WORKSHOP MEETING AUGUST 19, 1985
Chairman Albert Schiff called the Workshop Meeting of the Board of Ad-
justment to order at 1:30 P.M. to examine PETITION #7-85-27, submitted
by YACHTSMAN'S COVE TOWNHOUSE CONDOMINIUM, INC., c/o Robert A. Eisen,
Esq., Marchbanks, Eisen & Feaman, P.A., 4700 N.W. 2nd Avenue, Suite 101,
Boca Raton, Florida 33431, requesting a variance of rear yard setback
under Section 4.3 (e) (6) of Chapter 30 of the Code of Ordinances of
the Town of Highland Beach, Florida, for the property located at 1010
BELAIR DRIVE, HIGHLAND BEACH, FLORIDA 33431, TOWN LOT 2, HIGHLAND
BEACH ISLES SUB -DIVISION.
The recording secretary called the roll. Present were regular members
Albert Schiff, Gilbert Lorenz, Harold Cohen and alternate member Raymond
Masciarella. Also present were Building Official Bruce Sutherland, Pe-
titioner's Attorney Mark Gaylord and Recording Secretary Anne Kowals.
Absent from this Workshop Meeting were regular members Albert Kahler,
Charles Arbetman and alternate member A. M. Fox, Jr.
• Chairman Schiff officially welcomed the newly appointed alternate mem-
ber to the Board of Adjustment, Raymond Masciarella.
The procedure to be followed at this meeting was outlined by Chairman
Schiff. First, the board will hear from the petitioner or the repre-
sentative who will inform the members of the facts pertaining to this
petition. The building official will then be asked to comment. The
board will proceed with the deliberation of this petition by discussing
the merits of same. After all comments are heard, the chairman will
set a time and date for a public hearing. The Workshop Meeting will
be recessed to allow an on site inspection of the property. The chair-
man will then adjourn the meeting.
Attorney Mark Gaylord of Marchbanks, Eisen & Feaman, P.A., representing
the petitioner, informed the members that the petition was filed on be-
half of Yachtsman's Cove Townhouse Condominium, Inc., by Robert A.
Eisen, Esq., who was presently on vacation.
Yachtsman's Cove is located at 1010 Belair Drive, Building B, and is
perpendicular to the Intracoastal Waterway. The petitioner requests
a variance of rear yard setbacks to permit the erection of screen en-
closures on common condominium property, on the back patio areas, due
to a problem with insects, continued Attorney Gaylord.

Attorney Gaylord referred to two letters attached to the petition. One
letter is from John F. Pearl, M.D., who has been treating Mrs. Helen
Drake for severe reaction to insect bites and recommends any precaution
to isolate her from insects.
The other letter from Manley L. Boss, Ph.D., Professor, Department of
Biological Sciences at Florida Atlantic University, Boca Raton, Florida,
states that due to the swampy nature of the mangrove islands (protected
by the State of Florida) in the area, the environment is a prime breeder
of mosquitoes and insects.
Attorney Gaylord said the petitioner is seeking a variance to reduce
the rear yard setback from 20 feet to 13 feet 6 inches with a screen
enclosure. Drawings showing the screen enclosures were submitted this
afternoon prior to this Workshop Meeting, stated Mr. Gaylord.
Building Official Bruce Sutherland said this application started out
for one unit only --now, there are three additional units involved. The
existing patios in the rear are of concrete slabs which meet the zoning
requirements and will not require enlargement. The slabs do not con-
stitute an intrusion of the setbacks. Verticle supports will be neces-
sary for the screen enclosure. Aesthetically, continued Mr. Sutherland,
the screen enclosures would not have an impact on the area.
When Chairman Schiff questioned the number of units involved in this
petition, Attorney Gaylord replied that this is a condominium and the
petition requests that all four units in Building B be enclosed.
Chairman Schiff advised the petitioner's attorney that the Board of
Adjustment looks very carefully on any undue hardship. The board must
make sure that it does not create a precedent that will be detrimental
to the Town in the future.
Addressing Attorney Gaylord, Chairman Schiff said he would set a date
for the public hearing with the understanding that the attorney repre-
senting the petitioner keep in touch with the building official to make
sure all the necessary data (new screen enclosure sketches) is sub-
mitted prior to the date of the public hearing.
After lengthy discussion, the public hearing was scheduled for Thurs-
day, October 3, 1985, at 1:30 P.M. for Vernon Investment Properties
Corp. (workshop meeting regarding their petition was held on July 5,
1985) to be followed by a public hearing for Yachtsman's Cove Town-
house Condominium, Inc. At the completion of the public hearings, the
Board of Adjustment will hold its quarterly meeting.

The Workshop Meeting recessed at 2:05 P.M. to allow members to make an
on site inspection of the property in question.
After the on site inspection, Chairman Schiff adjourned the Workshop
Meeting at 2:35 P.M.
