial review
up to and including the Section titled "Beaches and Boats" on page 3.
The consensus of the Town Commission was that certain items will be ad-
dressed separately from the recodification, i.e., elevator requirements,
etc. The matter of the "order of business" regarding the agenda will be
up-dated.
The Town Commission Members agreed to include the code recodification on
the May Workshop Agenda at which time they will continue their review of
this matter.
Upon MOTION by COMMISSIONER CHAMBERS/COMMISSIONER WALDMAN, Mayor Boulay
adjourned the Special Meeting of the Town Commission at 11:25 A.M.
