1997.01.14_BAA_Minutes_Workshop~_ - ' • TOWN OF HIGHLAND BEACH BOARD OF ADJUSTMENT QUARTERLY/WORKSHOP MEETING MINUTES Tuesday January 14, 1997 9:30 A.M. Chairman Neil W. Burd called the Quarterly Meeting to order in Commission Chambers at 9:30 A.M. Deputy Town Clerk Jane Dillon called the roll. Present were Chairman Neil W. Burd, Members Benjamin Cohen, Richard C. Seguso, and James F. Niehoff. Vice Chair Daniel J. Loventhal and Member Victor P. Hadeed were absent. Town Attorney Tom Sliney and Building Official James Du Vall were present, as well as members of the general public. Upon MOTION by MR. COHEN/MR. NIEHOFF, the minutes of the October 15, 1996 Quarterly Meeting were unanimously approved. ELECTION OF OFFICERS Due to the absence of three members, Chairman Burd suggested the Election of Officers be deferred until the next Quarterly Meeting. OTHER BUSINESS • Chairman Burd presented Mr. Selby with a Certificate of Appreciation for his six year tenure on the Board of Adjustment, completed December 31, 1996. Mr. Selby thanked the Board and expressed his thanks on being able to serve the Town. ADJOURNMENT With no other business to come before the Board at this time, MOTION was made by MR. COHEN/MR. NIEHOFF to adjourn the Quarterly Meeting at 9:40 a.m. NEW BUSINESS Immediately following the Quarterly Meeting, Chairman Burd called the Workshop Meeting to order at 9:41 a.m. It was noted that all preceding members were present. Chairman Burd advised the applicants on the procedures'of the Workshop meeting and forthcoming Advertised Public Hearing.. The first Petition for Variance to be heard was No. 01-97-58. REQUEST SUBMITTED BY MR. MILAN PEVNY FOR PROPERTY LOCATED AT 4314 TRANQUILITY DRIVE, LOT 6, BLOCK 4. SEEKING RELIEF FROM TOWN CODE OF ORDINANCES CHAPTER 30 [ZONING, SECTION 5.2 (d) NON COMMERCIAL DOCKS, PIERS, LAUNCHING • Board of Adjustment Quarterly/Workshop Meeting January 14, 1997 Page 2 of 3 FACILITIES AND MOORING DEVICES. REQUESTING PROPOSED BOATLIFT TO EXTEND TWENTY (20) FEET OUT FROM THE BULKHEAD/SEAWALL AT THE PROPERTY LINE. • All those who would be testifying on behalf of this Petition were sworn in and stated their names. Mr. Du Vall stated that the applicant was not in conformance with Town code, and was seeking 15 feet beyond existing dock to install a boatlift. Mr. Victor Valli, Jr. (authorized agent) testified on the Pevy's behalf and stated that the existing dock was installed only a year ago, and in order to install a boatlift within code, the dock would need to be removed and the lift installed on the seawall. The owners want to keep existing dock and install lift from same, creating the needed 15 foot extension from the dock. The hardship being claimed is the possibility of having to remove existing new dock to stay within code, and the necessity for a lift due to the family being out of the area most of the time and the need to keep their boat out of the water. Mr. Valli discussed the type of lift to be installed and showed pictures to the Board of like ones. The second Petition for Variance to be heard was No. O1-97-59. REQUEST SUBMITTED BY R.M. RANKIN FOR PROPERTY LOCATED AT 2474 S. OCEAN BLVD., BLOCK 1, LOT 127. SEEKING RELIEF FROM TOWN CODE OR ORDINANCES CHAPTER 30, [ZONING], SECTION 4.2, RESIDENTIAL SINGLE FAMILY (RS), PARAGRAPH (e), LOT, YARD AND BULK REGULATIONS. REQUIRED SIDE YARD SETBACK: TWELVE (12) FEET. REQUESTING THE PRE-EXISTING BOATHOUSE AND GARAGE LOCATED ON THE NORTH PROPERTY LINE BE ALLOWED TO REMAIN AS AN ACCESSORY STRUCTURE TO THE NEW RESIDENCE. The date of Tuesday, February 11 at 9:30 a.m. was selected to hold the Advertised Public Hearing. With all questions being answered, Chairman Burd recessed the Workshop meeting at 10:12 am in order that the members could conduct the site inspections.
