Also Attending: Mayor Bernard Featherman, Town Manager Kathleen Weiser, Commissioner Louis Stern, Administrative Assistant Rosalie DeMartino and members of the public. 1. CALL TO ORDER: Chair Svenstrup called the Regular Meeting to order at 9:30 AM. Roll call was taken by Rosalie DeMartino, Administrative Assistant, followed by the Pledge of Allegiance. 2. ADDITIONS, DELETIONS OR ACCEPTANCE OF AGENDA: Chair SvenstM called for additions, deletions or acceptance of agenda. By consensus, the Board accepted the agenda as presented. 3. PUBLIC COMMENTS AND REOUESTS: There were no public comments. 4. PRESENTATIONS There were no presentations. 5. APPROVAL OF MINUTES: • January 8, 2013 — Regular Meeting MOTION: Member Albertson moved to approve the January 8, 2013 Regular Meeting Minutes; seconded by Member Hiles Motion passed with all in favor. 6. OLD BUSINESS A. Discussion of Town Wide Beach Clean -Up on April 8, 2013 Chair Svenstrup explained the reason for changing the Town Wide Beach Clean-Up Day from Saturday April 6, 2013, which was agreed upon at the last meeting, to Monday April 8, 2013 at 9:00 a.m. Town Hall is closed on Saturdays and it would be Beaches & Shores Advisory Board February 12, 2013 Page 2 of 4 more convenient for the volunteers to pick up their supplies at Town Hall on Monday. Also, it would be easier to have the trash picked up by the town after the beach clean- up on that day. A flyer prepared by Administrative Assistant Rosalie DeMartino was presented to the Board for approval. There were a few minor changes such as adding the Town Hall phone number as an additional contact; placing the word "bottled" in front of water and adding the trash grabbers to supplies. The Board members will be supplied with a number of flyers for distribution. Chair Svenstrun asked for a list of all the condominiums and their managers for each member. She requested that they divide this list and ask each manager to post the flyer. The event has been written up in the Coastal Star and hopefully we will have a good number of volunteers. Vice Chair Oaklander purchased two trash grabbers for the Board's consideration; a plastic grabber for $1.50 and a metal grabber for $9.99. The members all agreed that the plastic trash grabber was sufficient for the beach clean-up. Administrative Assistant Rosalie DeMartino will look into ordering the plastic trash grabbers. 7. NEW BUSINESS A) Review Resolution No. 815 pertaining to the responsibilities of the Beaches & Shores Advisory Board. Chair Svenstrun stated that the Beaches Advisory Board was established by Resolution No. 805 on October 14, 2003. On June 1, 2004, Resolution No. 815, the Beaches Advisory Board was renamed the Beaches and Shores Advisory Board. It also amended some of the responsibilities of the Board; specifically Item No. 6: Assist the Town Commission, upon the Commission request, with items and issues related to waterways within the corporate limits of Highland Beach including boat wakes, manatee protection and mangroves. She indicated that this Board has tried to do work on all of these in the past and can make recommendations to the Commission regarding these regulations and beach cleaning. Member Jiovanazzo stated that some of the homes on the south end of town have replanted shrubs and grass after Hurricane Sandy. He also observed that there were some homes that do not have this type of vegetation; only the natural sea grapes. Vice Chair Oaklander suggested that, if it is not already a requirement, the Board make a recommendation that the dunes be planted with the appropriate plants. There was a discussion regarding sea grapes and whether or not they can be trimmed or removed. They also discussed the Boca Raton sea grape project along AIA. Town Manager Weiser stated that sea grape trimming, planting and everything else is out of the jurisdiction of the town. If someone wants to trim the sea grapes, it is a whole permitting process through the State. She indicated that the Boca Raton sea grape project cost $700,000 and was permitted through the State. Member Hiles asked the Town Manager if it was mandatory that residents have vegetation in front of their homes along the beach. Town Manager Weiser did not believe it was mandatory. Beaches & Shores Advisory Board February 12, 2013 Pate 3 of 4 Vice Chair Oaklander stated that he requested the Board review the Resolution in light of what took place two meetings ago regarding the beach erosion and the concerns of the residents. He indicated that it wasn't clear what the parameters are that we work under, and that we understand them, and whether or not we want to increase them or change them. He asked if this is something we can do to add or request to do other things besides what we are doing now. Chair Svens!W stated that this Board is an advisory board. We are trying to assist the turtle program by having turtle walk days and also beach clean-up. Member Riesa suggested we ask the Commission if they would want to utilize this Board in anyway when there is an emergency situation to the beach or the shoreline; especially, when the employees of the Town do not have enough resources to do everything that might be necessary, such as making phone calls, etc. She feels it would be beneficial to the Town if we could volunteer our services in a constructive way during the time of emergency. Member Jiovanazzo suggested we put out information to encourage homeowners to keep the beaches clean and be responsible for their property. Chair Svenstruy indicated that all the condos pay their portion for beach cleaning. She stated that in walking the beach, the worst areas of debris are the vacant lots and the lots that are being built on. Member Hiles stated that she walks the beach every day during turtle season and the two high rises in her zone have the same trash there every day and would remain there if she does not pick it up. She feels if there is a service, it is not being used. Chair Svenstruv indicated that she has noticed that the beach rakers are not doing a thorough job, but it is up to the Condominium Managers to address this. When the members deliver the flyers, perhaps they can mention this to the managers. Vice Chair Oaklander feels there should be a town ordinance that would force people to clean their property on the beach or be fined. Chair Svenstrup stated that the Board could ask for more patrol of the beaches to see if there are a lot of these violations. Vice Chair Oaklander asked how they could go about this process and who would take it to the next step. Manager Weiser stated that she did not know since the Town has no jurisdiction over that portion of the beach. You have no teeth in any enforcement because the Town cannot enforce it. She will have the Town Attorney look into this to see what we can and cannot do; but feels you can't put in a rule that you cannot enforce and cite people. The area the Board is talking about is not like the front of the property where everyone can see it. The State has total jurisdiction over the beach front of the properties and unless they give us the right to issue permits, such as they did during an emergency situation, we have no jurisdiction over it. Member Jiovanazzo questioned the stakes and tape around the turtle nests and whether they can be removed if placed on the private part of the beach. Town Manager Weiser stated that they cannot and it is governed by the State. Member Hiles made mention that Sgt. Carl is responsible for enforcing the laws regarding the turtle nests; such as lighting, disturbing the nests, etc. Beaches & Shores Advisory Board February 12, 2013 Pate 4 of 4 Chair Svenstrun stated they will let the Town Commission know that the Board is willing to work with the Town in any capacity at any time. 8. ADJOURNMENT: Chair Svenstrun announced that the March 12`' meeting of the Beaches and Shores is cancelled due to lack of agenda items. Chair Svenstrun called for a motion to adjourn at 10:25 a.m. MOTION: Member Andrews moved to adjourn the meeting at 10:25 a.m. Vice Chair Oaklander seconded the motion which passed unanimously.
