FOR VARIANCE. JAMES M. SCHUBERT, LOT #128. SETBACKS.
•Chairman Blosser called the meeting to order advising this was a public
hearing, called in accordance with the requirements of Chapter 30, Section
4.1(e)(10) of the Code of Ordinances of the Town of Highland Beach, Florida,
to consider a petition for a variance for the property located at 2454 South
Ocean Blvd., Highland Beach, Town Lot #128 West, or, South 50' of Lot 11A
and all of Lot 12A, Byrd Beach Subdivision of Town of Highland Beach, Florida.
This request has been made by Mr. James M. Schubert. Proof of publication
is Attachment "A".
Present: R. F. Blosser, W. J. Wernecke, L. E. Brotzman,
E. E. Aldrich, A. J. Kiefer, F. C. Scofield.

Copy of public notice was referred to Secretary Scofield for approval.
Chairman Blosser noted that the required Board of Adjustment procedure,
that of notifying all property owners within three hundred (300) feet of the
subject property, that the petition for variance had been submitted, had not
been complied with by the petitioner. A new date for a Public Hearing must
be scheduled.
Following general discussion relative to notification of residents and
format of letter to be used by petitioner for this notification, Mr. Schubert
advised he will mail letters of notification to residents as required, with
copy of petition and noting date and time of scheduled public hearing.
Secretary Scofield moved that members of the Board of Adjustment follow
the usual procedures and schedule a date for a public hearing to consider
the petition for variance submitted by Mr. Schubert. Mr. Wernecke seconded
Following discussion it was agreed the public hearing be scheduled for
Monday, November 12, 1979, at 7:30 p.m. Mr. Wernecke, Col.Scofield, Chair-
man Blosser, Mr. Frederick and Mr. Brotzman, voted aye. It was later de-
termined that since November 12, 1979, is a holiday, this public hearing
will be held on Tuesday, November 13, 1979, at 7:30 p.m. A copy of the
public notice will be mailed to the petitioner by the recording secretary,
Attachment "B". Col. Scofield noted that the only requirement for the
letter from petitioner to residents is specification of time, date and
nature of petition be included.
ADJOURNMENT
At the conclusion of the business of the public hearing it was agreed that
a certified letter will be sent to petitioner advising of the date and
time scheduled for hearing petition.
Mr. Frederick noted terms of members due to end in 1979. A poll of members
indicated the following wished to be considered for reappointment; Mr.
Aldrich, Mr. Kiefer, Mr. Frederick. Mr. Brotzman advised he did not wish
to be considered for reappointment upon completion of his present term,
• ending in February 1980.
