Chairperson Joseph Sarubbi called the Workshop Meeting to order in
Commission Chambers at 9:30 a.m.
Deputy Town Clerk Jane Dillon called the roll. Present were Vice
Chair Merton Rubin, Joseph Yucht, Michael Hill, Barbara Eagel and
Jack Halpern. Peter Corrales was absent. Also in attendance was
Building Official Bob Dawson and Town Attorney Tom Sliney.
THIS IS A WORKSHOP MEETING TO REVIEW THE FOLLOWING PETITIONS FOR
VARIANCES:
NO. 05-05-88: REQUEST SUBMITTED BY MICHAEL SCHATZ, FOR
PROPERTY LOCATED AT 1096 BEL LIDO DRIVE.

SEEKING RELIEF FROM TOWN CODE OF ORDINANCES CHAPTER 30,
ARTICLE IV [ZONING DISTRICTS]; SECTION 68 [SUPPLEMENTAL
DISTRICT REGULATIONS]; (G)(6)d; MARINE FACILITIES.
• REQUESTING: REPLACE EXISTING DOCK WITH THE SAME SIZE
DOCK.
Recording secretary noted three pieces of correspondence. The first
submitted by Shelly and Richard Greenwald of 4308 Tranquility Drive,
have no objection if the dock is replaced with the same size dock,
but do have an objection if size is changed. Second from George
Barlow noting that he did not receive proper notification of the
Public Hearing, and third from Michael Radu, DDS objecting to the
application.
Petition presented by Mrs. Schatz. Mr. Dawson made the Board aware
that certified mailings were only sent to residents within 200 feet,
not the required 300 feet from subject property. Upon MOTION by MR.
HILL/MR. HALPERN, due to insufficient mailing, motion to be tabled.
Motion met with unanimous approval.

Petition was presented by Mr. Remmerden. Sally Shutt of 1083 Bel
Lido Drive, Host Suskind of 4216 Tranquility Drive were against the
application. They feel the house is much to large for the
neighborhood and is an eyesore. Third correspondence from Michael
Radu, DDS who opposes application, and third from Horst Susskind who
opposes application. The Board noted that the pool should have been
on the original plans rather then adding it now. Mr. Remmerden drew
a diagram of the odd shaped lot noting why he is claiming a hardship
to put the pool at a five foot setback.
After further discussion, the following MOTION was made by MR.
YUCHT/MR. HILL to approve subject application. The following

Petition was presented by Mr. Williams. who noted that he wishes to
add a stair tower on the roof in order to create a small open
viewing area. He also requested a pool setback of five feet. After
further discussion, MOTION was made by MR. YUCHT/MR. HILL to approve
application. Roll call vote carried unanimously.

DISTRICT REGULATIONS]; (p)(1); ROOF OVERHANGS.

REQUESTING: INCREASE MAXIMUM OVERHANG OF 10% TO SECOND
LEVEL (31%), THIRD LEVEL TO (20.3%).
Architect for project was present, noting this is currently a
fourteen unit rental with perpendicular parking in the front.
Developer wishes to build a multi family, three unit building,
consisting of two story townhouses with a single unit on top, with
common parking of ten spaces. The terrace will be for the top unit.
Legal Counsel for Vila Nova noted that the association had several
problems with this project, namely the very large observation deck,
room overhangs and the requested height. A Public Hearing was
scheduled for August 8, 2005 at 9:30 a.m.
With no further business to come before the Board, MOTION to adjourn
was made by MR. RUBIN/MR. HALPERN at 10:45 a.m.
