TOWN OF HIGHLAND BEACH
BOARD OF ADJUSTMENT
WORKSHOP MEETING - MINUTES
Tuesday, October 26, 1993 9:30 A.M.
Chairman Harold B. Cohen called the Workshop Meeting to order in Com-
mission Chambers at 9:30 A.M., advising its purpose was to review the
following:
Petition for Variance No. 10-93-50. Submitted by
Gregory C. Miklos, Architect, re a proposed single
family residence at 3615 S. Ocean Blvd., Lot 74 East.
Seeking relief from front and side setbacks and building
height requirements. Town Code Chapter 30, Section 4.3 (e)
(4),(5) and (11).
Deputy Town Clerk Doris Trinley called the roll. Present were the
Chairman, Vice Chairman Robert F. Selby, Secretary Jane Rayner and
Regular Members Daniel C. Stump, Benjamin Cohen, Richard C. Seguso and
Neil W. Burd.
Also present were Building Official Lee Leffingwell, Town Attorney
• Thomas E. Sliney and members of the general public.
The Chairman noted that no decision on the petition would take place
at this time; rather the Workshop was being conducted to review the
plans and hear testimony from the applicant, after which the meeting
would be recessed to allow for a physical inspection of the property.
It was also noted that a date for the Public Hearing would be set
today.
Gregory C. Miklos, architect for the project, was sworn in and ad-
dressed the Board. He noted that the proposal would replace an
existing 8-unit complex and proceeded to explain why the requirements
set forth in Town Code regarding front and side setbacks and building
height regarding RML, for which category the property was zoned, would
impose a hardship relative to building a single family structure on
the lot.
During the course of discussion, when it was noted that the Board
would need more detailed plans than were presented, Mr. Miklos
explained he was under a time constraint in order to take advantage of
of his petition being assigned this meeting, which had been previously
scheduled and subsequently cancelled by another applicant. He assured
the members that adequate plans would be available for their review
before the Public Hearing date and sketched on the plans being re-
viewed today the shape of the proposed house so the members would have
somewhat of a visual idea of the kind of structure planned for the

Mr. Miklos advised the proposed residence would be an "L"-shaped
two-story with approximately 10,000 sq.ft. under A/C, and include an
elevator and partial basement. He then explained the hardship claimed
was that it would not be possible to build a structure of this size
adhering to the applicable Code (Residential Multiple-Family/Low
Density (RML):
The lot was situated on a dune hill which caused the rear yard to drop
off sharply and also caused the driveway to have a steep incline; in
addition, the front property line was angled. Therefore, it was
necessary to request a front yard setback of 25' (in some portions
33'). Regarding the side setback requirement of 20', it was requested
this be reduced to 12' in order to accommodate a suitable family-sized
home comparable to others in the general area. Finally, Mr. Miklos
requested that only a portion of the roof line be allowed to extend 7'
higher than~the 30' required height.
Concluding discussion and review, it was the consensus of the members
to hold the Public Hearing for this petition on Friday, November 12,
at 9:30 A.M.
Chairman Cohen then recessed the Workshop Meeting at 10:00 A.M. in
order that -the property could be physically inspected by the members
and the Town Attorney. The Meeting was adjourned at 10:15 A.M.

QUARTERLY MEETING - MINUTES
Tuesday, October 19, 1993 9:30 A.M.
Chairman Harold B. Cohen called the Quarterly Meeting to order in Com-
mission Chambers at 9:30 A.M.
Deputy Town Clerk Doris Trinley called the roll. Present were the
Chairman, Vice Chairman Robert F. Selby, Secretary Jane Rayner and
Regular Members Daniel C. Stump, Benjamin Cohen, Richard C. Seguso and
Neil W. Burd.
Building Official Lee Leffingwell was also in attendance.

Meeting of July 20 were unanimously approved.
