Cohen called this meeting to order in Commission Chambers at 1:30 P.M., stating it was a continuance of the Public Hearing held on January 6, 1992 to make a decision on Petition for Variance for the following: NO. 11-91-43 RELIEF FROM SIDE SETBACKS FOR BUILDING AT 3525 S. OCEAN BLVD., LOT 78E; TOWN CODE OF ORDINANCES: CHAPTER 30, SECTION 4.3(e)(5). SUBMITTED BY G. ANTONACCI, OWNER. He explained the continuance was granted because Mr. Antonacci could not be present at the January 6 Public Hearing due to illness, and at that time his representative, architect John Baccari, did not have enough pertinent information, nor were the plans complete enough to answer concerns expressed by the members. • Deputy Town Clerk Doris Trinley called the roll. Present were the Chairman, Vice Chairman David Augenstein and Members Robert F. Selby, Daniel C. Stump and Richard C. Seguso. Members Jane Rayner and Benjamin Cohen were absent. Also present were Town Attorney Kenneth E. Zeilberger, Building Offi- cial Harry Heithaus and members of the general public. Mr. Antonacci was sworn in and stated he was a resident of Highland Beach and planned to remain so; he wanted to convert the structure, which is now 10 units, to 3 units only for use by himself and his two sons. He said he was asking relief from the side setback requirements not only to enlarge the dining area to accommodate his furniture, but also because he suffered from emphysema and needed an outside area where he would not be directly near pool fumes (upstairs deck). Mr. Baccari, having been previously sworn in on January 6, said there were no changes to the plans, which generated substantial discussion since this was an area where the members had requested more detail. In this regard, Building Official Heithaus asked if the members might consider the plans being initialled to denote that only three (3) units with one (1) kitchen each would be utilized; it was also noted that upon completion, a certificate of occupancy could be issued for a triplex. • . ~. • • Board of Adjustment Public Hearing - Minutes February 7, 1992 Page 2 of 2 Members' questions regarding entry to the units were answered sat- isfactorily; there would be only one main entry into the structure, with private doors to each of the apartments within the structure. Timeframe for completion of the project also generated concern from the members; however, Mr. Antonacci assured that the work would be sub- stantially completed within one (1) year from date of permits. Concluding discussion and further deliberation, the members asked Mr. Baccari to initial the plans as previously discussed (denoting one (1) kitchen in each of three (3) units), which was done. MOTS4N by Mr. AugensteiII/Mr. Stamp was then made as follows: PETITION FOR VARIANCE BE GRANTED WITH STIPULATION THAT WORK BE SUBSTANTIALLY COMPLETED WITHIN ONE (1) YEAR AND THAT WHEN CERTIFICATE OF OCCUPANCY IS ISSUED, IT BE ISSUED FOR A TRIPLEX. • Roll call met with unanimous favorable vote.
