SIDE YARD, 12 FEET. PUBLIC HEARING.
Chairman Blosser called the meeting to order at 7:40 p.m., a delay of ten
minutes in order to permit the presence and participation of a fifth member.
The Chairman then advised that this was a Public Hearing called to examine
an application for Variance submitted by Joseph H. and Lillian McCoy for
Lot 4, Block 5, 4226 Tranquility Drive, Bel Lido. The Agenda is Attach-
ment"A". Proof of publication for the Notice of Public Hearing is Attach-
ment "B".
Present: F. C. Scofield, A. J. Kiefer, R. F. Blosser,
E. E. Aldrich, R. C. Frederick
Absent: W. J. Wernecke, Lester Levine
Following Chairman Blosser's suggestion, Mr. Aldrich moved that the roll
call and examination of minutes be dispensed with at this time. Mr.
Frederick seconded, all aye votes.
Mr. Fran Hamzik, Building Official, presented proof of mailing of notice
of Public Hearing, to all residents within 300 feet of the subject property.
Mr. Hamzik noted that Mr. McCoy was notified of the existing violation of
Code and Mr. McCoy opted to apply for approval of a Variance. Mr. Hamzik
• then read from page 2 of the application for approval of Variance, as
follows:
"The slab is existing, was made when the house was constructed and approved
for this structure by Mr. Schott, at that time the Building Inspector for
Highland Beach.
This structure is designed to enhance the property. It is not designed to
enlarge the existing home, as there is no entrance from this storage shed
to the home. It is to be utilized strictly for storage of lawn and pool
maintenance equipment. This structure is 5 ft. by 12 ft. and is located
approximately 105 ft. from the street and behind a 10 ft. hedge which
belongs to this property, almost completely concealing it. The net effect
is that it is almost not visible.
It would be a hardship not to grant this Variance to construct this struc-
ture as the existing slab has been paid for as well as the materials and
labor.
It would be discriminating not to receive Variance as one was granted for
Mr. and Mrs. Carmine Bedotto, Lot 5, Block 3, and also for Block 3, Lot 11
and a 5 ft. Variance was recently granted for an entire building at the
• entrance to Bel Lido."
At the request of members of the Board of Adjustment, Building Official
Hamzik read the attachment relating to the Variance requested under

Section 9.3 of Chapter 30 of the Code of Ordinances, Attachment "C". This
application was made by Dr. Carmine Bedotto and Carol D. Bedotto, his wife.
Chairman Blosser asked Mr. Hamzik if there are special conditions and
circumstances existing which are peculiar to the land, structure, or build-
ing involved and which are not applicable to ether lends, buildings, or
structures in the same district. Mr. Hamzik advised there are not. Mr.
Hamzik noted that no special approval was required for construction of the
existing slab on the subject property. He also advised that nothing in the
original records or plans indicated a shed was to be constructed on the
property.
Following a general discussion, including variance decisions cited by
applicant, motion was made by Col. Scofield that special conditions and
circumstances do not exist which are peculiar to the land, structure or
building involved, therefore the variance should be disapproved. Mr.
Aldrich seconded the motion. Voting was as follows:

It was therefore the unanimous decision of the members of the Board of
Adjustment that the application for variance be disapproved. Letter
advising of disapproval is to be sent to applicant, Attachment "D".
ADJOURNMENT
Mr. Frederick moved to adjourn the Public Hearing, Mr. Aldrich seconded.
All aye votes. The Public Hearing was adjourned at 8:30 p.m.
