Mr. Richard T. Kemper the Vice Chairman, acting as Chairman because of
40 the resignation of Mr. Watson, called the Public Hearing at 2:30 p.m..
In attendance the following board members were present: Messrs. William
J. Wernecke, George K. Whyte, Charles Saari, and Col. Frank C. Scofield,
Jr., and Richard T. Kemper.
The hearing was advertised in the Boca Raton News on November 23, 1973,
and again on December 21, 1973, for the purpose of considering and to
take whatever action necessary regarding a petition received from
Weidersum & Associates for a Special Exception under Chapter 30, Section
5.5 of the Code of Ordinance of the Town of Highland Beach.
Representing Weidersum & Associates were Mr. Baccardi and Mr. Weidersum;
and other interested residents in the Town.
Mr. Kemper gave a dissertation of what the petition of Weidersum entailed,
reciting the requirements of giving legal notice and that the adjacent
property owners were given sufficient notice, 30 days, of this matter.
A prior meeting, November 19, which was to discuss this petition was
nullified. Mr. Kemper informed those in audience that the Board of
Adjustment had consulted with members of the Planning Board and with
members of the Building Dept. on December 13, 1973.
Several persons in audience expressed their views and the matter was
discussed.
Mr. Weidersum requested the Board to grant the Special Exception pursuant
to provisions of Section 5.5(e). He further stated that the approval
is being requested for eighteen feet increase in height; however, their
project will only occupy 1W. of their site. He further advised that
sites occupied by other buildings were: Highland Towers 21%, Penthouse
Towers 20%, the latter has an additional 33%o for their two story paring
structures; and Sea Pines 180%. Discussion followed.
Mr. Kemper informed the Board that an opinion would be secured from the
Town's Attorney, Thomas E. Sliney, and if they are in error on making
a decision, such action would be nullified; however, it was deemed
desirable that delays not be continued. The members were then polled
as to their wishes in this regard. The petitioner and interested
residents were informed that it was the decision of the members of the
Board to render their decision now. He requested each member in giving
his vote to announce their name to the recording secretary, and members
voted as follows:
Mr'. George K. Whyte stated he was in favor of granting the exception.
Mr. R. Kemper then requested that this statement (and/or others) be so
recorded; Mr. William J. Wernecke stated that he would like to preface
his decision and gave his statement; his vote was for granting the
special exception; Mr. Charles Saari stated he was against, on the

basis it is not compatible with the adjacent building,and height; Col.
Frank C. Scofield, Jr. voted for the Special Exception; Mr. Richard T.
Kemper also made a statement and voted Yes. (accordingly, the records
show there were four yes votes and one no).
