1989.01.30_BAA_Minutes_WorkshopTOWN OF HIGHLAND BEACH, FLORIDA BOARD OF ADJUSTMENT WORKSHOP MEETING - MINUTES Monday, January 30, 1989 1.30 P.M. The Workshop Meeting of the Board of Adjustment, Town of Highland Beach, Florida, was called to order by Chairman Harold B. Cohen at 1:30 P.M. in the Town Commission Chambers at Town Hall. The Deputy Town Clerk, Redawna Bavender, called the roll. Present were Chairman Cohen, David Augenstein, Carmine Zeccola, Reese James and Alternate Members Jane Rayner and Robert Selby. Regular Member Gilbert Lorenz was absent. Chairman Cohen advised the purpose of the Workshop Meeting was to review Petition 1-89-36, submitted by Colonel and Mrs. Frank Scofield, of 2640 South Ocean Blvd, Highland Beach, Florida requesting relief relative to front yard and side yard setback requirements. The Chair stated no action will be taken by the Board at this time; formal action will be taken at a subsequent Public Hearing scheduled for February 21, 1989 at 9:30 A.M. After all information has been presented, the Workshop Meeting will recess to allow the Members to make an on -site inspection of the premises. Following the physical inspection, the Workshop Meeting will adjourn. The Board will hear from the Building Official, the petitioner or his representative and any citizen of Highland Beach who may have comments to offer, stated Chairman Cohen. Mr. Ed Hardy, Building Official, informed the members that Mr. Scofield put up a canopy carport without first obtaining a permit and was therefore issued a Notice of Violation. After not complying with said Notice, Mr. Scofield was given a Citation to appear before the Code Enforcement Board. Mr. Hardy further noted that in his discussion with the former Building Official, it was stated that Mr. Scofield had previously questioned erecting a carport and was told the setback was not adequate. The required setback for the front yard is 251; the side yard setback is 12', which is also in violation. Mr. Hardy has therefore, denied Mr. Scofield's permit for the existing carport. Mr. Steven Utrecht, the attorney representing Mr. Scofield, was not able to attend this meeting. Mr. Van Stillman was present, representing Mr. Utrecht's office. Mr. Stillman noted they had presented a proposed site plan for a privacy wall as well as the variance for the carport. Mr. Cohen stated the petition under discussion today is only for the carport. The privacy wall will have to be a separate matter. Mr. Stillman noted Mr. Scofield had relied upon the contractor to obtain a permit to put up the carport. Mr. Stillman further noted that as this particular home was not constructed with a garage, the Scofields want a place to park their cars to shelter them from the elements. After further discussion regarding the front yard setback, Mr. Cohen announced the Public Hearing date has been scheduled for February 21, 1989, at 9:30 A.M. and Mr. Utrecht will have an opportunity to make a presentation at that time. Chairman Cohen recessed the Workshop Meeting for the purpose of making an on -site inspection of the premises.
