1986.01.20_BAA_Minutes_WorkshopTOWN OF HIGHLAND BEACH, FLORIDA • BOARD OF ADJUSTMENT WORKSHOP MEETING JANUARY 20, 1986 2:25 P.M. Chairman Harold B. Cohen called the Workshop Meeting of the Board of Adjustment to order at 2:25 P.M. to examine Petition #1-86-28 request- ing a variance for a mechanical boat lift under Section 5.2 (d) (1) of Chapter 30 of the Code of Ordinances of the Town of Highland Beach, submitted by Joseph Quatman, 4204 Intracoastal Drive (Lot #26, Block #4, Bel Lido Subdivision). Present were Regular Members Harold B. Cohen, Gilbert G. Lorenz, Charles Arbetman, A. M. Fox, Jr., Raymond Masciarella (alt.) and David Augenstein (alt.). Absent was Regular Member Albert Kahler. Also present were Town Attorney David Friedman, Building Official Bruce Sutherland, Recording Secretary Anne Kowals, Attorney Adam Heffner re- presenting the Petitioner, Petitioner Joseph Quatman and a few Town residents. • Chairman Cohen said this procedure is for the purpose of reviewing the applicant's petition - there will be no official action by the Board, at this time. Formal action will be taken at a Public Hearing at a date to be set at the end of this meeting. Continuing, Chairman Cohen said we will hear from the Petitioner or his representative, the Building Official and any citizen who may have comments to offer. Mr. Joseph Quatman, addressing -'-the Board, stated he has owned the pro- perty in the Bel Lido Subdivision for five years; and, being on the 'point' he gets a lot of wave action which create unsafe conditions for his boat sitting at his dock. Having consulted with marine construction people, Mr. Quatman was informed there are two kinds of lifts available --the davit type and the elevator type. They do not recommend the use of the davit type lift for Mr. Quatman's situation due to the dangerous conditions in his area. The marine people said the logical solution for Mr. Quatman is the elevator lift that gets under the boat, continued Mr. Quatman. 0 BOARD OF ADJUSTMENT • Workshop Meeting January 20, 1986 Page 2 of 3 Mr. Quatman said there are lifts in the area that extend more than 5' into the water. The Town Ordinance states that lifting devices shall not extend in any waterway more than 5'. The Coast Guard informed Mr. Quatman that as long as the area in question will still allow 50% of that area for navigational purposes, they will grant permits. Mr. Quatman said his proposal allows 61/ of the area for navigation; including the thought of his neighbor across the way wanting to install the same system, there would still be 50% of area remaining for navigation. Chairman Cohen asked the Building Official if he had knowledge of any elevator lifts. Building Official Sutherland stated the Kinser Residence at the North end of Town has an elevator lift. Permission was granted for that lift because it is on the Intracoastal and totally within the confines of the Army Corp of Engineers and Department of Environmental Regula- tions, said Mr. Sutherland. • When Mr. Lorenz questioned how close this lift would be to the lot line of the neighbor, Mr. Quatman replied it would be about 30' away from his only neighbor, Mr. Lemon. Mr. Masciarella said because of the very heavy wave action at Mr. Quatman's property (the huge wakes that come through that area)_ neces- sitates the lift. Attorney Friedman said one thing that was overlooked is the fact that the elevator is under water; it is important that the elevator be raised so it can be seen when not in use. Chairman Cohen said that can be made a condition, if the Board decides to grant this variance. Mr. Sutherland said the four posts (topped with reflector balls) on the four corners of the elevator would be tall enough to protrude out of the water,even when the elevator was at the lowest point in the water, Chairman Cohen and members, in discussing the matter,.agreed to hold a • Public Hearing on February 11, 1986, at 1:30 P.M. when formal action on this petition will be taken. Chairman Cohen advised the Petitioner that he is to perform all the requirements as far as notification.
