1992.09.08_BAA_Minutes_Regular~ _, .. .` TOWN OF HIGHLAND BEACH BOARD OF ADJUSTMENT PUBLIC HEARING - MINUTES Tuesday, September 8, 1992 9:30 A.M. Chairman Harold B. Cohen called this Public Hearing to order in Commis- sion Chambers at 9:30 A.M. Deputy Town Clerk Doris Trinley called the roll. Present were the Chairman, Vice Chairman David Augenstein and Members Robert F. Selby, Benjamin Cohen and Richard C. Seguso. Members Jane Rayner and Daniel C. Stump were absent. Also present were Town Attorney Thomas E. Sliney, Building Official Lee Leffingwell and members of the general public. Petition 7-92-46. Submitted by Richard Mendelson. Seeking Relief for Side Setback from 20' to 20.22' at 1124 Highland Beach Dr., Unit #1. Town Code Chapter 30, Section 4.3 Chairman Cohen noted that a Workshop Meeting was held on August 21 during which the members and Town Attorney Carol Sullivan had made a physical inspection of the site. After it had been determined that the required legal ads had been published and receipts for certified mailings had been received, the Chairman announced that the Board met today to hear any interested parties and to reach a decision. Representing the owner, Skip Jackman was sworn in to explain the reasons why this request for variance represented hardship. In order to construct a second story, it would be structurally sound to maintain loading points above the existing pilings. In addition, because of the irregular configuration of the lot, it made it impossible to conform to the sideline requirments. He noted that the project was approximately 80°s in conformance with Code and it was only the southeast corner that was in violation of ordinances. Mr. Andrej Martinovic of 4204 Tranquility Dr. questioned the possi- bility of obstructed air flow should a second story be allowed on Unit 1 of the structure, but after discussing the project and reviewing the plans, he had no objections. There were no other persons to be heard from and discussion among the members concluded with a MOTION by MR. AUGENSTEIN/MR. BENJAMIN COHEN to grant the variance, which met with unanimous approval.
