BOARD OF ADJUSTMENT PUBLIC HEARING
DECEMBER 11 2007 1.35 P M
Vice-Chair Merton Rubin called the Public Hearing to order at 1:35 p.m. In attendance
were Vice-Chair Rubin, Anthony Ruotolo, Theresa Colarullo, Neil Burd and David Stern.
Chairman Jack Halpern and Peter Corrales were absent. Also in attendance were Town
Attorney Thomas E. Sliney, Building Official Bob Dawson and members of the general
public.
The Vice-Chair noted that this Public Hearing was scheduled for the following two
variances. Recording Secretary swore in all who would be testifying.

FENCES, WALLS AND HEDGES.
1~UESTING: INCREASE WALL FROM SIX FEET (6 FT} ALLOWED
• HEIGHT TO EIGHT FEET (8 FT).
Property Manager Joan Gregory spoke on behalf of the application. As questions arose,
it became apparent that the wall would be intermittent and not continuous from East to
West. Because each homeowner owns the property behind their homes directly to the
property line, and is not Association owned, the individual homeowner can decide if they
want to spend money on the new wall behind their homes. Some opted to leave the
existing fence. This would create a "spotty" look rather than a continuous new wall. The
Board members said that at their .site visit on November 15 they were under the
impression the entire length would be a wall. Due to the fact that the wall runs parallel
with Town Hall, the Town has a major interest in the appearance of the wall.
The Board asked the applicant to go back to the homeowners to resolve the request for
the wall and address the need for a continuous wall. The following MOTION was made
by MR. STERN/MRS. COLARULLO:

COME BACK TO THE BOARD AFTER SPEAKING WITH THE OCEAN
GRAND HOMEOWNERS ASSOCIATION, AND PRESENT A MORE
SUITABLE PLAN.
MOTION carried unanimously.

REQUESTING: INSTALLATION OF A BOAT LIFT (DAVIT) WITHIN
TWELVE (12) FEET OF THE PROPERTY LINE.
Attorney Les H. Stevens, was present on the applicant's behalf. It was noted by Mr.
Dawson and Mr. Stevens that the certified notices of the public hearing were not sent in a
timely manner, with residents receiving just one-two days prior to the meeting. Due to
this, the Board postponed the site visit and hearing to a later date of January 15, 2008
(thereafter changed to January 17, 2008). MOTION for this postponement was made by
MR. RUOTOLO/MRS. COLARULLO, with unanimous approval.
With no further business to come before the Board, Motion to Adjourn was made by MR.
RUBIN/MR. RUOTOLO at 2:10 p.m.
