1991.09.03_TC_Minutes_Regular • TOWN OF HIGHLAND BEACH, FLORIDA Minutes of Meeting of Town Commission REGULAR MEETING • Mayor Joseph A. Boulay called the Regular Meeting of the Town Com- mission of the Town of Highland Beach, Florida, to order in the Commission Chambers at Town Hall at 7:30 P.M. Others present were Commissioners Arlin Voress, Arthur Eypel and John F. Rand. Vice Mayor Bill Paul was absent. Also in attendance were Town Attorney Kenneth Zeilberger, Town Manager Mary Ann Mariano, Town Clerk Anne M. Kowals and members of the general public. Following roll call, the Pledge of Allegiance was given. ADOPTION OF A~IDA The Agenda was adopted as submitted upon MO'PION by C014IISSIONSR VORESS/00lD~iISSIOI~IER RAND. The MOTION carried unanimously. APPROVAL OF NINOTSS COi~@SISSIONER RAND/COl~lQSSIONBR B?PEL MOVBD to approve, as written, the following Minutes: July 23, 1991 - Special Meeting July 30, 1991 - Workshop Meeting August 06, 1991 - Regular Meeting u The MOWS carried without objection. Under Public Comments and Requests, Mr. Jose Echeverria of Russell Drive commented relative to the sparse audience present at the evening meetings of the Town Commission. Mr. Echeverria, noting it is not conducive to hold meetings at 7:30 P.M., stated more people attend the 1:30 P.M. meetings giving more public comments and more support to the Town Commission. Mr. Echeverria recom- mended the Commission consider holding the Regular Meetings at 1:30 P.M. which is the same time the Workshop Meetings are conducted. Mayor Boulay, noting many residents are on vacation during the summer months, stated he would like to give the matter more time before he takes action. Commissioner Rand, stating he is inclined to agree with Mr. Echeverria, noted that during the season we do not have many people in attendance at the evening meetings. The Commissioner, Town Commission Regular Meeting Minutes • September 03, 1991 Page 2 of 6 noting the evening Regular Meetings were on a trial basis to see what attendance would result with 7:30 P.M. meetings, stated he thinks the matter was given a fair trial and evening schedules do not make much of a difference. The Commissioner suggested the videotapes of Town Commission Meetings could be replayed at 7:00 P.M. for Town residents. Commissioner Voress, noting his disappointment in the number of people attending the evening meetings, suggested the Town consider including an item in the next Newsletter to encourage residents to submit their comments with regard to when it would be more convenient for them to attend Town Commission Meetings (i.e. in the afternoon or in the evenings). Mayor Boulay commented that an ordinance amendment would be required to change the time of the meetings. Mr. Jose Echeverria, noting we all want people to attend the meetings and many things have to be taken into consideration (i.e. cost factors, etc.), stated that, as a concerned citizen, he wanted to give his comments on this matter. • REPORTS - TOiil~i (~DM~ssi~iri Vice Mavor Bill Paul Absent - no report. Commissioner Voress, under his report, noted he would like to recognize the great increases in property taxes Town residents are faced with. Commissioner Eypel had no report. Commissioner Rand, noting he received many calls from residents regarding the assessed valuation and the substantial tax increases, suggested the residents participate in the campaign for referendum to try to limit the increases to no more than 3$ during one given year. The Commissioner further noted he was pleased with the response received from the condominiums regarding their involvement in the petition campaign. It should be noted that • copies of the petition are available at Town Hall. Town Commission Regular Meeting Minutes September 03, 1991 Page 3 of 6 Commissioners Rand and Voress, along with Highland Beach resident Jerry Marshall, met with County Commissioner Mary McCarty (who also agreed it was a difficult situation) to let her know of the concern in Highland Beach with regard to this run-away taxation. The Commissioner, noting he requested the Sun Sentinel to have the editors join in this campaign, stated our taxes are due to an uncontrolled increase in expenses. If we support the constitu- tional amendment, the taxing authorities would have to justify the millage rate. Commissioner Rand advised the concerned citizens would have to attend seven (7) budget hearings to be heard. The Commissioner suggested that our residents "stop letting someone else do your job--you have to stand up and be counted--you have to go to the Palm Beach County Commission Meetings and let your feelings be known. Our residents must get involved in their government." Commissioner Voress informed the public the next County Commission Meeting is set for Thursday, September 05, 1991, at 7:00 P.M. at the Governmental Center, 301 North Olive Avenue, West Palm Beach. • It was noted that residents may write letters to the editors of the sun Sentinel, Palm Beach Post, Boca News, etc., asking them to help in this cause. Commissioner Rand stated that State Repre- sentative Carol Hanson has helped him with this matter; the State Representative in our district will not assist us saying this is a County issue. The Commissioner commented this is really a State matter and property owners are being taxed out of their homes. Under his report, the Mayor advised that the Town of Highland Beach is a member of the Municipal League which League has taken a stand on the increases, assessments and the method of assessment. The Mayor, noting he will keep all apprised with regard to what the Municipal League does in this matter, stated the League works through the elected officials and municipal managers and, as an elected official, he would be happy to let them know the feelings of the Highland Beach residents relative to this important issue. Mayor Boulay noted an advertised Public Hearing for the 1991/92 fiscal year budget is set for Friday, September 06, 1991 at 5:01 P.M. at which time the public may present their comments on said budget. Additional comments on this subject may be made at the advertised Public Hearing/Special Meeting scheduled for Tuesday, September 17, 1991 at 5:01 P.M. at which time the Commission will consider approving/disapproving the 1991/92 f.y. budget. Town Commission Regular Meeting Minutes • September 03, 1991 Page 4 of 6 The Mayor, noting the Commission planned to propose nominees for the Charter Review Board, requested that, in the absence of the Vice Mayor, the matter be postponed until there is a full comple- ment in attendance. This will be included on the Agenda for the scheduled Public Hearing/Special Meeting on September 17, 1991 at 5:01 P.M. Mayor Boulay requested anyone interested in serving on the Charter Review Board contact anyone of the Commissioners for further information. RSPOR?S - BOARDS 1hND (~0lQ~ITTSES Mayor Boulay noted the schedule of Meetings for, and the existing vacancies on, the various Town Boards. • The Commission is considering an ordinance that would eliminate Alternate Membership on the Planning Board, Community Appearance Board and the Board of Adjustment therefore, any appointments of Alternate Members, proposed today, are being made with the under- standing that, once said ordinance is approved, these Alternate appointees will automatically be elevated to the Regular Member status for a three year term commencing immediately upon adoption of ordinance now under consideration. It was noted that time served as an Alternate Member has no bearing on the total six years (2 three year terms) limitation each Regular Member is permitted to serve on any Town Boards. COMMISSIONER RAND/MAYOR BOULAY made a MOTION, which carried unani- mously, to appoint Frank Colarullo as an Alternate Member of the Planning Board for a one year term. A MOTION by (:oNKISSIONER RAND/COlNIISSIONER EYPEL to appoint Arthur Hamerman as a Regular Member of the Code Enforcement Board for a three year term carried without objection. • COMMISSIONER VORESS/QOl9~tISSIONER RAND MOVED to reappoint Frank Arenella to the Alternate position on the Community Appearance Board for a one year term. AN ORDINANCE OF THE TOWN OF HIGHLAND BEACH, FLORIDA, AMENDING THE TOWN CODE, CHAPTER 29 ENTITLED "WATER SYSTEM:, SECTION 29-10 ENTITLED "CHARGE FOR WATER SERVICE". ordinance, given first reading on 8/06/91 and published on .6/91, was read by title only by Mayor Boulay. Following ,cussion, MOTION was made by (A~SlISSIONBR VORSSS/C01~II+IISSIOIdSR 'EL to adopt the ordinance. A roll call vote resulted in "AYB" .es cast by each Commission Member. 2. AN ORDINANCE OF THE TOWN OF HIGHLAND BEACH, FLORIDA, AMENDING THE CODE OF ORDINANCES TO PROVIDE THAT ALL ALTERNATE MEMBERS OF THE PLANNING BOARD, BOARD OF ADJUSTMENT AND COMMUNITY APPEARANCE BOARD BECOME REGULAR MEMBERS AND PROVIDING THAT ALL SECTIONS OF THE CODE OF ORDINANCES IN CONFLICT ARE HEREBY AMENDED, TO WIT, SECTIONS 20-26 (a); 20-46; 2-76 (a); TO PROVIDE FOR THE NUMBER OF REGULAR MEMBERS OF THE PLANNING BOARD, BOARD OF ADJUSTMENT AND COMMUNITY APPEARANCE BOARD AND PROVIDING THAT ALL SECTIONS OF THE CODE OF ORDINANCES IN CONFLICT ARE HEREBY AMENDED, TO WIT, SECTIONS 20-26 (a); ordinance was given first reading, by title only, by Mayor ay. It was noted the first portion of this title deals with Alternate/Regular Membership while the final portion addresses number of members required for each Board. It was the ensus to move this matter to the September Workshop Meeting further discussion. 1. Discussion re Status Report - Long Term Water Supply Plan (documentation required for ten (10) year water supply permit request to be submitted to South Florida Water Management District). imissioner Voress noted that at the August Workshop Meeting of :Town Commission, the estimated Safe Yield Report for the Town discussed and mention was made of several other documents ~ded for the ten (10) year Water Use Permit Application for the rn of Highland Beach to be submitted to South Florida water iagement District. The Commissioner further noted that the Town awaiting receipt of a 'Letter of Commitment' from Delray Beach .ch is to be included in said application submittal. . , Town Commission Regular Meeting Minutes . Montgomery, the Town's Engineers, to submit said documents together with the Delray Beach 'Letter of Commitment' to South Florida Water Management District on behalf of the Town to apply for the ten (10) year water permit which would run until the year 2001. MO'PI~1 was made by DOlMISSIOIdER RAND/C10lQ[ISSIODIER VORE33 to approve the Consent Agenda relating to a request for a seawall at 4111 South ocean Boulevard (Town Lot 42 East) submitted by James Billik. The MOTIO~i carried without objection. Mayor Boulay thanked those in attendance and noted the videotape of this Meeting will be replayed on Friday, September 06, 1991 at 1:30 P.M. on Channel 12 (the government channel).
