10 BOARD OF ADJUSTMENT
PUBLIC HEA-RING - MINUTES
Tuesday, April 25, 1989 9.30 A.M.
Chairman Harold B. Cohen called the Public Hearing of the Board of
Adjustment, Town of Highland Beach, Florida, to order at 9:30 A.M. in
the Commission Chambers at Town Hall.
Deputy Town Clerk Redawna Bavender called the roll. Present were
Chairman Cohen, Vice Chairman David Augenstein, Carmine Zeccola, Reese
James and Alternate Member Jane Rayner, acting in the capacity of a
Regular Member for this meeting. Mr. Gilbert Lorenz and Mr. Robert
Selby were absent.
Also present for this meeting were Town Attorney David Friedman,
Building Official Harry Heithaus and members of the general public.
Chairman Cohen noted a Workshop Meeting was held on April 4, 1989 when
the petitioner explained, in detail, their request for a variance from
Town Code, Section 4.2 (e) (4) of Chapter 30, for relief relative to
front yard setback requirements. The Board Members visited the site
and observed at first hand, the physical aspects of this petition. As
no official action could be taken at that Workshop Meeting, it was
adjourned by Chairman Cohen.
The Deputy Town Clerk attested to fulfillment of all requirements with
respect to the posting of the Public Hearing and the advertising of
same. Certified letters were forwarded to appropriate property owners
located within 300' and the return receipts were received and placed on
file.
PETITION NO. 3-89-38 - SUBMITTED BY GERRY AND VICTORIA SWEENEY, (BLOCK
5, LOT 5, BEL LIDO).
Under oath, Victoria Sweeney stated they are requesting two (2) feet in
the front yard in order to construct an additional two -car garage and
second story. Mrs. Sweeney further noted a gradual two (2) feet is
necessary due to their irregularly shaped lot.
Mr. Augenstein corrected Mrs. Sweeney by noting they have asked for
three (3) feet in the front yard for -the setback rather than two (2)
feet. Mrs. Sweeney agreed with such correction.
Mr. Harry Bauer, a resident of 4208 Tranquility Drive, requested to see
a blueprint of the proposed additions. Mr. Cohen noted the Board of
Adjustment only has those plans relating to the additional three (3)
feet. The plans for any new structure will be presented to the
Planning Board. After reviewing the Board of Adjustment's plans, Mr.
Bauer stated he had no objection to Mrs. Sweeney's request.

Mr. Augenstein stated he felt this variance would be in harmony with
the general purpose and intent of the ordinance and would not be
injurious to the neighborhood or otherwise detrimental to the public
welfare.
A MOTION was made by Mr. Augenstein/Mr. James that Petition No. 3-89-39
be approved. A roll call vote resulted as follows:

Chairman Cohen announced that Petition No. 3-89-38 has been granted.
The next Regular Meeting was scheduled for May 2, 1989 at 9:30 A.M.
There being no other business to come before the Board of Adjustment at
this time, a MOTION to adjourn was made by Mr. James/Mr. Augenstein at
9:45 A.M. All members voted "aye".
