BOARD OF ADJUSTMENT
QUARTERLY MEETING - MINUTES
Tuesday, April 21, 1992 2:5PJ P.M.
Chairman Harold B. Cohen called the Quarterly Meeting to order in Com-
mission Chambers at 2:5P1 P.M., following a Public Hearing re Lot 90E,
Petition 3-92-44.
Deputy Town Clerk Doris Trinley called the roll. Present were the
Chairman, Vice Chairman David Augenstein and Members Jane Rayner,
Robert F. Selby, Daniel C. Stump, Benjamin Cohen and Richard C. Seguso.
Also present was Town Attorney Thomas E. Sliney.
The agenda was amended at the Chairman's discretion and the Town At-
torney was asked to clarify the "Sunshine Law" as it related to a
petitioner for variance approaching individual members of the Board of
Adjustment, either by phone or in person, to discuss the petition. Mr.
Sliney advised that the "Sunshine Law" pertained to two or more members
of a Board or governing body, but not including all members, meeting
covertly for decision-making purposes. He said there was nothing il-
. legal about a petitioner calling individual Board members to discuss a
petition under process; indeed, the members could look upon such a con-
tact as an opportunity to "gather information."
The following sets of Minutes were unanimously approved:

DISCUSSION:
Information Sheet for Petitioners (Pale 5, Section f)
Regarding the need for six (6) copies of a plot plan of a site to be
submitted when a variance was sought, it was noted that the Planning
Board and Community Appearance Board require only four (4) sets. Dis-
cussion on this aspect of requirements concluded with the consensus
that four (4) copies would suffice for the BOA also. Unanimous
favorable vote to change this section of the Information Sheet for
Petitioners followed MOTION by Mr. Stump/Mr. Augenstein.
Decision on Petition for Variance Form
Per previous advice from the Building Official, it was noted that Town
Code allows one (1) year from date of approval of plans to obtain a

building permit, while the Board's "Decision on Petition for Variance"
form specified six (6) months from the date the Board authorized a
variance on submitted plans. Following some discussion, it was the
consensus of the members to change the form to be consistent with
Code. MOTION to this effect by Mr. Augenstein/Mrs. Rayner met with
unanimous favorable vote.
The next Quarterly Meeting was set for July 21 at 9:30 AM.
There being no further business to come before the Board at this time,
the meeting was adjourned at 3:05 P.M.
