1992.01.06_BAA_Minutes_Regular~^,. TOWN OF HIGHLAND BEACH • BOARD OF ADJUSTMENT PUBLIC HEARING - MINUTES Monday, January 6, 1992 1:30 P.M. Chairman Harold B. Cohen called this Public Hearing to order in Commis- sion Chambers at 1:30 P.M. Deputy Town Clerk Doris Trinley called the roll. Present were the Chairman, Vice Chairman David Augenstein and Regular Members Jane Rayner, Robert F. Selby, Donald C. Stump, Benjamin Cohen and Richard C. Seguso. Also present were Town Attorney Kenneth E. Zeilberger, Building Offi- cial Harry Heithaus and members of the general public. The Chairman stated for the record that the Public Hearing was being held to make a decision on Petition for Variance No. 11-91-43, seeking relief on sideyard setbacks from the required 20' to 10' at 3525 S. Ocean Boulevard, Lot 78E, submitted by G. Antonacci. He also noted that members of the Board had physically inspected the site during the Workshop Meeting on December 20, 1991. • Chairman Cohen then confirmed with the Deputy Clerk that proper publi- cation of the Public Hearing had been made and certified return re- ceipts of mailings to property owners within 300' had 'oeen submitted. John Baccari, Mr. Antonacci's representative and architect for the pro- posed project, was then sworn in. He reiterated information given at the December 20 Workshop, i.e., Mr. Antonacci proposed to decrease density of the structure from 10 units to 3 units for personal use by himself and his two sons and was requesting side setback relief in order to extend 4' out on the east side to add more dining room space in his proposed unit. Substantial review and discussion of the available plans took place, with concern being expressed by the members that a hardship actually existed in this petition, as well as the fact that plans represented only one (1) unit, that being Mr. Antonacci's own, located on the north side of the building, whereby it was proposed to take two (2) units each from the first and second floors and make them into one (1) two- level unit. There were no submitted plans for the other two (2) proposed units, which, as the Board had been advised at the Workshop Meeting, were to be constructed from the remaining six (6) units (3 on the first floor and 3 on the second floor). Answering questions regarding Certificate of Occupancy, Building Official Heithaus advised that when Mr. Antonacci had originally applied for a demolition permit, which was issued, the existing C.O. became null and void; he added no multi-family C.O. had been re-applied for since that time and, therefore, any C.O. for 3525 S. Ocean Blvd. is now non-existent. ~. Board of Adjustment Public Hearing - Minutes January 6, 1992 Page 2 of 2 The members also noted the absence of Mr. Antonacci at this meeting, saying they would like to question him personally about the project. Mr. Baccari explained Mr. Antonacci's absence was due to ill health. In defense of the proposed project, Mr. Baccari stated it was his opinion that living space should relate to the value of the property and noted again Mr. Antonacci's willingess to decrease density from 10 to 3 units, saying this would be a benefit to the Town. In light of the concerns expressed by the Board, he also asked if they might con- sider postponing their decision today so he could discuss with Mr. Antonacci their need for more specific information. After some discussion in regard to postponement and upon advice from Attorney Zeilberger that such could be done, the following MOTION was- made by Mr. Seguso/Mr. Augenstein: MOTION IS MADE TO POSTPONE DECISION ON THIS APPLICATION. IT IS THE CONSENSUS OF THE BOARD THAT MORE SPECIFIC INFOR- MATION IS NEEDED IN REGARD TO PLANS FOR THE PROPOSED TWO (2) UNITS ON THE SOUTH SIDE OF THE STRUCTURE, INCLUDING SQUARE FOOTAGE AND TIMEFRAME FOR COMPLETION OF UNITS. Motion met with unanimous favorable vote and Mr. Baccari was advised that any additional fees for another Public Hearing would be made known to him by the Building Department. There being no further business to come before the Board at this time, Chairman Cohen announced a Quarterly Meeting of the Board on January 20 and upon MOTION by Mr. Augenstein/Mrs. Rayner, the Public Hearing was adjourned at 2:10 P.M. dmt APPROVE : ~ ~~~-~~ Harold B.
