Minutes of Meeting of Town Commission
WORKSHOP MEETING
Tuesday October 29 1991 1:30 P.M.
Mayar Joseph A. Boulay called the Workshop Meeting of the Town
Commission of the Town of Highland Beach, Florida, to order in the
Commission Chambers at Town Hall at 1:30 P.M. Others present were
Vice Mayor Bill Paul, Commissioners Arlin Voress and John F. Rand.
Absent was Commissioner Arthur Eypel.
Also in attendance were Town Attorney Thomas E. Sliney, Town
Manager Mary Ann Mariano, Town Clerk Anne M. Kowals and members of
the general public.
Following Town Manager Mariano's request to delete Item 2 under
the Town Manager's Report (Agenda Report Form re P. B. County
CDBG Program), the Agenda was accepted as amended.

No individuals stepped forward to address the Town Commission.
Mayor Boulay noted the existing vacancy on the Town's Board of
Adjustment.
The Commission interviewed Talent Bank Applicant Richard Seguso, a
full time residentjowner at the Ambassadors South Condominium
where he serves on the Board of Directors, who has expressed an
interest in serving the Town on the Board of Adjustment. Mayor
Boulay thanked Mr. Seguso for attending this Workshop Meeting and
advised the Commission will consider an appointment to that Board
vacancy at their November 05, 1991 Regular Meeting.
Following discussion of a Talent Bank Application indicating the
applicant resides in Town for seven months and would be available
by mail or phone for the remainder of the year, the Commission
directed the Tawn Clerk's Office to follow the policy of informing
the applicant by mail that the Board of his choice requires year-
round residency, however, the applicant may consider serving on
any Town Ad Hoc Committee that would be on a short term basis.
Mayor Boulay acknowledged receipt of correspondence from Mr. David
• Greene of 20867 Cipres Way, Boca Raton, Florida 33433, who was
present to explain his request regarding the leasing of Town owned
property on Federal Highway (adjacent to the Town's Water Treat-
ment Plant in Baca Ratan which is a licensed well field) from the

Town of Highland Beach. Following considerable discussion of the
matter, it was the consensus to oppose the leasing of said
property and deny Mr. Greene's request.
1. AN ORDINANCE OF THE TOWN OF HIGHLAND BEACH, FLORIDA,
AMENDING THE CODE OF ORDINANCES SECTION 2-28 ENTITLED
RULES OF PROCEDURE BY AMENDING RULE NO. 1 PROVIDING FOR
CHANGE IN TIME OF THE REGULAR MONTHLY MEETING OF THE TOWN
COMMISSION.
The ordinance, given first reading on 10/01/91 and published on
10/18/91, was read by title only by Mayor Boulay. It was the
consensus to move this matter to the Agenda for the November
Regular Meeting for consideration.

During discussion of the November/December Newsletter, the new
format was acknowledged as was the inclusion of the invitation to
the Government Day "open House" which is scheduled for Thursday,
December 05, 1991 from 10:00 A.M. to 3:00 P.M. It was noted that
. information regarding an additional recycling pick up on Thursdays
from November 15 through April 15 has been arranged at no extra
charge to residents was included in this issue of the Newsletter.
The Commission directed that the Newsletter be processed for
mailing as soon as possible.
The Commission complimented Deputy Town Clerk Trinley for a job
well done in preparing the Newsletter.
Status of Bui~dina Development in Town
The Commission received as information the Status of Building
Development in Town, a report prepared by the Building Official.
Minutes for approval at November Regular Meetincr
The Members discussed three sets of Minutes; same will be placed
on the November Regular Meeting Agenda for consideration.
Vice Mavor Bi11 Paul
• Under his report, vice Mayor Paul, noting the cable t.v. outage
that occurred on Friday, 10/25/91, stated residents were advised

by Adelphia Cable personnel that the matter could not be rectified
as the Town of Highland Beach does not permit their technicians to
work in Town on Saturdays. The Vice Mayor, noting that was not a
fact as any registered individual is permitted to work in Town on
Saturdays (particularly when it involves the Town's cable t.v.
service), stated he found it offensive for the Cable Company to
place the blame on the Town. It was the consensus to have the
Town Manager handle the matter by submitting a letter to Mr. Chuck
Blaine, Development/Community Relations Coordinator at Adelphia
Cable, advising him of the situation.
Commissioner Arlin Voress
Commissioner Voress had no report.
Commissioner Arthur Evnel
Commissioner Eypel was absent.
Commissioner John F. Rand
Commissioner Rand, under his report, reminded the winter residents
• that the edited tape of the Palm Beach County Budget Public Hear-
ing of 9/05/91 will be replayed at 1:00 P.M. on each Wednesday in
November, December 04 and 11, and on each Wednesday in January,
1992, except for January 01, 1992. The Commissioner urged all to
pay attention to the time schedules that will appear in the Com-
munity Newsletter and on Government Channel 12.
Commissioner Rand stated he arranged to have Pooled Investment
Fund material distributed to each Commissioner for their review.
With regard to this matter, the Commissioner requested (and was
granted) authorization from his colleagues to meet with Financial
Representatives from the Cities of Boca Raton and Delray Beach
(both Cities participate in the State Pooled Investment Fund) to
discuss the issues involved in this program. Town Manager Mariano
was requested to arrange such meetings for Commissioner Rand.
Mayor Joseuh A. Boulav
Mayor Boulay reported that the Town of Highland Beach is actively
involved in the move to enhance accountability of the County's
five constitutional offices (Property Appraiser, Clerk of Courts,
Tax Collector, Sheriff's Department and Supervisor of Elections)
by having them directly responsible to the Board of County
Commissioners. The Mayor noted that the Municipal League
requested the Legislative Review Board of the League to review
this matter and submit their recommendations. The Mayor noted
• that, as a member of said Board, he will be giving periodic
reports of their progress to the Town Commission.

Mayor Boulay further reported that the Palm Beach County Water
Resources Advisory Board, of which he is a member, has been Work-
ing on a Countywide Water and Irrigation Conservation ordinance
which is going to a County Commission Public Hearing for approval.
The Mayor noted the Town's Conservation Ordinance is more
restrictive therefore it would take precedence over the County
ordinance.
The Mayor sadly noted the passing of former Commissioner Bob
Scholz and Dolores Hadeed (wife of F.A.B. Member Victor Hadeed).
On behalf of the Town Commission, Mayor Boulay extended sincere
condolences to Mrs. Scholz and Mr. Hadeed.
Mayor Boulay noted that, on the Agenda under his report, is listed
a Resolution regarding the repealing of Article VII (Countywide
Planning Council) of the Charter of Palm Beach County. The feel-
ing of the Municipal League is that the Countywide Planning
Council is not doing what they were to do and it is a waste of tax
dollars. Consequently, a Resolution to repeal Article VII (copies
of which were distributed to the Members of the Town Commission)
was drafted. Mayor Boulay urged the Members to review this matter
and be prepared to consider the Resolution which will be an Agenda
• Item for the November Regular Meeting of the Town Commission. It
was noted that most of the Palm Beach County Municipalities have
already adopted this Resolution.
Mayor Boulay reminded all that the Government Open House is
scheduled to take place on Thursday, December 05, 1991 from 10:00
A.M. through 3:00 P.M. and all are invited to attend.
Attorney Sliney reported he prepared several ordinances; one
relating to a two year hiatus following completion of six consecu-
tive years of service by a Member on one Town Board; and, two that
relate to the Town's Investment Policy (one changing the Town Code
Section and the other changing the Town Charter Section). Both
Investment Policy Ordinances will be on the November Regular Meet-
ing Agenda for first reading.
Following substantial discussion regarding the two year hiatus
ordinance, it was the consensus that a Resolution be drafted (in
place of said ordinance) to indicate a two year hiatus would apply
unless directed otherwise by the Town Commission. Said Resolution
will be considered at the November Regular Meeting of the Town
commission.

Town Manager Mariano reported that, prior to this Workshop Meet-
ing, a meeting of the Retirement Board was held at which the
Financial Advisory Board recommendation to change the vesting
schedule for practicality as well as to encourage longevity of
service of employees was approved by a 3 to 1 vote. Town Manager
Mariano will prepare a Resolution amending the retirement plan to
reflect the vesting schedule change. Same will be placed on the
November Regular Meeting Agenda for consideration.
Town Manager Mariano informed the Town Commission that bids (to be
opened on November 15) for repaving the roads in the Bel Lido Sub-
Division are being received at Town Hall.
The Town Manager, citing the Town Clerk's memorandum to the Town
Commission noting problems regarding the replaying of County Com-
mission Meeting videotapes, advised .County Commissioner Mary
McCarty is checking to see if the. Town of Highland Beach might
obtain an antenna which would enable Town residents to receive (on
their television sets) the County Commission Meetings as they are
in progress. Town Manager Mariano noted that the County Commis-
sion meets every Tuesday therefore it would create a conflict with
the Highland Beach Town Commission Meetings. The Town Manager
further noted that Commissioner Eypel suggested a copy of the
County Commission Meeting Agendas be made available to residents
at Town Hall; if there is an item of interest to resident, that
resident would then arrange to attend that County Commission Meet-
ing at which time said item would be discussed. We would announce
the availability of the County Commission Meeting Agendas on our
Government Channel 12 as well as in our Community Newsletter. The
Commission agreed with Commissioner Eypel's suggestion and noted
it would not be feasible, at this time, to run videotapes of the
County Commission Meetings.
It was noted that the edited videotape of the September 05, 1991
County Commission Budget Public Hearing will be shown on the
Town's Government Channel 12 at 1:00 P.M. on each Wednesday in
November, December 04 and 11, and each Wednesday during January,
1992, except January 01, 1992.
At this time, Mr. Leonard Bell of the Villa Magna addressed the
Town Commission to note that Town Manager Mariano's memory and
knowledge regarding Town matters, which she shares with the
Members of the Charter Review Board, is very valuable.

Mr. Bell noted that the dunes at the Holiday Inn are being
destroyed as there is no dune walk-over provided in that area.
Mayor Boulay advised the Town will look into this matter.
Mayor Boulay thanked all for attending this meeting as well as
those residents watching the proceedings on television. The Mayor
noted the videotape of this meeting will be replayed on Friday,
November 1st, at 1:30 P.M. on Government Channel 12.
There being no further business to come before the Town Commission
at this time, Mayor Boulay, upon proper MOTION, adjourned the
Workshop Meeting at 3:05 P.M. c~
