Minutes of Meeting of Town Commission
WORKSHOP MEETING
Tuesday, Februar~~ 27, 1990 1x30 _P.M.
Mayor Joseph A. Boulay called the Workshop Meeting of the Town Commis-
sion of the Town of Highland Beach, Florida, to order at 1:30 P.M. in
the Commission Chambers at Town Hall. Others in attendance were Vice
Mayor John J. Basso, Commissioners Doris R. Rome, Marvin A. Waldman and
Betty Jean Stewart.
Also present were Town Attorney David K. Friedman, Town Manager Mary Ann
Mariano, Deputy Town Clerk Anne M. Kowals and members of the general
public..
ADDITIONS, DELETIONS OR ACCEPTANCE OF AGENDA
Following the addition of an Item (Receipt of Reverse Osmosis Study pre-
pared by J. M. Montgomery Engineers) under the Town Manager's Report,
the Agenda was accepted as amended.
90.1 Public Comments and Requests
• Dr. E. Pearson, a resident at the Seagate of Highland, noted that, as
suggested by the Town Commission at their last meeting, a mass letter
writing program regarding a manatee protection zone on the Intracoastal
Waterway in the Highland Beach area was undertaken and more than 100 of
such letters were delivered to County Commissioner Carol Roberts prior
to the February 14, 1990 County Commission Meeting. Dr. Pearson urged
the Town Commission and Town Attorney to prepare an ordinance to control
the boating speed limit on the Intracoastal Waterway in Highland Beach
that would compliment the ordinance that the Boca Raton officials may
pass with regard to speed control on the Intracoastal Waterway in the
Boca Raton area. During Dr. Pearson's commentary, a brief discussion
ensued at which time Commissioner Waldman complimented Commissioner Rome
for her efforts with regard to the problems on the Intracoastal Water-
way and noted that both Vice Mayor Basso and Commissioner Rome have been
concerned and involved in this fight for a number of years.
Ms. Helene Christiansen, a resident at the Seagate of Highland, stated
Mayor Boulay has been in the forefront in this situation and has
contacted numerous agencies and set up meetings with numerous parties.
Continuing, Ms. Christiansen said it was her hope that the rest of the
Commission will help as much as the Mayor has, then, we will get manatee
protection and speed control on the Intracoastal Waterway in the near
future.
Mr. Hal Chambers of 2524 South Ocean Boulevard, questioned the Town
• Attorney as to the current status with regard to political campaign
signs. Town Attorney Friedman noted that the Florida Department of
Transportation advised no signs may be placed along the right of way in

accordance to the Florida Statues and Regulations; however, Attorney
Friedman noted that that is a D.O.T. Regulation and the Town does not
get involved. When Mr. Chambers questioned the placement of signs on
property with permission of the owner, Attorney Friedman stated "with
prior written consent of the property owner, there is no problem".
Ms. Florence Riess, a resident at the Seagate of Highland Condominium,
commented that the sand at the construction site (Villa Costa) adjacent
to the Seagate Condominium blows around onto their cars and requested
help with the situation while the construction continues at that site.
It was noted that Ms. Jane Rayner of Seagate called this matter to the
attention of Project Manager Mike Everett who is cooperating in trying
to resolve this matter. The Town Manager will look into this matter to
see what can be done to help the residents at Seagate.
Mr. Michael Dent, residing at the Casuarina, commenting on Town Attorney
Friedman's response to Mr. Chamber's inquiry relating to the posting of
political campaign signs in the right of way, requested that the Mayor,
as head of the City, take no action in regard to somebody's complaint in
this matter.
• Mr. Jose Echeverria of Russell Drive, head of the Turtle Program as well
as the Beach Cleaning Program in Highland Beach, advised the Town
Commission that the beach clean-up suffered a drawback because of the
heavy winds. It was noted that volunteers are needed for these pro-
grams. Mr. Echeverria stated that although the Turtle Program starts in
May, turtles have been known to come on shore in April.
90.2 Boards and Committees
Mayor Boulay noted the existing Alternate Member Vacancy on the Planning
Board and acknowledged receipt of Dr. Grover Ensleys's resignation (sub-
mitted to the Chairman) from the Financial Advisory Board. The Mayor
noted that a letter of appreciation will be forwarded to Dr. Ensley.
Mayor Boulay requested the Commissioners review the Talent Bank Applica-
tions for possible appointments at the March 6, 1990 Regular Meeting.
90.3 Proposed Ordinances and Resolutions
1. AN ORDINANCE AMENDING CHAPTER 29 ENTITLED "WATER SYSTEM",
SEC. 29-24 ENTITLED "DEFINITIONS", SEC. (4) ENTITLED
"WATER SHORTAGE"; SEC. 29-24 (c) (1) AND SEC. 29-24 (c)
(1) A ENTITLED "IMPLEMENTATION"; SEC. 29-24 (c) (2)
ENTITLED "WATER USES"; SEC. 29-24 (d) ENTITLED "ENFORCE-
MENT"; PROVIDING AN EFFECTIVE DATE.
• The proposed ordinance had first reading on 2/6/90 and was published on
2/16/90. Following brief discussion, this matter was moved for final
consideration to the March 6, 1990 Regular Meeting Agenda.

2. AN ORDINANCE OF THE TOWN OF HIGHLAND BEACH, FLORIDA,
AMENDING THE TOWN CODE OF THE TOWN OF HIGHLAND BEACH,
FLORIDA, TO WIT: CHAPTER 7, ENTITLED "BUILDINGS", SECTION
7-l.l PROVIDING FOR A MINIMUM PERMIT FEE, PROVIDING AN
EFFECTIVE DATE.
The proposed ordinance had first reading on 2/6/90 and was published on
2/16/90. Following discussion and amendment of this ordinance, it was
the consensus of the Town Commission that this matter should be moved to
the Agenda for the March 6, 1990 Regular Meeting.
87.4 Discussion re March/April 1990 Newsletter
The Town Commission reviewed a draft of the March/April Newsletter.
Following a recommendation to increase the information under Water
Restrictions, the Town Commission accepted the March/April Newsletter.
89.17 Discussion re status of code recodification
The Town Commission moved the discussion regarding the status of the
. code recodification to the Agenda for their March 27, 1990 Workshop
Meeting.
MISCELLANEOUS - ITEMS LEFT OVER
Status of Building Development in Town
The Status of Building Development in Town, prepared by the Building
Official, was received as information by the Town Commission.
Minutes for approval at March Regular Meeting
Two sets of Minutes to be submitted for approval at the March Regular
Meeting of the Town Commission were reviewed. An amendment to the
February 6, 1990 Regular Meeting Minutes was recommended by Commissioner
Stewart.
REPORTS - TOWN COMMISSION
Mayor Joseph A. Boulay
Mayor Boulay reported that he was invited to participate in the "Good
Morning America" Show which had been aired from the Breakers Hotel in
Palm Beach, Florida. on Friday, February 23, 1990.

Commissioner Doris R. Rome
No report; however, Commissioner Rome expressed her appreciation to the
Palm Beach Post for their endorsement of her as Town Commissioner in the
upcoming Municipal Election on March 13, 1990.
Commissioner Marvin A. Waldman
Commissioner Waldman had no report; Commissioner Waldman did comment
that he would like everyone to do something good for the Town, reelect
John Basso and Doris Rome.
Commissioner Betty Jean Stewart
Commissioner Stewart, in order to avoid any confusion, requested that
the Town Commission consider naming the proposed park behind Town Hall
and asked Members to bring their suggestions to the March 6, 1990
Regular Meeting at which time she will again bring up this matter.
REPORTS - TOWN ATTORNEY

With regard to the Palm Beach County Fire/Rescue Contract, Attorney
Friedman noted receipt of a letter from Assistant County Attorney Denise
D. Barile, dated 2/16/90. This matter will be placed on the Agenda for
the March 6, 1990 Regular Meeting for further discussion.
Attorney Friedman reported that his office and Attorney Dan Rosenbaum
are working on a proposed settlement agreement to offer to the Hoffmanns
which is similar to the Broadview Savings and Loan settlement agreement.
The Town Attorney noted that the Planning Board is working to implement
the range of densities for the Comprehensive Plan and has recommended a
proposed parking ordinance. In this regard, a Public Hearing is set for
5:01 P.M., this date, to receive public comment and give first reading
to this proposed ordinance.
REPORTS - TOWN MANAGER
Town Manager Mariano reported on the status of pending Town projects and
noted that the "Bike Path Study" by Gee & Jenson is under way. Mr. Jim
Park, Senior Planner at Gee & Jenson, will be in attendance at the March
6, 1990 Regular Meeting to give an update on the study to the Town
Commission.

The matter of the Topographical Survey by Gentry Engineers of the Town
Hall Property is under way and, upon completion, Urban Design Studio
will continue the preliminary site plan of the park behind the Town
Hall.
Town Manager Mariano extended congratulations to the Highland Beach
Police Department for having passed the recent inspection conducted by
the Florida Department of Law Enforcement.
Town Manager Mariano submitted a list of poll workers for the March 13,
1990 Municipal Election. This matter will be placed on the Consent
Agenda for the March 6, 1990 Regular Meeting.
The Town Manager acknowledged receipt from James M. Montgomery Engineers
of the Reverse Osmosis Study. The Town Commission directed the Water
Resources Advisory Board to review the Study and transmit their recom-
mendations to the Town Commission
There being no further business to come before the Town Commission at
this Workshop Meeting, Mayor Boulay adjourned same at 2:35 P.M.

PUBLIC HEARING
TUESDAY, FEBRUARY 27, 1990 5:P11 P.M.
The advertised Public Hearing of the Town Commission of the Town
of Highland Beach, Florida, was called to order at 5:811 P.M. by
Mayor Joseph A. Boulay in the Commission Chambers at Town Hall.
Others present were Vice Mayor John J. Basso, Commissioners Doris
R. Rome and Betty Jean Stewart. Commissioner Marvin A. Waldman
was absent.
Mayor Boulay noted that the purpose of this advertised Public
Hearing was to receive public comment and give first reading to
the following proposed ordinance:
AN ORDINANCE OF THE TOWN OF HIGHLAND BEACH, FLORIDA, AMENDING
THE CODE OF ORDINANCES OF THE TOWN OF HIGHLAND BEACH, CHAPTER
30, ENTITLED "ZONING", SECTION 5.8 ENTITLED "OFF-STREET PARK-
ING", SECTION 5.9 ENTITLED "OFF-STREET LOADING"; PROVIDING
FOR VISIBILITY TRIANGLES TO IMPROVE VISIBILITY AT INTER-
SECTIONS; PROVIDING FOR MAINTENANCE OF VEHICULAR USE AREAS;
PROVIDING FOR THE NUMBER, LOCATION AND WIDTH OF ACCESS
DRIVEWAYS; PROVIDING FOR DESIGN STANDARDS FOR VEHICULAR USE
AREAS; PROVIDING FOR AN EFFECTIVE DATE.
With one resident in the audience, there were no public comments
forthcoming when Mayor Boulay requested same.
Following discussion of this proposed ordinance, it was the
consensus of the Town Commission that this matter required further
study and, in this regard, another Public Hearing will be
scheduled at an early date.
There being no further business to come before the Town Commission
at this advertised Public Hearing, upon proper MOTION, Mayor
Boulay adjourned same at 5:35 P.M.
