Minutes of Meeting of Town Commission
WORKSHOP MEETING
Tuesday August 27 1991 1:30 P.M.
Mayor Joseph A. Boulay called the Workshop Meeting of the Town
Commission of the Town of Highland Beach, Florida, to order in the
Commission Chambers at Town Hall at 1:30 P.M. Present also were
Vice Mayor Bill Paul, Commissioners Arlin Voress, Arthur Eypel and
John F. Rand.
Also in attendance were Town Attorney Thomas E. Sliney, Town
Manager Mary Ann Mariano, Town Clerk Anne M. Kowals and members of
the general public.
ADDITIONS_ DELETIONS OR ACCEPTANCE OF AGENDA
The Agenda was accepted, as submitted, upon proper MOTION.
91.I PUBLIC COMMENTS AND REQUESTS
Talent Bank Applicant Frank Colarullo, residing at 3420 South
Ocean Boulevard, interviewed by the Town Commission, noted his
past experience in the building industry as a Construction
• Engineer and a concrete contractor, expressed an interest in
serving on the Planning Board.
Mr. Michael Dent, residing at the Casuarina Condominium, commented
with regard to the new proposed real estate assessments recently
received from the Palm Beach County Property Appraiser's Office.
91_2 BOARDS AND COMMITTEES
The existing vacancies on the various Town Boards were noted by
Mayor Boulay who requested the Commission review the current
Talent Bank Applications in preparation for possible appointments
to be considered at the September 03, 1991 Regular Town Commission
Meeting.
It was noted no correspondence was received from the Town Boards
and Committees.
9I.3 PROPOSED ORDINANCES AND RESOLUTIONS
1. AN ORDINANCE OF THE TOWN OF HIGHLAND BEACH,
FLORIDA, TO EFFECT A TAX LEVY BASED UPON THE 1991
TAX ROLL OF THE TOWN OF HIGHLAND BEACH.

2. RN ORDINANCE OF THE TOWN OF HIGHLAND BEACH,
FLORIDA, APPROPRIATING FUNDS FOR THE FISCAL YEAR
1991/92, BEGINNING OCTOBER O1, 1991 AND ENDING
SEPTEMBER 30, 1992.
The ordinances received first reading on 8/06/91 and were
published on 8/16/91. Both were read by Mayor Boulay by title
only. It was noted the public will have the opportunity to give
input on these ordinances at an advertised Public Hearing set for
Friday, September 06, 1991 at 5:01 P.M. with final reading and
consideration scheduled on Tuesday, September 17, 1991 at the ad-
vertised 5:01 P.M. Public Hearing/Special Meeting.
3. AN ORDINANCE OF THE TOWN OF HIGHLAND BEACH,
FLORIDA, AMENDING THE TOWN CODE, CHAPTER 29
ENTITLED "WATER SYSTEM:, SECTION 29-10 ENTITLED
"CHARGE FOR WATER SERVICE".
The ordinance was given first reading on 8/06/91 and was published
on 8/16/91. Mayor Boulay read same by title only. It was the
consensus of the Town Commission to move this matter to the
September 03, 1991 Regular Meeting Agenda for discussion and
• possible consideration.
90.5 Status Report - Lona Tern hater Supply Plan
Commissioner Voress, explained the Status Report - Long Term Water
Supply Plan prepared by J. M. Montgomery (the Town's Engineers)
and noted the Town is presently operating under a one year water
permit granted on October 11, 1990 which requires the Town
evaluate the long term water supply alternatives and submit a long
term water supply plan to South Florida Water Management District
prior to expiration of said permit. The Commissioner further
noted that, in compliance with the S.F.w.M.D.'s requirements, the
Commission, at is September 03 Regular Meeting, will consider
approving the following:
1. Safe Yield report
2. The long range supply plan for the Town
3. The application for a ten (10) year permit from
S.F.W.M.D. and the Delray Beach "Letter of Commit-
ment" to supply supplemental water to the Town of
Highland Beach.
It should be noted that, at the successful conclusion of the ten
(10) year permit application, the Town will have in place the long
term (10 year) water supply plan.

91.5 Di~russion re Sentenber/October Newsletter
The Town Commission reviewed the draft of the September/October
Newsletter and directed same be processed for mailing to residents
as soon as possible.
91. n~scussion re Town Boards Regular/Alternate Members
Following discussion by the Town Commission with regard to Town
Boards Regular/Alternate Members, the Town Attorney was directed
to prepare for first reading at the September 03,'1991 Town
Commission Regular Meeting an ordinance to address elimination of
Alternate Membership on Town Boards whereby all appointments to
Town Boards would be as a Regular Member. The Commission will
also address (at the September 03, 1991 Regular Meeting) the
matter of the number of members required on the Town Boards.
91.7 Discussion re Billik Seawall [Town Lot 42 East)
4111 South Ocean Boulevard
Building Official Harry Heithaus explained the request for a
seawall at 4111 South Ocean Boulevard (Town Lot 42 East) submitted
• by Mr. James Billik. The Building Official noted that the Palm
Beach County Department of Environmental Resource Management
reviewed the plans and issued a permit for the construction of a
seawall as part of the entire building; the Planning Board
authorized an adjustment of the seawall to meet existing condi-
tions and the building does not extend east of the coastal
construction control line.
The Building Official, noting he reviewed the plans, informed the
Commission that the Building Department has no objection to the
construction of the seawall as indicated on the plans.
It was the consensus of the Town Commission to move this matter to
the Consent Agenda for the September 03, 1991 Regular Town Commis-
sion Meeting.
MISCELLANEOUS - ITEMS LEFT OVER
Status of Building Development in Town
The Commission reviewed the Status of Building Development in
Town, a report prepared by the Building Official.
Minutes for approval at September Regular Meeting
Following discussion of three sets of Town Commission Meeting
• Minutes, it was the consensus to move same to the Agenda for the
September 03, 1991 Regular Tawn Commission Meeting for approval.

Vice Mavor Bill Paul
No report.
Commissioner Arlin Voress
Commissioner Voress, noting he attended several matches of the
U. S. Women's Chess Tournament, requested and received approval
from the Town Commission to have the Town Manager write to Mr. &
Mrs. Don Schultz to compliment them on the way the Championship
event was handled.
Commissioner Arthur Evpel
Commissioner Eypel, under his report, added his support to the
comments of Commissioner Voress with regard to the U. S. Women's
Chess Tournament held in Town Hall. The commissioner extended
thanks to Town Hall staff with regard to the new recodified Code
of Ordinance Book recently distributed.
Commissioner Eypel, citing Commissioner Voress' explanation of the
. Status Report - Long Term Water Supply Plan (prepared by the
Town's Engineers) commended the Commissioner fcr his very profes-
sional analysis and contribution regarding this matter. Commis-
sioner Eypel further commended Commissioner Voress and the Water
Resources Advisory Board for their leadership and effort that went
into said document.
Commissioner John F. Rand
Under his report, Commissioner Rand requested up-dated information
regarding the Town`s Recycling Program. The Town Manager, noting
the program is a success, advised that we are in the fourth
quarter of our first year of said program in which 120 single
family and 184 multi-family residences participate, as well as
3,161 centralized condominium units. The initial report indicated
a 37~ rate of participation; presently, the rate of participation
is approximately 86~. Town Manager Mariano indicated that
educating the residents with regard to recycling will be included
in the open-house program to be held at the end of this year.
Continuing with his report, Commissioner Rand commented with
regard to the recently received proposed County Real Estate Tax
Notices and questioned if it would be appropriate for the Town to
make available at Town Hall a copy of the proposed constitutional
amendment petition form which is sponsored by "Save Our Homes,
Inc.". The Town Attorney, responding to the Commissioner`s query,

advised that he sees nothing wrong with the Town making said
petition available at Town Hall. Vice Mayor Paul questioned if
our State Representative might help our residents with this
matter.
Mavor Joseph A. Boulav
Mayor Boulay, under his report, read an item in the Community
Newsletter for September/October reminding dog/cat owners of the
Town of Highland Beach Code which bans an animal running 'at
large' on public or private property, including all beaches within
Town limits. The Mayor cited a Palm Beach Post article of 8/26/91
(West Palm Mayor jailed over leash-law citation) and noted such
ordinances are enforceable.
Commissioner Rand, noting there is a Town Ordinance concerning
sprinkler systems, advised he sees said ordinance being violated
and questioned if our Police Department should be on the lookout
to enforce same. The Mayor noted that the Highland Beach Police
Department does carefully watch for sprinkler system violations,
however, there are instances where residents are away when their
system malfunctions, in which case, the Police Department Staff
• takes necessary steps to shut off the system.
REPORTS TOfiN ATTORNEY
Town Attorney Sliney reported he is working with Commissioner Rand
with regard to "State Pooled Investment Fund". At this point,
Commissioner Rand commented he is dissatisfied with the Town's
investment in the State Pooled Fund and would prefer to have the
Financial Advisory Board review the matter again as the Commis-
sioner wishes to consider the F.A.B. reply before he makes any
recommendations to the Town Commission.
REPORTS - TO(~iN MANAGER
Under her report, Town Manager Mariano noted the American Cancer
Society is sponsoring a five (5} mile walk on Saturday (9/21/91).
Anyone interested in participating in this fund raising event
should contact the Town Manager at Town Hall (278-4548).
The Town Manager reported the Town is in the process of getting
proposals for a structure to house the portable generator at Lift
Station No. 2.
Town Manager Mariano, noting she enjoyed the Chess Tournament,
reported all players were saddened to leave Town and expressed an
interest in returning to Highland Beach for another tournament.
• It was noted that next year the tournament is scheduled to take
place in Dearborn, Michigan.

Town Manager Mariano reported the Town is looking at Thursday,
December 05, 1991 as the date for the Local Government Open House
at Town Hall. The Staff is working on several segments that will
have a time certain between 10:00 A.M. and 4:00 P.M. (i.e. a Fire/
Rescue demonstration; tour of the water plant which would require
residents to sign up in advance of the scheduled tour, etc.).
The Town Manager reported the Town has opened up the interconnect
with Delray Beach because their Intracoastal crossing water line
is in disrepair; Highland Beach may be providing the City of
Delray Beach with water under the Emergency Interconnect
Agreement.
ADJOURNMBNT
There being no further business to come before the Town Commission
at this time, Mayor Boulay, upon proper MOTION, adjourned the
Workshop Meeting at 3:00 P.M.
