1995.05.22_BAA_Minutes_Regular~` ' • • • TOWN OF HIGHLAND BEACH BOARD OF ADIUSTMENT WORKSHOP MEETING MINUTES Monday, May 22, 1995 9:30 A.M. Chairman Harold B. Cohen called the Workshop Meeting to order in Commission Chambers at 9:30 A.M. Deputy Town Clerk Gretchen Dayton called the roll. Present were the Chairman, Vice Chairman Robert F. Selby, Secretary Jane Rayner and Members Benjamin Cohen, Richard C. Seguso and Neil W. Burd. Members Daniel J. Loventhal was absent. Also present were Building Official Lee Leffingwell, Town Attorney Thomas E. Sliney and members of the general public. The Chairman noted no decision on the petition would take place at this time; rather the workshop meeting was being conducted to review plans and hear testimony regarding petition for variance, after which the meeting would be recessed to allow for a physical inspection of the site. It was also advised that a date for the Public Hearing is scheduled • for June 6, 1995. NO. 05-95-55 Request submitted by Charles Tozzi for property located at 4108 South Ocean Boulevard, Lot 41 W East, Highland Beach, Florida. Pursuant to the Town Code of Ordinances, Chapter 30 [zoning], section 5, Supplementary district regulations, Section 5.2 (B) pools and pool decks. Petitioner is seeking relief from the twenty-five (25) feet front yard set back to fifteen (15) feet front yard set back in order to construct a swimming pool and twelve (12) feet front yard set back from the required twenty (20) feet front yard set back in order to construct a pool deck. At this time Mr. Charles Tozzi was sworn in. Mr. Tozzi stated he is acting as agent for the property owner, Mr. Tim O'Connor and has a purchase contract for the property pending at this time. He explained that the house is set back from Alternate A 1 A forty feet as per code requirements, and most of the other lots on Alternate A 1 A are about fifty feet longer than this particular piece of property. Therefore, the strict adherence to this ordinance would deprive him of rights commonly enjoyed by other properties in the same district and cause undue hardship. • • • BOA WS Min 5/22/95 Pg. 2 The Board discussed the possibility of altering the shape of the pool, which may require a lesser variance. Concluding review and discussion, Chairman Cohen recessed the meeting at 9:50 A.M. to allow for a physical inspection of the property, following which meeting was adjourned at 10:25 A.M.
