Boulay called the Workshop Meeting of the Town Commission -of the Town of Highland Beach, Florida to order in the Commission Chambers at Town Hall at 1:30 P.M. Others present were Vice Mayor Bill Paul, Commissioners Arthur Eypel and Arlin Voress. Commissioner John F. Rand was absent. Also in attendance were Town Attorney Thomas E. Sliney, Town Manager Mary Ann Mariano, Town Clerk Anne M. Kowals, and members of the general public. ADDITIONS. D$LSTIONS OR ACCSPTANCS OF AGBNDA The Agenda was accepted as written. 91.1 PUBLIC COlQ~IiTS AND RBOUSSTS Mr. Jose Echeverria of Russell Drive, addressed the Town Commis- sion to report on the recent meeting of the Palm Beach County Beaches and Shores Committee. Mr. Echeverria advised there is • movement on in Tallahassee with regard to coastal building whereby permitting for coastal construction will be more difficult to come by. Mr. Echeverria, head of the Highland Beach Turtle Program, noting the Town has had some good 'nesting' this year, reported that the 'zone people' are cleaning the beach and watching the turtles on our beach. 91-2 Mayor Boulay, noting the existing Planning Board Alternate Member vacancy, stated that, at the June 04, 1991 Regular Town Commission Meeting, it was the consensus that this position remain vacant until the Commission determines how the Alternate/Regular Member- ship matter should be addressed. At this time, the Commission interviewed Talent Bank Applicants Arthur Hamerman and Eugene Behrman (both of whom have attended the Financial Advisory Board Meeting) who have expressed an interest in serving on Town Boards. No correspondence was received from any Town Boards and Committees. • Town Commission Workshop Meeting Minutes June 25, 1991 Page 2 of 6 91.3 PROPOSED ORDINANCES AND RESOLUTIONS 1. AN ORDINANCE OF THE TOWN OF HIGHLAND BEACH, FLORIDA, REPEALING ORDINANCES 573 AND 579 WHICH ORDINANCES AMENDED CERTAIN PROVISIONS OF CHAPTER 28-1/2 ENTITLED "TREES, SHRUBS AND VEGETATION". The ordinance, given first reading on 6/04/91 and published on 6J14J91, was read by title only by Mayor Boulay. Following brief discussion, it was the consensus of the Town Commission to move this iten to the July 02, 1991 Regular Meeting Agenda for further discussion and possible adoption. 2. A RESOLUTION CREATING A CHARTER REVISION BOARD. During discussion of the proposed resolution, the Commission Members agreed to the following: the title is to read "Charter Review Board"; same shall consist of 11 members with each Town Commissioner and Vice Mayor appointing two members and the Mayor appointing three members; the Charter Review Board shall present a progress report at the Town Commission Workshop Meeting each month. In discussion relating to the matter of a date for the • completion of the Charter review, it was noted that any date agreed upon may be changed by Resolution, if necessary. It was the consensus to keep the final date open, at this time. The Town Attorney, noting certain types of changes to the Charter would require a referendum as per State Statute 166 which provides the home rules, stated most changes would be done by ordinances. Attorney Sliney noted he had, in the past, submitted a letter to the Town regarding changes to the Charter that might require a referendum. Regarding the Charter review, Attorney Sliney advised he knows of no particular changes that need to be done; the Town is trying to update the Charter which amounts to nothing other than a house- keeping measure. The Mayor requested any interested, qualified people wishing to volunteer their services for the Charter Review Board contact any Member of the Town Commission. 8_74 Tlisrncrinn~ re J'ulvlAuctust Newsletter During discussion of the July/August Newsletter, the Town Commis- sion accepted suggested amendments/additions and approved same for mailing to residents. The Mayor noted that the Town will show its patriotism and appreciation for the troops of all conflicts by • decorating the community for the Fourth of July. Town Manager Town Commission Workshop Meeting Minutes June 25, 1991 • Page 3 of 6 Mariano informed the Commission that the July/August Newsletter which advises of (and requests residents to join in) the Town's plan to decorate will be timely mailed so as to reach all residents in advance of the Fourth of July observances. MISCELLANEOUS ITEMS LEFT OVER status of Building Development in Town The Commission Members received and reviewed the Status of Building Development in Town, a report prepared by the Building official. Minutes for approval at Julv Regular Meetina Two sets of Minutes to be submitted for approval at the July Regular Meeting were reviewed and will be included on the July 02, 1991 Regular Meeting Agenda. REPORTS - TOWN COMMISSION Vice Mavor Bill Paul • No report. Commissioner Arlin Voress Commissioner Voress requested the Town Manager research the cost of having the Town Seal and Town Name painted on the water tower behind Town Hall. Commissioner Voress advised he would like to see a Town Committee appointed for planning an 'Open House' in the Fall, hosted by the Town at the Town Hall Complex, for the purpose of welcoming back residents wha are returning for the season. Commissioner Voress reported that the Town Manager and he met this morning (6/25/91) with the Town's Engineers, J. M. Montgomery, to discuss the progress relating to the Town's safe water yield cal- culations. The Commissioner noted that the Town Manager, the Water Resources Advisory Board Chairman and he are planning to meet with South Florida Water Management District within the next three weeks to discuss the data and gain insight as to how S.F.W.M.D. perceives the technical data and what restrictions on the Town's well withdrawal rate might be acceptable to S.F.W.M.D. over a ten year period. Commissioner Voress noted that the Town is on schedule with developing plans and data to meet the 10/11/91 date for the Town's long term water plan. • Tocan Commission Workshop Meeting Minutes • June 25, 1991 Page 4 of 6 Commissioner Arthur Evpel Commissioner Eypel reported the Hurricane Preparedness Seminar presented by Mr. Kennedy of the Palm Beach County Civil Defense, arranged by Police Chief Cecere, was very informative and well attended. Commissioner Eypel, citing communication (including a Wall Street Journal article} received from the Town Attorney, noted the article regards a new Federal Communications Commission vote that would reinstate local rate regulations for cable T.V. operators. The Commissioner further acknowledged receipt of a letter from Mr. Chuck Blaine, Development/Community Relations Coordinator at Adelphia Cable, dated 6/19/91, which indicates Adelphia has taken the pcsition that the new F.C.C. regulation vote was unnecessary. It was noted that Adelphia is awaiting receipt of a copy of the new regulations and will not make a commitment until same is received. Mayor Joseph A. Boulav Mayor Boulay, noting he has attended the Hurricane Preparedness • Sessions for the last three years, reported this year's presenta- tion which had been promoted on the government channel, in the Town Newsletter, etc., attracted a full house of interested indi- viduals which is indicative of a new wave of interest in the Town. The Mayor stated he is looking for the same interest to surface with regard to the Committee for the proposed 'Open House'. At this point, Mayor Boulay reported that, when it was decided the Town would be decorated for the Fourth of July, help was needed in making the decorations; a call went out and twenty residents volunteered their services. Mayor Boulay thanked one and all for a job well done. REPORTS - TOWN ATTORNEY Town Attorney Sliney reported the Broadview Litigation has not gone to trial as yet; hewever, a meeting with Magistrate Seltzer in West Palm Beach has been scheduled for Thursday, June 27, 1991. said meeting will be similar to the meeting held before Judge Vitunic some months back. It was noted that the June 27th meeting will be more of a get-together to determine how far apart the involved parties are. The Agenda Report Form regarding the Fire Station Lease, prepared • and submitted by the Town Manager, was discussed and it was the r t ` a Town Commission Workshop Meeting Minutes June 26, 1991 • Page 5 of 6 consensus to defer this matter to the July Workshop Meeting of the Town Commission to allow the Members to review the comments and observations of the Town Attorney received this date. Commis- sioner Voress congratulated the Town Manager for arranging the Fire Station Lease with the County while the County continues to maintain the property. Town Manager Mariano informed the Town Commission that she has been appointed to the Palm Beach County Fire/Rescue Advisory Board and will be working in over-seeing the budget and proposals of Palm Beach County Fire/Rescue. Town Manager Mariano submitted an Agenda Report Form regarding the National Pollutant Discharge Elimination System (NPDES) permit for stormwater systems. It was noted the U. S. Environmental Protec- tion Agency mandates all municipalities within Palm Beach County apply for a NPDES permit. Commissioner Voress explained that North Palm Beach County Water Control District agreed to be the "lead permittee" for all of Palm Beach County and, the Town's Engineers (J. M. Montgomery) have followed the establishment and proposed implementation of the EPA requirements including the decision to engage the services of • Mock, Roos & Associates for some of the overlapping engineering work; Montgomery would continue to be involved in the compilation of some required data to obtain the Town's portion of the county- wide permit. It was the consensus to move the Resolution (which will be amended to clarify the fact that the Town shall be a co- permittee for purposes of application to the EPA, with the ulti- mate permit being issued in the name of the Town of Highland Beach) authorizing the entering into of an Interlocal Agreement between the Town of Highland Beach and Northern Palm Beach County Water Control District for Phase 1 for mandatory EPA permitting of municipal stormwater systems to the July 02, 1991 Regular Town Commission Meeting Agenda for further discussion and possible adoption. Regarding Phase 2 as relates to this matter, it was noted that the Town may not want to continue as part of the group but may instead opt to proceed on its own. Town Manager Mariano informed the Commission that the components for the Commission Chambers new public address system have been ordered and it is anticipated same will be received and installed in approximately sixty days. The Town Manager noted the plans for the Women's Championship Chess Tournament scheduled to take place in Town Hall during the week of August 17, are formulating nicely.
