REGULAR MEETING

Members Present: Chairman Lucy Miller; Vice Chair Ruth Samuels, Member Betty
Hofstadter, Member Rosalind Svenstrup, and Member Evelyn Weiss. Absent: Member
Barbara Zeeman (excused). Also Attending: Town Manager Dale Sugerman, Town
Clerk Beverly Brown and members of the general public.
CALL TO ORDER:
Chairman Miller called the Regular Meeting to order at 9:30 AM. Roll Call was taken by
Town Clerk Brown, followed by the Pledge of Allegiance.
ADDITIONS, DELETIONS OR ACCEPTANCE OF AGENDA:
MOTION: Vice Chair Samuels moved to accept the agenda as presented; seconded by
Member Weiss. Motion passed with all in favor.
• PUBLIC COMMENTS AND REQUESTS:
Vice Chair Samuels introduced Joel Ignaton, a new resident and prospective applicant for
the Board.
PRESENTATIONS:
None.
APPROVAL OF MINUTES:
MOTION: Vice Chair Samuels moved to approve the minutes of the September 8, 2009,
regular meeting and the September 30, 2009 workshop meeting; seconded by Member
Hofstadter. Motion passed with all in favor.
OLD BUSINESS:
A) Mangrove Project
Member Weiss stated that Ken Spole requested to be on the February 10, 2010 Agenda,
and continued her report by submitting the following comments received from Carman
Vare, Environmental Program Supervisor of the Marine and Estuarine Section of Palm
Beach County.

• Carman Vare: There aze three sites generally dominated by mangroves within Highland
Beach. The southern most site belongs to Ocean Cove and currently has a wave break
along the mangrove fringe as part of the on-site mitigation for the Ocean Cove
Development. Jeff Norman, the developer of the site is interested in giving the site to the
County for long-teen management. The County is interested in acquiring this mangrove
site and is willing to perform maintenance provided that Mr. Norman gives the County
funds to accomplish this. The central mangrove site is mitigation for the adjacent
development to the north. Again, the County could manage these mangroves but would
require funding to do so. This shoreline would likely require permitting and funding to
construct. The northern mangrove site, where the St. Lucy Church is located, has
multiple land owners including the County, St. Lucy Church, Casuarina and the
Coronado Condo to the north. These mangroves also are eroding due to boat wakes and
will require a rock breakwater. Since this project contains aCounty-owned pazcel, we
are in a better position to promote getting the necessary permits to go forwazd with
constructing the wave break system. The mangrove ditches adjacent to Casuarina where
we removed some exotics and fallen limbs continue to flush well. By the end of the year,
my staff should have the opportunity to put together a permit application for constructing
the wave break for the northern mangrove site. This is contingent on getting in-house
approval to go forwazd.
Member Sventrun -Three sites not included in this northern mangrove site aze behind
Villa Costa, the Azure undeveloped site and the area behind Seagate. The mangroves are
• deteriorating because of the boat waves. The large waves aze deteriorating the
mangroves.
Member Weiss -The County has been working on this one project for over seven yeazs.
They were not interested in the project until they realized that the County owned some of
the property. They initially started cleaning it up, but cannot remove any living trees.
Each owner of the three properties that you refer to is responsible for cleaning up their
own mangroves. The owners of the mangroves have to turn the property over to the
County and supply funds to maintain it. Due to the economy, any additional projects will
be in the future.
Town Manager Su eg rman -The process is: privately owned mangroves need a permit
prior to the owner doing any work on them. The County will not go on private property
to clean up mangroves. Each property or condo owner needs to clean their own property.
They can be cut down or cut back with a permit. The standazds aze set by the Department
of Environmental Protection. The application has to be reviewed by both the DEP and
the South Florida Water Management District.

• A) Municipal Tax District:
Member Samuels - My responsibility was to have located communities in the area
that have MSTU's. Boca Raton has a tax district -but not a MSTU. At one time
they had a MSTU but it was for Sugar Leaf Park. Hillsboro Beach has an Inlet Tax
District. Deerfield Beach has a tax district in the works for a community
development district. Ocean Ridge does not have a MSTU.
Recently had a conversation with Paul David of Palm Beach County who gave me a
name of an economist who works at FAU -Paul Fiskind. Did not contact him as
Chairman Miller is handling contacting economists. The actual cost of the economist
will be determined once we get proposals. We also have to make a recommendation
on who would be the Board for the MSTU. Previously in Boca Raton it was the Town
Commission.
Town Mana eg r Su eg rman stated that this type of project could be done within the
Town Budget, but the Town cannot go on to the beach without authorization from
every single property owner. This is not an issue of money, but access to the beach.
If the district is formed, you would have to have public hearings for the approval of a
budget. I contacted Florida State University who also gave me the name of Paul
Fiskind. I have requested a proposal from him, but have not received one to date. An
• estimate of costs would be: Economist - $10/15,000; associated paper work and
election $20,000 for a estimated total of $35,000.

Member Svenstrup - No report.
Member Hofstadter -The slowing down of the large boats is a big concern of all the
residents in Boca Highlands. Have spent a fortune repairing the sea wall. Even
though all our beaches are private, we will not get any place unless Boca is also
interested in a no wake zone. Member Svenstrup - We do not have a marine
patrol associated with our police department. Consequently, neither Boca Raton
nor Delray Beach are interested in patrolling our waters. What is the sense of
having a no wake zone if there is no one to enforce it? Florida Fish and Wildlife
is not interested in property damage, only human lives. The problem is the large
cabin cruisers and their four foot wakes.
