Chairperson Joseph Sarubbi called the Public Hearing to order in Commission Chambers at 9:30 A.M. Deputy Town Clerk Jane Dillon called the roll. Present were Vice Chair Merton Rubin, Joseph Yucht, and Peter Corrales. Barbara Eagel, Jack Halpern and Michael Hill were absent. Also in attendance was Building Official Bob Dawson and Town Attorney Tom Sliney and members of the general public. This Public Hearing was being held to discuss and receive public input for the following Variance Applications. Recording secretary sworn in all who would be testifying, and attested that all criteria had been met as far as publication of the meeting and notification to appropriate residents. NO. 06-04-74. REQUEST SUBMITTED BY JEFFERY H. NORMAN, PRESIDENT, OCEAN COVE, INC., GENERAL PARTNER, FOR PROPERTY LOCATED AT 4020 SOUTH OCEAN BLVD., LOT 10 (OCEAN COVE.) • OWNER, THE GARDENS AT HIGHLAND BEACH, LTD. SEEKING RELIEF FROM TOWN CODE OF ORDINANCES CHAPTER 30, ARTICLE IV [ZONING DISTRICTS]; SECTION 64 [PROPERTY DEVELOPMENT REGULATIONS]; TABLE 30-2. REQUESTING: REDUCE SIDE YARD SETBACK FROM 12 FEET TO 4 FEET This request is to accommodate a driveway on a corner lot. Mr. Norman will add a landscape buffer in the range of $15-20,000. With MOTION being made by MR. HILL/MR. HALPERN, the Board granted FINAL approval for Variance No. 06-04-74 with the commitment of Mr. Norman to maintain the landscape buffer. Motion carried unanimously. NO. 06-04-75. REQUEST SUBMITTED BY STEVE WILLIAMS FOR PROPERTY LOCATED AT 1020 BEL AIR DRIVE, LOT 4. OWNER, GLOBAL VOICES, LLC. SEEKING RELIEF FROM TOWN CODE OF ORDINANCES CHAPTER 30, ARTICLE IV [ZONING DISTRICTS]; SECTION 64 [PROPERTY DEVELOPMENT REGULATIONS]; TABLE 30-2. REQUESTING: REPLACE EXISTING 4 UNIT BUILDING WITH A NEW 3 UNIT BUILDING. This request is to demolish a building containing 4 apartments and construct three townhouses. Greg Bowen, 1101 Russell Drive and Shawn O'Day, Russell Drive were in support of project noting that any improvement to the property would be good. Upon MOTION by MR. HALPERN/MR. HILL, the Board granted FINAL • approval for Variance No. 06-04-75. Motion carried unanimously. r: Board of Adjustment and Appeals Auaust 17, 2004 Paae 2 of 2 NO. 06-04-76. REQUEST SUBMITTED BY KADO TUNDISI FOR PROPERTY LOCATED AT 4112 S. OCEAN BLVD., LOT 39. OWNER, KADO TUNDISI. SEEKING RELIEF FROM TOWN CODE OF ORDINANCES CHAPTER 30, ARTICLE IV [ZONING DISTRICTS]; SECTION 64 [PROPERTY DEVELOPMENT REGULATIONS]; TABLE 30-2. REQUESTING: REDUCE FRONT SETBACK FROM 40 FEET TO 25 FEET. REDUCE STREET SIDE SETBACK FROM 25 FEET TO 20 FEET. This request is to demolish existing one story apartments and construct a single family house. This variance was approved several years ago, but the time limit to obtain a permit expired. The owner presented the same plans as previously submitted. Upon MOTION by MR. YUCHT/MR. HALPERN, the Board granted FINAL approval for Variance No. 06-04-76. Motion carried unanimously. NO. 06-04-77. REQUEST SUBMITTED BY CHARLES AND ELLEN SOLLINS FOR PROPERTY LOCATED AT 1006 GRAND COURT, LOT 6. OWNER, CHARLES AND ELLEN SOLLINS. SEEKING RELIEF FROM TOWN CODE OF ORDINANCES CHAPTER 30, ARTICLE IV [ZONING DISTRICTS]; SECTION 64 [PROPERTY DEVELOPMENT REGULATIONS]; TABLE 30-2. REOUESTING: 36•°s OF LAND AREA COVERED. This request is to build on half a lot they own with neighbor, in order to enlarge existing house. This would be lot 6 and half of lot 7. Upon MOTION by MR. HALPERN/MR. YUCHT, the Board granted FINAL approval for Variance No. 06-04-77. Motion carried unanimously. It was noted that all findings and facts were met pursuant to Town Code for all four variances.
