WORKSHOP MEETING APRIL 20, 1987
Chairman Harold B. Cohen called the Workshop Meeting of the Board of
Adjustment to order at 1:40 p.m. to examine the following Petition for
Variance:
PETITION #4-87-31 is a request for variance for a fence, under Section
5.1(a)(1) of Chapter 30 of the Code of Ordinances of the Town of High-
land.Beach, submitted by Mr. and Mrs. H. Boyd, 2475 South Ocean
Boulevard, Highland Beach, Florida 33431 (Town Lot No. 127) requesting
permission for fence to be placed within 5' of the front property line,
behind an existing hedge.
The recording secretary called the roll. Present were Regular Members
Harold B. Cohen, Charles Arbetman, David Augenstein, A. M. Fox, Jr.,
and Gilbert G. Lorenz. Also present were Town Attorney Steve Abrams and
Town Clerk Mary Ann Mariano.
This procedure, stated Chairman Cohen, is for the purpose of reviewing
the applicant's Petition. No official action will be taken by the
Board at this time. Formal action will be taken at a Public Hearing at
a future date to be set at the end of this meeting.
• After all information is presented and a date set for the Public Hear-
ing, this meeting will recess to allow members to make an on site
inspection of the parcels. The Workshop Meeting will then adjourn.
Bruce Sutherland, Building Official, explained that the Boyd's request
involved the placing of .a fence on their front property line directly
behind an existing hedge. This would place the fence 18" from the
front property line, rather than the 5' which is required by ordinance
for a 6' fence. It was noted at this time that the fence had already
been constructed by Bulldog Fence Company in error.
Mr. Boyd stated that the existing hedge has been there for 15-20 years
and that the request involved the placement of the fence directly be-
hind the hedge in order to avoid a "dead spot" between the hedge and
the fence. The Boyd's purchased this property in March of 1986. Mr.
Boyd stated that a fence was required as they own two dogs, and also
for security reasons as they are not full time residents.
Bruce Sutherland pointed out that the fence on all other sides of the
property were in conformance with the code and that the Community
Appearance Board, although they could not approve such front property
variance, was supportive of the Boyd's Petition for aesthetic reasons.
Although presently the existing hedge would serve to conceal the fence,
Mr. Arbetman expressed concern as to subsequent owners of the property.
Mr. Arbetman felt that if a variance were granted, the Town should ob-
tain a covenant running with the land as to the retention and mainten-
ance of such hedge.

In answer to Mr. Augenstein's inquiry, Mr. Boyd stated that the fence
was 6' on a 2 1/2' rise.
The Public Hearing for this Petition is scheduled for May 12, 1987 at
9: 30 a .m.
Attorney Abrams cautioned the members that no discussion regarding the
Petition was to take place during the site inspection in compliance
with the Sunshine Law regulations.
The Workshop Meeting recessed at 1:55 p.m. to allow members to make an
on site inspection of the Boyd property, after which the meeting was
adjourned.
