OCTOBER 1, 1976
Chairman Horton called the meetingto order
at 7:30 P.M., advising
this was a Public Hearing called for the purpose of considering a
petition from Mr. John O'Grady acting as agent for St. Lucy's church.
Present - E. Finch, R. Frederick, R. Blosser, L. Brotzman, L.Y. Horton.
Absent - F. Scofield, F. Hartkopf.
Chairman Horton recognized Mr. O'Grady, authorized agent for St.
Lucy's church.
Chairman Horton reviewed the case in hand. He noted that the
Petition No. 5753S, dated August 4, 1976, sought relief from Section
23.7(f)(2) Code of Ordinances, Town of Highland Beach. Mr. O'Grady
requested the Board Members to refer to Section 23-2(9). Mr. Horton
read from the petition for the record. It was noted that these plans
had been reviewed by the Community Appearance Board on July 29, 1976,
at which time an error was noted.
Mr. O'Grady stated that he signed a paper from the Community Appearance
Board verifying the fact that after checking the Zoning Ordinance, he
felt
the request was correct.
Discussion followed realtive to the the size of the signs, lighting
of sign, number of signs, location of signs, etc.
Chairman Horton read from the Community Appearance Board Minutes
dated July 29, 1976.
Chairman Horton recognized Father Chepanis who also presented his
case to the Board of Adjustment. After being questioned Father
Chepanis noted that the cost of the signs would be in the area of
$1,000.00.
Chairman Horton stated that he felt a good case has not been made
for the relief requested. He questioned salvage value on these
signs, financial obligation on the part of St. Lucy's.
There was a great deal of discussion, questions and answers.

Mr. O'Grady excused himself from the meeting at 8:50 P.M.
Chairman Horton recognized the following citizens in the audience:
Mr. Earl Totz, Esther A. Schroder, Mr. Kurtz, Mr. Conway, Mrs.
Farrell, Mrs. Horn.
Chairman Horton recognized Earl Totz who requested to speak for the
record: " I would like to say that we did not come here to put
John O'Grady on his defense and to be judged by your Board or the
parishioners. We came here for a petition for the sign to be
either accepted or tb be denied by your Board. It seems that
we have been turned away and John O'Grady is in judgement. I
think that should not be in the record.
Mr. Horton noted that he was not interested in castigating Mr.
O'Grady at all. It was noted that he did make two errors.
Mr. Horton went on to explain the position of the Board of Adjustment.
The Board Members discussed various possibilities to resolve this
problem.
MOTION by Mr. Bro`nsman/Seconded by Mr. Frederick:
1. The Sign Ordinance, Chapter 23 of the Code of
Ordinances does not give the Board of Adjustment �
to commit the Town.
2. It is the consensus of this Board that the case
presented has not been sufficient to warrant
granting of the appeal.
3. It is the consensus of this Board that the Town has
moral responsibility, in the fact, that funds have
been committed based upon an error of *-Town Official.

Mr. Horton took this oportunity to thank the citizens that
participated in the meeting this evening.
The purpose for which this public hearing was called has been
accomplished - meeting ADJOURNED at 9:35 P.M.
