BOARD OF ADJUSTMENT
QUARTERLY/WORKSHOP MEETING
MINUTES
Tuesdav, Januarv 16, 1996 9:30 A.M.
Chairman Harold B. Cohen called the Quarterly Meeting to order in
Commission Chambers at 9:30 A.M.
Chairman Cohen congratulated James F. Niehoff on his appointment to
the Board for the next three years, and also congratulated Vice
Chair Burd on his reappointment to the board for the next three
years.
Deputy Town Clerk Jane Dillon called the roll. Present were
Chairman Harold B. Cohen, Vice Chairman Neil W. Burd, Members
Robert F. Selby, Daniel J. Loventhal, Benjamin Cohen, Richard C.
Seguso and James F. Niehoff.
Town Manager Mary Ann Mariano and Town Attorney Tom Sliney were
present, as well as members of the general audience.
ELECTION OF OFFICERS
• Upon Motion by Mr. Loventhal/Mr. B. Cohen, HAROLD B. COHEN was
unanimously re-elected CHAIRMAN.
Upon Motion by Mr. Loventhal/Mr. Seguso, NEIL W. BURR was
unanimously re-elected VICE-CHAIRMAN. .
Upon Motion by Mr. H. Cohen/Mr. J. Niehoff, MR. RICHARD C. SEGUSO
was unanimously elected SECRETARY.
APPROVAL OF MINUTES
The minutes of the October 12, 1995 Quarterly/Workshop meeting
were unanimously approved upon MOTION by MR. B. COHAN/MR.
LOVENTHAL.
The minutes of the October 20 and October 26, 1995 Workshop
Meetings were unanimously approved by MOTION by MR. BURR/MR.
LOVENTHAL.
CORRESPONDANCE
Newspaper Article regarding building in Highland Beach.
There being no further business to come before the Board at this
time, the Quarterly Meeting was adjourned at 9:40 A.M.
Immediately following the Quarterly Meeting, Chairman Cohen called
the Board of Adjustment Workshop Meeting to order at 9:41 A.M. He
noted that all the preceding members in attendance were present.

The agenda item to be heard was a request for petition (No. 01-96-
57), submitted by Mr. and Mrs. Kelvin Claney for property located
at 3901 South Ocean Blvd., Lot 64A, seeking relief from Town Code
of Ordinances Chapter 30 [Zoning], Section 4, Zoning Districts,
Section 4.2, Residential Single Family (RS), (e) lot, yard and bulk
regulations..
Requesting two foot, 10" on the south portion of the front of the
lot and six foot 10" on the north portion of the front lot, leaving
a setback from AlA of 22 feet 2" at the south portion of the lot
and 18 foot 2" to the north.
Chairman Cohen advised applicant of the procedures of the Workshop
meeting and forthcoming Public Hearing.
Chairman Cohen asked the applicant, Mrs. Claney, to present her
case and hardship. She stated that the lot is small, and while
there is not a real hardship and a few feet here and there could be
taken off the plans, she would like the additional space the plans
would provide.
Building Official Ed Hardy presented his views to the board, and
• explained how the current home is going to be torn down, but the
owners would like to keep the present pool, which is now 2 feet
into the CCC. They would like to extend the new home closer to AlA
in order to keep from loosing patio area around the pool.
In answer to Mr. Loventhal, Mr. Hardy did state that the plans
could be reworked to come within the zoning ordinance. Mr. Hardy
also stated that he has not seen a hardship on this case yet, and
also if the entire home is torn down, then the pool would have to
be taken out in order to conform to town code.
Chairman Cohen suggested the applicant rework the plans with her
architect in order that the Board would have the proper information
to work with.
It was suggested the Workshop meeting be adjourned until further
notice of a second workshop meeting.
The next Quarterly Meeting is scheduled for April 16, 1996.
Upon MOTION by MR. BURR/MR. LOVENTHAL the workshop meeting was
adjourned at 9:55 A.M.
