1990.02.20_BAA_Minutes_Workshop f ~_ J TOWN OF HIGHLAND BEACH BOARD OF ADJUSTMENT WORKSHOP MEETING Tuesda , Februar 20, 1990 9:30 A.M. Chairman Harold B. Cohen called this Workshop Meeting to order in Com- mission Chambers at 9:30 A.M. Deputy Town Clerk Doris Trinley called the roll. Present were Chairman Cohen, Vice President David Augenstein, and Regular Members Reese James Gilbert Lorenz and Jane Rayner. Alternate members Robert F. Selby and A.G. Voress were absent. Also present were Town Attorney David K. Friedman, Building Official Harry Heithaus and members of the general public. Chairman Cohen noted that the purpose of the meeting was to review a request for variance submitted by Robert A. Eisen, Esq. representing Lawrence Germain (owner} for property located at 3519 S. Ocean Blvd., Lot 82. Specifically, he continued, the applicant was requesting re- lief from sideyard setback requirements from 20' to 10'. {Section 4.3 (e) (5) of Chapter 30) . Chairman Cohen also noted for the record that at the conclusion of today's review, the meeting would be recessed so the members could physically inspect the site, and adjourned immediately thereafter. Building Official Harry Heithaus then addressed the Board, stating that the request involves a second floor addition to an existing single family residence whose sideyeard setbacks are non-conforming by present Code guidelines (10' rather than 12'). Two-story single family homes in this zoning district (RML-1), he continued, require 20' side-yard setbacks. Mark Rigo, a planning consultant with Mr. Eisen's office, then introduced himself to the members and proceeded to explain the proposed plans for the second floor addition. He stated that when the existing structure was built, it was in compliance with Code, and in order for the addition to be aethestically and architecturally in keeping with the existing structure, his client had requested relief from the 12' side setback on the existing structure to include the addition of a foyer and elevator, as well as relief from the 20' sideyard setback re- quirement for two-story structures. He further advised the members that the second floor addition would be only partial, covering the eastern portion of the existing structure. In this regard, Mr. Rigo presented a color-coded drawing to show the members where the additions were proposed. Using this partial approach, he continued, would pro- vide good architectural transition, hardly altering the view of the ~tructure from AlA. _j Board of Adjustment Workshop Meeting -Minutes Februar 20, 1994! Page 2 of 2 When questioned by Mr. James about the purpose of the proposed eleva- tor, Mr. Rigo replied that it would provide handicapped access to the second f loor . Mr . Cohen then asked if the owner , Mr . Germain, was now living in the house and if there was a possbility the property was going to be put up for re-sale. Mr. Rigo stated that Mr. Germain did reside in the house and, as far as he was aware, the plans represented only a renovation to the premises. Mr. Lorenz inquired about the set of stairs depicted on the north side of the plans and Mr. Rigo answered that they were simply an access to the lower patio area and beach. Mr. Augenstein inquired about that section of the plans depicting the balcony area on the east side. Mr. Rigo answered that it would be new construction extending out over the existing patio area. Mrs. Rayner questioned Mr. Rigo about his reference to a 20' sideback for the second floor being non-conforming and he explained that he meant it would be non-conforming with the existing structure, not the Town Code. Asked about a timetable for the proposed renovation by Mr. James, Mr. Rigo replied that while he had only dealt with the architect and could not answer definitively, he had gotten the impression that there was some urgency on the part of the owner to proceed in a timely manner, • with possible fall 1994! occupancy. Both Mr. James and Chairman Cohen suggested that Mr. Rigo make every effort to attend the Public Hearing so these and other pertinent questions could be answered. The members then discussed what date the advertised Public Hearing would be held and all agreed on Tuesday, March 20, 19941 at 9: 3P! A.M. Chairman Cohen recessed the meeting at 9:45 A.M. and the members pro- ceeded to the site for a physical inspection. The inspection was com- pleted and the meeting adjourned at 1P1:15 A.M.
