The Regular Meeting of the Town Commission of the Town of Highland Beach, Florida, was called to order by Mayor Joseph A. Boulay in the Commission Chambers at Town Hall at 7:30 P.M. Others present were Vice Mayor Bill Paul, Commissioners Arthur Eypel and John F. Rand. Commissioner Arlin Voress was absent. Also in attendance were Town Attorney Thomas E. Sliney, Town Manager Mary Ann Mariano, Town Clerk Anne M. Kowals and members of the general public. The Pledge of Allegiance was given following the roll call. ADOPTION OF IrIINUTSS The following Minutes were submitted for approval: May 28, 1991 - Workshop Meeting June 04, 1991 - Regular Meeting The MOTION by COMMISSIONER RAND/COMMISSIONER SYPEL approving the Minutes as written carried unanimously. • PUBLIC COMMENTS AND REQUESTS Ms. Marjorie Brasem, residing at the Casuarina Condominium, addressed the Town Commission to protest the patriotic decorations (which were made of a petroleum base material) that had been placed on the Town trees. Ms. Brasem made it clear that she was not protesting the patriotism, she was protesting the petroleum base material used for the bows. It was noted that the decora- tions are recyclable; they will be removed timely and stored for future use. REPORTS - TOi~1N Vice Mavor Bill Paul - No report. Commissioner Arlin Voress - Absent. Commissioner Arthur EvUel - No report. Commissioner John F. Rand Commissioner Rand acknowledged receipt of the announcement regard- ing the U. S. Women's Chess Championship Tournament scheduled to take place in Town Hall during August. It was noted that the publication cited by the Commissioner is available for review at Town Commission Regular Meeting Minutes July 02, 1991 Page 2 of 5 Town Hall and the announcement of the Tournament will run on the Town's government channel. It was further noted that considera- tion is being given to televise some of the final matches. Commissioner Rand, citing a newspaper article that appeared in the June 27, 1991 issue of the Sun Sentinel which referred to the proposed 'open house' as a 'party', noted the article was ir- responsible reporting. Mavor Joseph A. Boulav Under his report, Mayor Boulay noted he would like to see a few items on the July Workshop Meeting Agenda and the August Workshop Meeting Agenda. The Mayor, noting that while the Town has a 'scooper' law that is difficult to enforce, informed the Commission that some of the concerns and complaints center around dogs running loose on the beach. Mayor Boulay further noted that he would like the Commission to consider an ordinance that would address the matter of timing as related to Town Commission Meetings. The Town Clerk was directed to contact other Municipa- lities with regard to the matter of scheduling of Commission Meetings. Department. Mayor Boulay extended wishes (on 0 one and all for a Happy and safe Mariano acknowledged receipt of the eighth quarterly assessment mitigation report from Hidden Harbor Same is available for review in the Building Town Manager Mariano noted the Municipal League has been working closely with other Municipalities to work with the Palm Beach Countywide Planning Council to back down on the mandates they are trying to impose with regard to comrehensive plans. There is a compromise that, if we ever amend our plan for Town oriented purposes, at that time we will address some of the Countywide Planning Council's concerns. This matter will go to the Palm Beach County Commission for formal approval. The Town Manager noted the Town of Highland Beach is well represented in the Municipal League inasmuch as the Mayor has been appointed to the • Finance Committee and the Town Manager has been reappointed to the Directions Committee. w Town Commission Regular Meeting Minutes July 02, 1991 • Page 3 of 5 When the question regarding the recodified code was presented, the Town Manager reported that receipt of the first supplement is anticipated to be delivered sometime during the week of July 08. Commissioner Rand congratulated the Town Manager for arranging the Fire Station Lease and a response to his query indicated that the incoming revenue resulting from said Lease will be included in the up-coming 1991/92 f.y. budget. P.esponding to Commissioner Rand's inquiry, Town Manager Mariano stated the proposed Resolution regarding the National Pollutant Discharge Elimination System (NPDES) permit authorizes the Mayor to enter into the Interlocal Agreement for mandatory United States Environmental Protection Agency (EPA) permitting of municipal stormwater systems. REPORTS BOARDS AND COMMITTEES Mayor Boulay noted the scheduled Town Board Meetings. At this point, Commissioner Rand, noting Talent Bank Applicant Robert Lowe was in the audience, requested Mr. Lowe approach the dais and introduce himself to the Town Commission. Mr. Lowe, a resident at 3221 South ocean Boulevard for ten years, stated he retired from I.B.M. after 31-1/2 years of service and is interested in serving the Town on the Planning Board or an Ad Hoc Committee. 1. AN ORDINANCE OF THE TOWN OF HIGHLAND BEACH, FLORIDA, REPEALING ORDINANCES 573 AND 579 WHICH ORDINANCES AMENDED CERTAIN PROVISIONS OF CHAPTER 28-1/2 ENTITLED "TREES, SHRUBS RND VEGETATION". The proposed ordinance was given first reading on 6/04/91 and was published on 6/14/91. Mayor Boulay read same by title only. A MOTION by COMMISSIONSB RAND/COI~QSISSIONSR EYPEL to adopt the ordinance carried unanimously with "AYE" votes cast by Mayor Boulay, Vice Mayor Paul, Commissioner Eypel and Commissioner Rand. 2. A RESOLUTION CREATING A CHARTER REVIEW BOARD. The Commission Members reviewed the proposed resolution and accepted the following suggested amendments: Delete the last sentence in paragraph one. The last sentence in paragraph 2 should read "...progress • at each Monthly Workshop Meeting of the Town Commission." Town Commission Regular Meeting Minutes July 02, 1991 • Page 4 of 5 It was the consensus of the Town Commission that the Board itself would set up a schedule for meeting as they are able to arrange for a majority of the Members to be in attendance. With regard to renumeration, it was noted that matter would be handled administratively. A NOTION by COMMISSIONER RAND/VICE MAYOR PAUL to adopt the Reso- lution as amended carried without objection. 3. A RESOLUTION AUTHORIZING THE ENTERING INTO OF AN INTERLOCAL AGREEMENT BETWEEN THE TOWN OF HIGHLAND BEACH, FLORIDA, AND THE NORTHERN PALM BERCH COUNTY WATER CONTROL DISTRICT FOR MANDATORY EPA PERMITTING OF MUNICIPAL STORMWATER SYSTEMS. Mayor Boulay read the resolution by title only and noted that this matter was discussed fully at the last Town Commission Workshop Meeting. The MOTION proposed by VICE MAYOR PAUL/COMMISSIONER EYPSL adopting this Resolution carried unanimously. At this point, Commissioner Rand, noting he thought the last News- letter was well done, commented that many residents have given great compliments on the publication which contained a nice personal touch. The Commissioner extended congratulations to those responsible for the Newsletter. Mayor Boulay commented that the Newsletter will be as good as the people who give input and requested anyone wanting to include an item in the Newsletter contact Town Hall to discuss the matter with staff. The Mayor noted that, Under Regular Business, there were no 'Items Left over' and no 'Consent Agenda'. Mayor Boulay extended thanks to all who took the time to attend this Regular Meeting of the Town Commission, There being no further business to come before the Town Commission at this time, MOTION to adjourn was made by VICE MAYOR PAUL/COM- NISSIONSR RAND.
