BOARD OF ADJUSTMENT
QUARTERLY MEETING - MINUTES
Monday, January 18, 1988 1.30 P.M.
The Quarterly Meeting of the Board of Adjustment was called to
order by Chairman Harold B. Cohen at 1:30 p.m. in the Town
Commission Chambers at Town Hall.
Deputy Town Clerk/Recording Secretary Elizabeth L. Kolek called
the roll. Present were Chairman Harold B. Cohen, Vice Chairman
Gilbert Lorenz, Secretary Charles Arbetman, Regular Members David
Augenstein, A. M. Fox, Jr., and Alternate Member Carmine Zeccola.
Alternate Member George Harbin was absent.
Chairman Cohen introduced and welcomed new Alternate Member
Carmine Zeccola on his appointment to the Board and also
congratulated Mr. Lorenz on his reappointment to a three year term
on the Board, as well as noting his own reappointment to a three
year term.
MOTION was made by Mr. Lorenz, seconded by Mr. Augenstein, to
approve the Minutes of the Quarterly Meeting of October 19, 1987
as submitted. The MOTION carried unanimously.
MOTION was made by Mr. Lorenz, seconded by Mr. Fox, to approve the
Minutes of the Public Hearing of October 19, 1987 as submitted.
The MOTION carried unanimously.
The Board Members received a copy of the current Building
Department Report regarding the status of Building Development in
Town and the Building Official was present to go over the report.
Regarding the Hoffman/Broadview property, Mr. Sutherland stated
that the Notice of Violation issued to the property owners expired
this date and that he plans to issue a Citation on January 19,
1988 and unless the matter is resolved, will come before the Code
Enforcement Board, which can levy a fine of up to $250.00 per day.
OLD BUSINESS:
The issue of administering oaths for the Board of Adjustment was
discussed, to be held in abeyance until an official opinion from
the Town Attorney is received. The wording on applications was
also discussed in that some members felt the wording is not clear
and is confusing. The Board suggested that the wording "must be
notarized whether owner or principal" be added to the
application. Secretary Arbetman was asked to write a letter to
the Town Manager, for forwarding to the Town Attorney, on this
subject to clarify the matter, in case of appeal to Courts by
parties appearing for a variance whereby questions would arise as
to the fact, did or did not the applicant swear under oath.

NEW BUSINESS:
There was no new business to discuss.
The policies and procedures of the Board of Adjustment were
discussed. Chairman Cohen stated that the Board of Adjustment's
duties were specific in Chapter 30, Section 11 (pages 51-53) of
the Town Code, which the Board is governed by. A petitioner must
prove specific hardship or a mistake in land survey for a variance
to be granted. Bruce Sutherland stated that petitioners can seek
relief from some aspects of zoning in the book.
The next quarterly meeting was scheduled for Monday, April 18,
1988, at 1:30 p.m.
MOTION was made by David Augenstein/Charles Arbetman to adjourn
the meeting at 2:15 p.m. All were in favor.
