1994.10.03_BAA_Minutes_WorkshopTOWN OF HIGHLAND BEACH BOARD OF ADJUSTMENT WORKSHOP MEETING - MINUTES Monday, October 3, 1994 9:30 A.M. Chairman Harold B. Cohen called the Workshop Meeting to order in Commission Chambers at 9:30 A.M., advising its purpose was to review the following Petition for Variance: NO. 06-94-53. REQUEST SUBMITTED BY ROBERT EISEN, ESQ. RE 3515 S. OCEAN BLVD., LOT 83E. SEEKING RELIEF FROM TOWN CODE OF ORDINANCES CHAPTER 30 [ZONING), SECTION 4.3 (e) 3, 4, AND 5 [RESIDENTIAL MULTIPLE FAMILY-LOW DENSITY RML; LOT, YARD AND BULK REGULATIONS). Deputy Town Clerk Doris Trinley called the roll. Present were the Chairman, Vice Chairman Robert F. Selby, Secretary Jane Rayner and Members Benjamin Cohen, Richard C. Seguso and Neil W. Burd. Members Daniel J. Loventhal was absent. Also present were Building Official Lee Leffingwell, Town Attorney Thomas E. Sliney and members of the general public. The Chairman noted no decision on the etition would take lace at P P this time; rather the Workshop was being conducted to review plans and hear testimony, after which the meeting would be recessed to allow for a physical inspection of the site. It was also advised that a date for the Public Hearing would be set today. Attorney Robert A. Eisen, representing both the owner, Manley Boss, and the contract purchaser, Frank Lahage, then addressed the Board, using a color-coded drawing to illustrate his presentation. He explained that at the time the house was built (1950's), it did meet Code requirements; however, current Code requirements as regards minimum width of the lot, as well as existing front and side setback requirements, would now create a hardship for Mr. Lahage to build on the property as he anticipated (a 2-story single family residence of approximately 3700 sq.ft.). Therefore, Mr. Eisen stated, relief from Code was being sought as follows: WIDTH OF LOT: FROM 80' WIDTH TO 60' WIDTH SIDEYARD SETBACK: FROM 20' TO 10' FRONTYARD SETBACK: FROM 40' TO 25' It was noted that although the Boss residence does now intrude into the current Coastal Construction Control Line, the proposed residence would not, i.e., nothing would be constructed seaward of Board of Adjustment Workshop Meeting - Minutes October 3, 1994 Paae 2 of 2 the current CCCL. It was further noted that Mr. Eisen did not have elevation information or a site plan for review today; however, he assured the members that same would be available to them prior to the Public Hearing. Concluding review and discussion, Chairman Cohen announced the. Public Hearing would be held Tuesday, October 18, immediately following the 9:30 A.M. Quarterly Meeting.
