BOARD OF ADJUSTMENT
WORKSHOP MEETING - MINUTES
Tuesday, May 24, 1994 9:30 A.M.
Chairman Harold B. Cohen called the Workshop Meeting to order in Com-
mission Chambers at 9:30 A.M, advising its purpose was to review the
following Petition for Variance:
No. 05-94-51. Submitted by Carlo Prestileo, President of
Boca Highland Center, re 4730 S. Ocean Blvd. (Lot 1W).
Seeking relief from Section 5.8(b)(1)(Z); Fig. 30-1 (Note
#3) [Off-Street Parking and Circulation] of Town Code of
Ordinances Chapter 30 [Zoning].
Deputy Town Clerk Doris Trinley called the roll. Present were the
Chairman, Secretary Jane Rayner and Members Benjamin Cohen, Richard C.
Seguso, Neil W. Burd and Daniel J. Loventhal. Vice Chairman Robert F.
Selby was absent.
Also present were Building Official Lee Leffingwell, Town Attorney
Thomas E. Sliney and members of the general public.
• The Chairman noted no decision on the petition would take place at
this time; rather the Workshop was being conducted to review plans and
hear testimony, after which the meeting would be recessed to allow for
a physical inspection of the site. It was also advised that a date
for the Public Hearing would be set today.
Before hearing testimony, Chairman Cohen asked that the Town Attorney
clarify a possible "conflict of interest," i.e., Messrs. Cohen
(Benjamin) and Loventhal advised they were both residents of the Boca
Highland complex, with Mr. Loventhal also serving on the Board of
Directors of the Boca Highland Center. Attorney Sliney responded
that "conflict of interest" more specifically referred to economic
gain, and considering the particulars of this variance petition, it
would appear that neither gentleman would have a conflict of interest
in casting a vote at the Public Hearing to be scheduled for this
petition.
Carlo Prestileo, President of the Boca Highland Center, was then sworn
in and explained the increase in parking spaces from 8 to 12 was being
requested because spaces previously used to accommodate "overflow
parking" in the tennis court area were no longer available (Gary
Gordon recently purchased that section of land and is in the process
of developing it at this time). He said plans called for installing
two (2) additional spaces at either end of the existing parking lot,
with the first four (4) spaces on the east side being designated for
"compact" vehicles. When questioned as to the hardship involved in
requesting this variance, Mr. Prestileo repeated that this additional
parking was necessary to accommodate the needs of the Boca Highland
residents, who previously had been able to park on land that was now
being developed.

Building Official Leffingwell added to Mr. Prestileo's remarks, noting
the petition for variance included not only the four (4) additional
spaces, but also the fact that these spaces would be 9' wide in keep-
ing with the existing spaces (Code calls for 10' width); also the
backup space for the additional two (2) spaces. on the east side would
be only 32' (Code calls for 36'[length of space plus 20' minimum back-
up space]). She said the "compact" designation should compensate in
this area.
Regarding the existing eight (8) spaces being only 9' wide, Mr.
Prestileo said they had existed as such for many years. The Town At-
torney noted that the entire Boca Hi property was part of an original
RPUD (Residential Planned Unit Development). He explained that RPUD's
were planned as a whole and not bound by setback requirements, which
may be a possible explanation as to why the parking spaces relating
to this petition are 9' wide rather than the Code-required 10'.
During discussion the Building Official also noted the first space
(east) would be for handicapped parking, with a ramp included immedi-
ately adjacent to it. She also advised that this is being done vol-
untarily, as Boca Hi is not required to provide such space in this
regard.
Concluding testimony and discussion, Chairman Cohen announced the
Public Hearing for the Petition would be held Tuesday, June 7, 1994,
at 9:30 A.M. He then recessed the Workshop at 9:45 A.M. to allow
physical inspection of the site. Adjournment took place at 10: 20 A.M.
