PUBLIC HEARING - MINUTES
October 17, 1988 1:30 P.M.
Chairman Cohen called the Public Hearing of the Board of Adjustment,
Town of Highland Beach, Florida, to order at 1:30 P.M. in the
Commission Chambers at Town Hall.
Deputy Town Clerk Bavender called the roll. Present were Regular
Members H. Cohen, G. Lorenz, D. Augenstein, C. Zeccola, R. Jan►es and
Alternate Members J. Rayner and R. Selby.
Also present were Town Attorney D. Friedman, Deputy Town Clerk Redawna
Bavender and members of the general public.
Chairman Cohen noted a Workshop Meeting was held on September 15, 1988
at 9:30 A.M. when the petitioner explained, in detail, their request
for a variance front Town Code, Section 4.3 (e) (5) of Chapter 30, for
relief relative to side yard setback. The Board Members visited the
site and observed, first hand, the physical aspects of this petition.
As no official action could be taken at that Workshop Meeting, it was
adjourned by Chairman Cohen.
The Deputy Town Clerk attested to fulfillment of all requirenents with
respect to the posting of the Public Hearing and the advertising of

same. Certified letters were forwarded to appropriate property owners
located within 300' and the return receipts were received and placed on
file.

CONTRACTO-R FOR THE OWNERS MR & MRS SCOROPOSKI .

Under oath, Mr. Jim Drago (Petitioner) advised that as he stated in the
last meeting, a hardship exists for the Scoroposki family as they want
to build a full sized family home on this lot and the required 20' side
yard setback restricts their building potential. The proposed 12' side
yard setback, which is similar to what the other single family setbacks
are in town, would allow then► to build the size of home they feel they
require. In addition, they are eliminating the potential of having
multi-fan►ily units built on the site, thereby reducing density.
Mr. Augenstein questioned Mr. Drago regarding the total height of the
building. Mr. Drago replied that he is not sure of the total height
because full plans have not been drawn up, as they are awaiting the
outcome of the variance. Mr. Drago stated the building will not be
significantly higher than adjacent buildings and they will certainly
follow all requirements and conform to the ordinance.
Chairman Cohen ,P asked for con►n+ents from the public.

Ms. Mary E. Grahan►, co-owner of Boxwood #15, stated the original house
that was there is exactly what Mr. Drago wants to build and questioned
why he would have a problem.
Town Attorney Friedman stated that zoning n►ay have changed since that
time, and new plans must conform to current zoning.
After discussion, a MOTION was made by Mr. Augenstein/Mr. Zeccola that
Petition No. 6-88-35 be granted.
A roll call vote resulted as follows:

Mr. Augenstein "for"
Mr. Lorenz "for"
Chairman Cohen "for"
Upon proper MOTION by Mr. James/Mr. Augenstein the meeting was
adjourned at 1:40 P.M.
