MINUTES: BOARD OF ADJUSTMENT, WORKSHOP MEETING, MAY 27, 1980. PETITION
FOR VARIANCE, JOSEPH H. AND LILLIAN M. MC COY, 4226 TRANQUILITY
DRIVE, BEL LIDO. SETBACKS.
• Chairman Blosser called the meeting to order at 7:35 p.m., advising this
was a workshop meeting called for the examination of a petition for variance
submitted by Joseph H.and Lillian M. McCoy for Lot 4 Block 5, 4226 Tran-
quility Drive, Bel Lido. The agenda is Attachment "A".
Present: W. J. Wernecke, R. F. Blosser, R. C. Frederick,
F. C. Scofield, E. E. Aldrich, L. Levine (Alt.)
and A. J. Kiefer (Alt.)
Chairman Blosser advised the petition requested a determination by the
Board of Adjustment on an appeal under Section 4.1(e)(4) of Chapter 30,
zoning Code, Town of Highland Beach. J
Chairman Blosser noted.the variance related to a storage shed constructed
on the subject property. Bicycles, lawn maintenance equipment, pool main-
tenance equipment, etc., to be stored in the shed. Building Official Fran
Hamzik informed Board members that a Code Violation citation had been issued
on the property, for a violation of Section 4.1(e), Building Site Regula-
tions for violation of side yard setbacks. The structure now has 7 ft.
setback instead of 12 ft. setback required. Mr. Hamzik noted the structure
requires approval of a request for variance, the slab does not.
is Mr. Hamzik added that requests for similar variances had previously been
approved for Mr. S. Maas for Lot 11, block 3 and for Dr. C. Bedotto for
Lot 5 Block 3, both in Bel Lido.
Mr. Mc Coy informed the members of the Board that the slab had been built
on the property as shown on original plans at the time the structure was
built. The partially constructed shed is concealed by shrubs and trees,
is not attached to the main structure and has no connecting entrance to
the main structure. The shed material, color and lines are to be the same
as the main structure. The shed faces the windowless, doorless side of the
adjacent structure.
At the conclusion of the general discussion, Chairman Blosser recommended
a public hearing with due public notice (Attachment "B"), be called for
Monday, June 23, 1980, at 7:30 p.m., to consider the petition for variance.
Mr. Aldrich so moved, Mr. Wernecke seconded. Col. Scofield, Mr. Wernecke,
Mr. Frederick, Mr. Aldrich and Chairman Blosser voted aye. Chairman Blosser
called for a five minute recess at 8:30 p.m.
At 8:35 p.m. Chairman Blosser called the meeting to order. The matter of
examination of Petitions for Special Exceptions by Boards other than the
40 Board of Adjustment, was discussed. It was noted that Dr. Richard Orman
had indicated the trend was to have requests for Special Exceptions approved
by the Town Commission rather than the Board of Adjustment.

• Revised copies of Procedures and Forms were examined by the Board. At the
conclusion of the discussion Chairman Blosser inquired as to whether members
of the Board had examined proposed changes in the INFORMATION SHEET, the
PETITION FOR VARIANCE/ADMINISTRATIVE REVIEW FORM, the DECISION ON PETITION
FOR ADMINISTRATIVE REVIEW FORM and the DECISION ON PETITION FOR VARIANCE.

Col. Scofield moved to accept the Information Sheet and Petition forms,
with Decision forms, as revised. Mr.Wernecke seconded the motion. Mr.
Wernecke, Mr. Frederick, Mr. Aldrich, Col. Scofield and Chairman Blosser
voted aye. The forms and information sheet were approved as revised and
presented.
Building Official F. Hamzik noted that changes in the Florida State Statutes
must be closely checked to keep abreast of action taken to revise: the
Statutes. Copies of changes will be distributed to Board of Adjustment
members by the Building Department.
ADJOURNMENT
Col. Scofield moved to adjourn the workshop meeting, Mr. Wernecke seconded.
All aye votes, Mr. Wernecke, Mr. Frederick, Col. Scofield, Mr. Aldrich,
Chairman Blosser. The workshop meeting was adjourned at 10:00 p.m.
The next scheduled meeting of the Board of Adjustment will be a public
hearing with due public notice, to examine the application for approval
of variance, submitted by Joseph H. and Lillian M. McCoy. This public
hearing is scheduled for Monday, June 23, 1980, at 7:30 p.m.
