BOARD OF ADJUSTMENT
WORKSHOP - MINUTES
Tuesday, March 20, 1990 10:15 A.M.
This Workshop Meeting of the Board of Adjustment was called to order by
Chairman Harold B. Cohen at 10:15 A.M, in Commission Chambers.
Deputy Town Clerk Doris Trinley called the roll. Present were Chairman
Cohen, Vice Chairman David Augenstein, Secretary Gilbert G. Lorenz,
Regular Members Reese E. James and Jane Rayner and Alternate Members
Robert F. Selby and A.G. Voress.
Also present were Building Official Harry Heithaus, Town Attorney David
K. Friedman and members of the general public.
REQUEST FOR VARIANCE N0. 3-90-41. SUBMITTED BY JAMES DRAGO, ARCHITECT,
FOR OWNER JAMES MACKAY, SEEKING RELIEF FROM SIDEYARD SETBACK, FRONTYARD
SETBACK AND ROOF HEIGHT ALLOWANCE FOR 4217 S. OCEAN BLVD., LOT 32,
UNDER CHAPTER 30, SEC. 4.3 (E) (4); SEC. 4.3 (E) (11); SEC. 5.14 (G);
ORD. 560, SEC. (4) (5); SEC. 11 {B) (1) AND (2)
. Chairman Cohen noted that the purpose of the meeting was to review this
request and, when review is completed, make a physical inspection of
the property. He added that official action would be taken at a
subsequent Public Hearing.
Building Official Harry Heithaus then addressed the Board, pointing out
the discrepancies of the submitted plans as regards Code requirements.
He noted that the petitioner requested relief from sideyard setbacks
(20' to 12'), frontyard setbacks (40' to 35') and also that the height
of the proposed structure is approximately 6-1/2' over Code. Mr.
Heithaus also drew the members' attention to the fact that no seawall
was shown on the plans.
After the Building Official's remarks, James Drago identified himself
to the Board and said he realized that no sea wall was shown on the
plans only when the Building Official pointed it out and assured the
members that this omission was strictly an oversight, as a sea wall
would be included with the proposed structure.
Stating that he had a contract to purchase the property, Mr. Drago then
gave his reasons for seeking variances from existing Code. In regard
to height, he told the members that only a small portion in the center
of the roof would exceed requirments and this would be done to aes-
~: thetically define the entranceway. The sideyard setback relief from
20' to 12, he continued, was no more than what similar structures in
the area had been allowed when downgrading zoning to single-family.

Finally, Mr. Drago told the Board that because of the angle of the
property line, the frontyard variance, which he considered minimal, had
been requested.
Mr. Heithaus, Mr. Drago and the members then continued to review the
submitted plans, which the Building Official felt were not adequate for
the Board's purposes. Mr. Cohen advised Mr. Drago that although
another Workshop Meeting would not be required, amended plans must be
submitted at the Public Hearing.
The date for the Public Hearing was then discussed and agreed on by the
members. It will be held Tuesday, April 17, 1990 at 9:30 A.M.
At 10:35 A.M., Chairman Cohen recessed the meeting so the members could
physically inspect the site. Inspection was completed and the meeting
adjourned at 11:10 A.M.
