1976.08.09_BAA_Minutes_SpecialMINUTES: BOARD OF ADJUSTMENT - SPECIAL MEETING - PETITION FROM ST. LUCY'S CHURCH - SIGNS - AUGUST 9, 1976. Chairman Horton called the meeting to order advising this was a Special Meeting of the • Board of Adjustment, called for the purpose of setting a date for a Public Hearing, with due public notice, on a petition from St. Lucy's Church, Highland Beach, for ingress and egress signs. The Agenda is attachment "A". The meeting was called to order at 5:55 P.M. Present: Mr. R. F. Blosser, Mr. R. C. Frederick, Mr. L. Y. Horton. Absent: Col. F. Scofield, Mr. Fred Hartkopf, Mr. L. E. Brotzman. Chairman Horton advised the pertinent part of the Sign Ordinance concerning the Board had to do with Section 23.3, Permits. "It shall be unlawful for any person to post, display, repair, change, or erect a sign in the town without first obtaining a permit." Section 23.3.2 was read by Chairman Horton, Attachment "B", Section 23-7, referring to signs permitted and regulated, was examined and commented on, (b) In all zoning districts one each "entrance" or "in" "exit" or "out", "no trespassing" or "posted" sign is permitted for each one hundred (100) feet of road frontage. It shall be no larger than three (3) square feet, illuminated or nonilluminated as the owner or the police department might determine. No permit is required. Copies of the petition were distributed. A discussion of the petition followed. Following the general discussion relative to the Sign Ordinance and Petition, Chairman Horton noted that Page 10, Paragraph 8 of the Board of Adjustment Operating Procedures (10/30/75) indicated under Specific Procedures for Petitions for Relief from the Signs and Advertising Ordinance (Chapter 23 of the Code of Ordinances) that the Board •may authorize upon appeal in specific cases such relief from the terms of the Sign and Advertising Ordinance as * will not be contrary to the public interest where, owing to special conditions, a literal enforcement of the provisions of the Signs and Advertising Ordinance would result in unnecessary and undue hardship. A variance from the terms of the Ordinance shall not be granted by the Board of Adjustment unless and until: (see Attachment " "). In accordance with Para. 8, Page 10, of the Operating Procedures, a Public Hearing with due public notice; will be scheduled for Wednesday, September 1, 1976, at 7:30 p.m. at the Town Hall.
