BOARD OF ADJUSTMENT
WORKSHOP MEETING APRIL 11, 1985
Chairman Albert Schiff called the Workshop Meeting of the Board of Ad-
justment to order at 1:30 P.M. to examine Petition ##3-85-24 requesting
a variance under Sections 4.5 (e) (8) and 4.5 (11) of Chapter 30 of the
Code of Ordinances of the Town of Highland Beach.
Present were Messrs. Albert Schiff, Gilbert Lorenz, Charles Arbetman,
Albert Kahler and A. M. Fox, Jr. Also in attendance were Town Manager
Hugh D. Williams, Building Official Bruce Sutherland, Town Attorney
David Friedman, Architect A. N. Hosking and Recording Secretary Anne
Kowals.
Absent from this meeting was regular member Mr. Harold B. Cohen.
Architect A. N. Hosking of 2929 East Commercial Boulevard, Fort Lauder-
dale, Florida, representing Mr. Linet, stated he was an equal partner
in this project, and proceeded to explain request for variance.
The petitioner is seeking a height and setback variance. Present restric-
•tions on the 100' wide property does not allow project depicted in the
architect's rendition dated 3/25/85 being built.
To utilize the property so all apartments have a view of the ocean, the
petitioner is requesting a side setback of 25' and a height variance of
76'.
The project drawing was displayed and discussed by the architect, board
members and building official. The structure will be eight stories high -
seven floors of living area and one lobby and garage level on the ground
floor. Each apartment will be 3,223 square feet with two bedrooms plus
den. Balconies are located on the Southeast side of building. Allseven
apartments will be identical.
The height of the building is 75' 6" as measured from the crown of the
road. A 3' parapet on the roof top brings the height up to 78' 6". The
maximum building height, under present zoning, is 60' including parking
underneath. The garage in the proposed structure is partly underneath.
After a lengthy discussion regarding the original purchase of the pro-
perty and the zoning in effect at that time, the members questioned the
unnecessary hardship under which this appeal was made.

• Looking at the property along AlA in that particular area, there is a
mixture of single family residences or residences that are just tino or
three stories high, a little renovated motel and a new building is under
construction at the Le Concorde site*,-. This area is not a series of
highrises all by themselves; it is interspersed with other residences.
Chairman Schiff regretted the absence of Mr. Linet and noted that some-
time ago Mr. Linet wrote to the Mayor and copies were sent to all board
members questioning the changes being made at Le Concorde. Now, it ap-
pears that Mr. Linet is asking for a petition of variance from some of
the very things that he questioned.
Town Attorney Friedman said more testimony is needed about what special
conditions and circumstances exist which are peculiar to the land or
the building involved which are not applicable to other lands. It is
important to look at the other lands to see whether granting this peti-
tion would confer any special privileges upon petitioner which would
not be available to the other lands.
The Public Hearing date is scheduled for Thursday, May 9, 1985, at
1:30 P.M.
• Chairman Schiff advised Mr. Hosking that registered letters must be
sent to all neighbors within a 300' radius of the property in question.
The Workshop Meeting recessed at 2:15 P.M. at which time members went
to make an on -site inspection of Town lot 90 and adjoining properties
in that area.
Chairman Schiff adjourned the Workshop Meeting at 2:40 P.M.
