BOARD OF ADJUSTMENT
WORKSHOP MEETING
Wednesday, May 24, 2000 9:30 A.M.
Chairman James F. Niehoff called the Workshop Meeting to order in
Commission Chambers at 9:30 A.M.
Deputy Town Clerk Jane Dillon called the roll. Present were
Chairman James F. Niehoff, Vice-Chair Victor P. Hadeed, Leonard
D.Bell, Betty Jane Hofstadter, Barbara Kane and Catherine
Friedenreich. Also present was Town Attorney Thomas E.Sliney and
Building Official Bob Dawson.
Chairman Niehoff stated that this workshop meeting was to hear the
following Petition for Variance:
NO. 05-00-66. REQUEST SUBMITTED BY ARTHUR KAYE FOR PROPERTY
LOCATED AT 2624 SOUTH OCEAN BLVD., TO DEMOLISH EXISTING RESIDENCE
AND CONSTRUCT A NEW SINGLE FAMILY HOUSE. SEEKING RELIEF FROM TOWN
CODE OF ORDINANCES CHAPTER 30 [ZONING]; SECTION 4.2 (e} LOT, YARD,
AND BULK REGULATIONS, AND SECTION 5.2(b)(2) POOLS AND POOL DECKS.
REQUESTING: REDUCE REQUIRED FRONT YARD SETBACK FROM 25 FEET TO 15
FEET; REDUCE REQUIRED SIDE YARD SETBACK FROM 12 FEET TO 9 FEET;
• REDUCE REQUIRED REAR YARD SETBACK FROM 20 FEET TO 17 FEET;
REDUCE REQUIRED POOL SETBACK FROM REAR PROPERTY LINE FROM 10 FEET
TO 2 FEET; REDUCE REQUIRED POOL SETBACK FROM SIDE PROPERTY LINE
FROM 10 FEET TO 8 FEET;
INCREASE MAXIMUM BUILDING HEIGHT FROM 30 FEET TO 35 FEET.
Chairman Niehoff stated that no decision will be made by the Board
at this meeting and that an Advertised Public Hearing will be held
whereby a decision will be determined. At the conclusion of this
meeting, an on site visit of the property will be conducted.
Recording Secretary swore in Attorney Scott Elk who was present to
represent Mr. Kaye. Mr. Elk stated that the current house is non-
conforming with existing codes, and that variance is requested in
order to construct a home to support the land value and be
consistent with other homes in the area.
There was question as to the hardship being presented regarding the
request for increase in height. Chairman Niehoff suggested that
before the Public Hearing, Applicant see if architect could modify
the design to a 30 foot height limitation.
It was requested that information regarding the "Arnold" house and
its approved height conformities be available to the Board at the
Public Hearing for comparison in height conformity.

An Advertised Public Hearing was scheduled for June 28 at 9:30 A.M.
Applicant will notify residents within 300 feet of subject
property, and appropriate publications will be made.

Chairman Niehoff recessed the meeting at 10:05 a.m. to conduct an
on site visit. Meeting was reconvened at 10:32 and promptly
adjourned upon MOTION by MR. HADEED/MR. BELL.
