1990.01.30_TC_Minutes_Workshopc* TOWN OF HIGHLAND BEACH, FLORIDA • Minutes of Meting of Town Commission WORKSHOP MEETING Tuesday, January 30, 1990 1:30 P.M. Mayor Joseph A. Boulay called the Workshop Meeting of the Town Commis- sion of the Town of Highland Beach, Florida, to order at 1:30 P.M. in the Commission Chambers at Town Hall. Others in attendance were Vice Mayor John J. Basso, Commissioners Doris R. Rome, Marvin A. Waldman and Betty Jean Stewart. Also present were Town Attorney Thomas E. Sliney, Town Manager Mary Ann Mariano, Deputy Town Clerk Anne M. Kowals and members of the general public. ADDITIONS, DELETIONS OR ACCEPTANCE OF AGENDA The Town Commission accepted the Agenda as submitted. 90.1 Public Comments and Requests Mrs. Sadie Spadafina of 1105 Russell Drive requested the Town allow more flexibility on Russell Drive with regard to service/repairman being per- mitted to park on the street when they are working in a residence. Mrs. . Spadafina, noting most of the residences on Russell Drive have garbage bins where garbage pails are kept, asked that the next Newsletter include a request for all residents to use the back door service (keep their garbage pails in the bins where they would be picked up by the County Sanitation Workers who would return the pails to the bins after they are emptied). This, Mrs. Spadafina feels, would end the hazard of empty pails blowing around in the roadway. Mr. Michael Dent, a resident of the Casuarina, stated that he hopes the Town Commission takes to heart some of the complaints registered by the Highland Beach residents at the January 2, 1990 Regular Meeting. Mr. Dent noted that his letter of January 27, 1990 to Mayor Boulay, with copies to the Town Commission, made a number of points, one of which is that the Mayor, who works his best with the Town Commission, needs more cooperation from the Members. Mr. Patrick Beary, Seagate of Highland resident, addressed the Town Com- mission on behalf of Dr. E. Pearson, Chairman of the Manatee Protection Committee in Highland Beach, who was unable to attend this meeting. Mr. Beary noted that Dr. Pearson, Mayor Boulay and he attended the meeting in West Palm Beach on January 4, 1990 regarding the protection of the • • • r- Town Commission Workshop Meeting Minutes January 30, 1990 Page 2 of 6 manatees and further noted that the next meeting on this matter is scheduled for February 1, 1990 at 7 P.M. at the Governmental Center on Olive Avenue in West Palm Beach. Talent Bank Applicant Stuart Rader residing at the Regency Highland, an attorney with Heinberg, Heinberg & Rader of West Palm Beach was inter- viewed by the Town Commission. Paul Olson of 4118 S. Ocean Boulevard, a Highland Beach resident for 17 years, who is a surfer, questioned if surfing will be eliminated at the site of Jap Rock. Mr. Olson noted that that location is a special area to a lot of people and it is known in surfing magazines where it is also referred to as Yamato Rock. Mr. Olson further noted that the best breaks occur on the rocks. 90.2 Boards and Committees Mayor Boulay noted the various vacancies on the Town Boards; possible appointments may be considered at the next Regular Town Commission Meet- ing on February 6, 1990. There was no correspondence received from any Town Boards. 90.03 Proposed Ordinances and Resolutions 1. AN ORDINANCE AMENDING CHAPTER 29 ENTITLED "WATER SYSTEM", SEC. 29-24 ENTITLED "DEFINITIONS", SEC. (4) ENTITLED "WATER SHORTAGE"; SEC. 29-24 (c) (1) AND SEC. 29-24 (c) (1) A ENTITLED "IMPLEMENTATION"; SEC. 29-24 (c) (2) ENTITLED "WATER USES"; SEC. 29-24 (d) ENTITLED "ENFORCE- MENT"; PROVIDING AN EFFECTIVE DATE. Following considerable discussion of the proposed ordinance, several amendments which were suggested will be incorporated into same. It was the consensus of the Town Commission that this matter should be moved to the February 6, 1990 Regular Meeting Agenda for first reading. 2. AN ORDINANCE OF THE TOWN OF HIGHLAND BEACH, FLORIDA, AMENDING THE TOWN CODE OF THE TOWN OF HIGHLAND BEACH, FLORIDA, TO WIT: CHAPTER 7, ENTITLED "BUILDINGS", SECTION 7-1.1 PROVIDING FOR A MINIMUM PERMIT FEE, PROVIDING AN EFFECTIVE DATE. Following discussion of the proposed ordinance, it was the consensus of the Town Commission that same should be moved to the February 6, 1990 Regular Meeting Agenda for first reading. • Town Commission Workshop Meeting Minutes • January 30, 1990 Page 3 of 6 89.14 Discussion re Palm Beach County Fire/Rescue Interlocal Agreement The Town Commission Members discussed the Palm Beach County Fire/Rescue Interlocal Agreement and suggested changes to this contract, which changes they requested be reviewed by the Town Attorney. Attorney Sliney noted that the County, wanting to keep their contracts uniform, does not want to incorporate any changes into the contract; all changes are to be in the form of a "letter addendum" which is attached to the contract. The amended Agreement (letter addendum) will be placed on the Agenda for the February 6, 1990 Regular Meeting of the Town Commission. 89.17 Discussion re status of code recodification Following a brief discussion, it was noted that the status of the code recodification was in the hands of the sub-committee; their review of the code recodification will be completed following the Municipal Elections scheduled for March 13, 1990. MISCELLANEOUS - ITEMS LEFT OVER . Status of Building Development in Town The Town Commission received the Status of Building Development in Town, a report prepared by the Building Official, as information. Town Manager Mariano informed the Town Commission that the Mitigation Report submitted by Hidden Harbor is available for inspection in the Building Department. Minutes for approval at February Regular Meeting Two sets of Minutes to be submitted for approval at the February Regular Meeting of the Town Commission were discussed. An amendment to the January 2, 1990 Regular Meeting Minutes was suggested by Commissioner Stewart. REPORTS - TOWN COMMISSION Mayor Joseph A. Boulay Mayor Boulay reminded the Members of the Town Commission that Town Manager Mary Ann Mariano's evaluation is due on February 1, 1990 and requested that the evaluation forms, distributed to each Member in advance of this Workshop Meeting, be returned to the Finance Department. The Mayor reported that Town Manager Mariano and he met for 45 minutes with representatives of Adelphia Cable Co. who outlined plans to bring • the Town's Cable System up to date. Montgomery Engineers, he was advised that the Reverse Osmosis Study is in the hands of the chief engineer for a final review; same will be submitted to the Town by the end of this week and is expected to be transmitted to the Town Commission at their Regular Meeting on February 6, 1990 where it will then be transmitted to the Water Resources Advisory Board. Regarding the Town Boards and Committees, Mayor Boulay informed the Town Commission that Community Appearance Board Regular Member Reginald Towner is seriously ill; and, Anne Galizia, wife of Community Appearance Board Co-chairman Guy Galizia, had undergone serious surgery in Jacksonville. With regard to Mr. Beary's comments made earlier in this meeting, the Mayor reminded all that a meeting is scheduled for Thursday, February 1, 1990 from 7 P.M. to 9 P.M. at the Palm Beach County Governmental Center on Olive Avenue in West Palm Beach with regard to Manatee Protection on the Intracoastal Waterway. Commissioner Betty Jean Stewart Commissioner Stewart presented to Mr. Patrick Beary (who spoke earlier in the meeting re the protection of the Manatee on the Intracoastal Waterway) printed material from the Palm Beach Countywide Beaches and Shores Council regarding the concerns for the Manatee. Commissioner Stewart reported that re the Beaches and Shores Council, a letter was received from Ocean Impact Foundation concerning the pruning of Seagrape to a very low level in the section of Sloan's Curve. It was noted that cutting back the Seagrape causes the demise of the dune system. Commissioner Stewart stated that most people on the beach are aware of the fragile beach area and they do not cut down the Seagrapes. Commissioner Stewart requested that the Members give some thought to the Seagrape pruning prior to the next Regular Meeting on February 6, 1990, at which time, the Commissioner would be interested to learn their • position on this matter. ~. Town Commission Workshop Meeting Minutes • January 30, 1990 Page 5 of 6 REPORTS - TOWN ATTORNEY Attorney Sliney noted that certain correspondence received with regard to the Broadview matter was inaccurate and Attorney Dan Rosenbaum will be responding to those inaccuracies. The Town Attorney noted that, through combined efforts, it is hoped this matter will be settled. REPORTS - TOWN MANAGER Town Manager Mariano requested, and the Town Commission Members agreed, that the matter of the proposed Town Park be addressed at this time, inasmuch as Ms. Jo Ellen Leisinger of Urban Design Studios was in attendance. Following substantial discussion of the proposed contract, amendments that were agreeable to all parties were suggested and will be incorporated in the revised contract. It was the consensus of the Town Commission that this matter be moved to the February 6, 1990 Regular Meeting Agenda, under Items Left Over. The Town Manager reported that a preliminary audit from Coopers and Lybrand is awaited and same will be reviewed by the Financial Advisory Board, after which it will be submitted to the Town Commission. The • Town Manager noted that the Town Seal will be delivered shortly for approval of the Town Commission. Mrs. Mariano further noted that the Police Vehicles were upgraded with new striping and markings (received from the Department of Transportation) in an effort to reduce the Town's insurance premiums. Representatives from the Tax Appraiser's Office processed a total of 70 Homestead Exemption Applications and 6 changes at Town Hall on January 9, 1990. Town Manager Mariano informed the Town Commission that in January, 1990, the Water Department pumped 9-1/2~ less water than in January, 1989. Town Manager Mariano advised the Town Commission that Mr. Mark Rothenberg (Lot 90, 3425 South Ocean Boulevard) received a recommenda- tion of approval for his proposed project from the Community Appearance Board; a recommendation of preliminary approval was received from the Planning Board and it is expected that a final recommendation of ap- proval will be forthcoming at the Planning Board Special Meeting on Wednesday, January 31, 1990. The Town Manager requested permission to place this matter on the February 6, 1990 Town Commission Regular Meeting Agenda. It was noted that qualifying for the March 13, 1990 Municipal Election began at noon on Tuesday, January 30, 1990 (both incumbents filed at noon) and will continue until noon on Tuesday, February 13, 1990. Town Manager Mariano submitted a proposed resolution regarding unfunded State mandates. It was the consensus of the Town Commission that this • matter should be placed on the February 6, 1990 Regular Meeting Agenda. The Town Manager suggested that a copy of said resolution should be s, Town Commission Workshop Meeting Minutes • January 30, 1990 Page 6 of 6 forwarded to the condominium (following its adoption) for posting to make the citizens aware of the ramifications of the resolution prior to voting. There being no further business to come before the Town Commission at this time, Mayor Boulay adjourned the Workshop Meeting at 3:30 P.M.
