2008.03.11_BSAB_Minutes_Regular PUBLIC NOTICE TOWN OF HIGHLAND BEACH • BEACHES & SHORES ADVISORY BOARD REGULAR MEETING Tuesday, March 11, 2008 9:30 A.M. Chair Lucy Miller called the regular meeting to order at 9:30 a.m. In attendance were Vice Chair Martha Pando, Betty Jane Hofstadter, Ruth Samuels, Gary Guertin and Beverly Knight. Evelyn Weiss was absent. Upon MOTION by Chair Lucy Miller and Mr. Guertin, the following sets of minutes were unanimously approved with corrections to the February 12, 2008 and the February 26, 2008 minutes. December 11, 2007 -Regular Meeting January 7, 2008 -Workshop January 15, 2008 -Regular Meeting February 5, 2008 -Workshop February 12, 2008 -Regular Meeting February 26, 2008 -Workshop • NEW BUSINESS MOTION was made to approve recommendations and adopt codes for keeping the beaches clean. These recommendations will be presented to the Commission as part of a presentation with written narrative in advance with a Clean Beaches Campaign. Per Dale Sugerman notification would take 35-60 days notice before a daily fine can occur. Will this infringe on private property owners? Can these goals be met via enforcement or some other method? Some questions that the Beaches & Shores Board have are who's responsible for State Laws here in Highland Beach? Any officer of State Law or any local police officer. Litter and Trash -What does the property owner do if they see someone litter? A police officer or a code enforcement officer must witness someone littering to hand out a notice. The Beaches & Shores Board will get 2 quotes from beach cleaning services. If the Town supports this endeavor this would be a line item. Taxing District means everyone would have to participate and a Taxing district would be elected. One option would be to hire an economist analysis to see what the benefits would be to the property owner. With suggested modifications in green and underlined, it would read as follows: (1) Lumber, junk, trash, glass, aluminum, cigarettes or debris. In our March 11 Board meeting we aim to finalize our recommendations to the Town Commission about modifications to beach-related town ordinances. Hopefully you can attend at least a portion of the meeting to, once again, assist us with your sage guidance. Some of the points that have come up for discussion: 1) Mechanics towards final approval of ordinances by Town Commission Including x-references to County and State codes) 2) Enforcement of those ordinances What can be expected today with existing man-power and conditions? • How can we be more effective about it? Impact on the Town if stricter enforcement is recommended (Example: additional manpower) 3) Highland Beach jurisdiction regarding dumping of debris in "inland Waterways Canal, or other part of the waterfront" (Sec 5-9 b}? Enforceability of an ordinance that bans it? 4) Sec 5-9 Littering (c) Private beaches. Reduction of time that debris is allowed to remain.
