Februar~12, 2008 930 a m Chair Lucy Miller called the regular meeting to order at 9:30 a.m. In attendance were, Vice Chair Martha Pando, Betty Jane Hofstadter, Evelyn Weiss, Gary Guertin and Beverly Knight. Ruth Samuels was absent. PRESENTATIONS Carmen Vare -Supervisor of marine division - gave a report on the mangrove project, in attendance was George Banet to photograph the mangroves. Phase I -survey the work, looked at the flushing and recognized a need to increase flushing and opened up a big area around the shoreline. The mangroves are receding on either side of the shoreline. Phase II - Ready to apply for a permit to build a boardwalk approximately 400' long at St. Lucy's Church. Soirie of.the questions that were brought up in the meeting were Define the areas of responsibility? What kind of lease agreement could we get into? • Whose liability would it become since its county property? Security /Possibility of a locked gate? It was suggested to perhaps get other private owners involved in the mangrove project. The Beaches & Shores Board wants to know if the town can get on the beach study. Mr. Guertin recommended putting together a proposal to present to the Commission. OLD BUSINESS MOTION was made to have a Beaches & Shores workshop to discuss updating ordinances. This tour will provide stakeholders an opportunity to view a similar restoration effort in Lake Worth Lagoon and to learn about the South Cove project Highland Beach Manerove Enhancement: Staff recently completed a project in Highland Beach that included the removal of exotic vegetation abng the edge of a mangrove area as well as the removal of debris from the mangrove ditches to enhance flushing. A planned boardwalk is underway that would be constructed through a main mangrove ditch to gain access to the ICW. Tohn Prince Park/Chain of Lakes Restoration: Two box culverts are under construction at the John Prince Park / Chain of bakes Restoration project The largest culvert is 20' in diameter and is located at the entrance to the John Prince Park Campground. This culvert will give canoeists and kayakers access to the Custard Apple Slough arm which will be restored to previous wetland conditions and planted with a wide variety of wetland vegetation The campground culvert chamiel ids to an existing pond in the West Custard Apple Slough and makes a loop around a restored nine acre island through remnant wetlands. Completion for the 20' culvert is anticipated to be Thanksgiving 2007. Construction of the 10' box culvert will take 60 calendar days to complete. This box culvert will give canoeists access to the middle lobe of Lake Osborne from Square Lake, through the Lr14 canal, along campground road and into the Custard Apple Slough. Canoeists will be able to enjoy the beauty of nature and wildlife on a scenic loop through rim remauung restored remnants of a vital wetland community. Lake Worth Ia~oon Partnershiv Grant Pr The LWLPGP Selection Committee convened on August 29th fio allocate $3.5 million in State funds to Projects that benefit habitat and water quality. The following projects were recommended to be funded: (1) Riviera Beach Maritime Academy Artificial ReeF $20,000; (2) Boynton Beach SE Federal Hwy Corridor Stormwater Improvements: $750.000; (3) PBCERM John's Island Oyster Reef Enhancement $265,000; (4) PBCERM South Cove Restoration: $600,000; (5) PBCERM Ibis Restoration: $,300,000; and (6) Westgate/Belvedere Homes CRA: $1,00,383. The remainder of ,the funding will be utilized for monitoring and grant administration Sea Turtle Nesting Update: Heavy swells generated by the early Cactober nofeaster eroded approximately 5X of the overall sea turtle nesting for the 2007 season Unfortunately, this represents approximately 20X of the green nesting for the season; less than 3% of the total loggerhead nesting was effected and no leatherback nests were eroded. Sea turtle nesting season ends on October 31~. Soim-1 CovE ARrtsT's RENDrr[onr • FLORIDA'S GOVERNMENT IN THE SUNSHINE LAW • The "Sunshine Law" was created to provide a right of access for citizens to the governmental proceedings of state and local government. • There are 3 basic requirements of the law: * All meetings of the Commission must be o en to the public. * Reasonable notice for those meetings must be given. - q~ ~ * Minutes of those meetings must be taken. • The Sunshine Law is governed both by State Statute and the Florida Constitution. • It provides the people who are affected and impacted by the decisions of local government, the opportunity to see and hear those decisions being made. • Typical questions asked about the Sunshine Law: May I speak with fellow elected officials at social gatherings? YES. You may speak with your colleagues about anything that you want, as long as it is not about Town business, or is a sub ject that could become Town business. Basketball, grandchildren, the stock market are all subjects that you may speak about with your colleagues. Anything pertaining to Town business has to be done at a meeting, that has been properly noticed, where minutes are being taken. (See the 3 basic requirements outlined above). May I lean over to one of my colleagues on the dais and whisper a suggestion to him/her? NO. The Sunshine Law prohibits what are called inaudible discussions. This is because whispering cannot be heard by the public at a meeting. All matters pertaining to public business must be conducted at a public meeting where the public can see and hear the business that is being conducted. . May I call one of my colleagues on the telephone to talk with themo YES, you may speak with them about anything that you would talk about at the social gathering mentioned above, but you may not talk about Town business or any subject that mix become Town business. If I share my thoughts in writing ~ th my colleagues are those written materials subject to the Sunshine Law? NO. Items that you provide to other members of the Town Commission are not subject to the Sunshine Law. However, they are subject to the Public Records Law and those written materials must be preserved under the Public Records Law. Does the public have a right to speak at public meetings YES and NO. The courts have held that the Sunshine Law was enacted to allow the public the ability to see and hear the governmental process, • and therefore, there is generally no right for the public to s eak at a public meeting, but for one very broad exception. During quasi- judicial hearings on local government land use matters, the courts have held that the public should be given an opportunity to "express its views" in the "marketplace of ideas" on decisions that affect the public. While there is not an obligation to give the public the opportunity to speak at Town meetings (other than quasi-judicial hearings), most communities encourage the public's input. The ability to provide "public comment" is usually established by a local set of rules and regulations. Are there penalties for violating the Sunshine Law? YES! Any member of the Town Commission who knowing/y violates the Sunshine Law is guilty of a misdemeanor of the second degree. A person convicted of a second degree misdemeanor may be sentenced to a term of imprisonment not to exceed 60 days and/or fined up to $500.00 YOU COULD GO TO JAIL AND BE REMOVED FROM OFFICE FOR VIOLATING THE SUNSHINE LAW
