TOWN OF ffiGHLAND BEACH BEACHES & SHORES ADVISORY BOARD WORKSHOP MEETING MINUTES Tuesday, February 5, 2008 9:30 a.m. Chair Lucy Miller called the workshop meeting to order at 9:30 a.m. In attendance were, Vice Chair Martha Pando, Betty Jane Hofstadter, Evelyn Weiss, Ruth Samuels, Gary Guertin and Beverly Knight. OLD BUSINESS Litter Letters - l O litter letters have been received out of 15 letters that were sent. These receptacles would be placed every 1/8 of a mile. The Board will ask the town to purchase 12 more receptacles instead of 15. The Beaches & Shores Board will inquire if Delray Beach has a trash ordinance and how do they enforce it? Commission Meeting on 2/13/08 regarding Milani Park, Commissioner Mary McCarty will be in . attendance. Beach Cleanliness Changes -Correct the existing ordinances. It was brought up by the Board to inquire if Board members get paid for workshops, the Town Clerk is checking into this matter. Underlined are the additions/changes I suggest in this first draft. Sec. 5-9 Littering (a)(Definitions. The following words, terms and phrases, when used in this section shall have the meaning ascribed to them in this subsection, except when the context clearly indicates a different meaning. Beaches means that area abutting the Atlantic Ocean consisting of predominately sand whether below or above the mean high mark and including Dunes and all ve etation. (b)Prohibited No person shall leave or deposit any trash, refuse or debris on any Beach. Any such trash, refuse or debris shall be placed in the litter containers provided by the town that are clearly marked by the town for such purpose • ©Private beaches. In regard to that portion of the beach determined to be Private property no person shall place or deposit on any such beach any trash refuse or debris. Further, the owner of the private property shall not allow trash, refuse or debris to remain on his property but must be placed in a litter receptacle of their own or use a receptacle provided by the town. The town will notify the beachfront owner of a removal charge if left for more than (~ three working days. (d) Violation. Any private/beachfront property owner found to be in violation of this section shall be subject to the jurisdiction of the town's code enforcement ordinances and subject to penalties prescribed by the code enforcement board for each day a violation is determined to exist. In addition, a town beach patrol person shall tae and advise the beachfront owner of the towns' ordinances and their violation charges. (e) Cleanliness. Requirements The requirement for private/beachfront proper owners is to clean their beachfront mechanically/manually at least (3) three times weekly weather permitting). In addition, a beach patrol person shall tag and advise the beachfront owner of the town's ordinances and their violation char eg s as per sec.5-9 (d). Sec. 5-10 Beach rakers All beach rakers are to place identification and phone numbers on their tractors. All beach rakers are to be registered with the town. Professional beach rakers shall employ the option of hand raking around turtle nests to protect hatchlings_ • 1/15/2008 Page 2 of 2 • Report regarding how other towns/cities requires beach cleanliness. Delray Beach as per a telephone conversation on January 10, 2008 with Supertentant Bob Taylor, Phone#2437352. He suggested that a beach patrol person for two (2) days a week on Wednesday and Saturday would be sufficient. 1. There aren't any regulations for the two miles from Beach street north. a. 50 percent of those residents clean their beaches by Universal Beach Service b. There are no complaints from residents regarding dirty beaches. 2. The city has a line item for beach cleaning from Seagate to Beach Street (one mile) and the Atlantic Dune Park with Universal Beach Service. 3. There are numerous community events such as: a. Clean the Beach Week b.Sandaway House Clean -up c. Coastal Group To date I am waiting for info from Boca Raton and will forward asap. FURTHER PROVIDED, HOWEVER, THAT NOTWITHSTANDING THE FOREGOING AUTOMATIC RENEWAL PROVISIONS THE OWNER SHALL HAVE THE RIGHT TO TERMINATE THIS AGREEMENT EFFECTIVE UPON THE EXPIRATION OF THE THEN CURRENT TERM BY PROVIDING UNIVERSAL WITH WRITTEN NOTICE OF THE OWNER'S ELECTION TO TERMINATE THIS AGREEMENT AT LEAST THIRTY (3O) DAYS PRIOR TO THE EXPIRATION OF THE THEN CURRENT TERM. 3. COMPENSATION. IN CONSIDERATION FOR UNIVERSAL'S PROVIDING THE SERVICES FIEREINABOVE DESCRIBED, THE OWNER AGREES TO PAY UNIVERSAL A "BASE COMPENSATION" AT THE RATE OF ~ ~Z'~ PER LINEAL FOOT OF OCEAN FRONTAGE PER • ANNUM, FOR A TOTAL BASE COMPENSATION FOR THE TERM OF THIS AGREEMENT OF 7~2~a~w THE BASE COMPENSATION SHALL BE SUBJECT TO UNIVERSAL'S PERFORMING OwJEf'E~~ferr~l SI}e ( J,^C'a ) BEACH CLEANUPS PER YEAR. THE COMPENSATION SHALL BE PAID BY THE OWNER TO UNIVERSAL ON A MONTHLY BASIS IN THE AMOUNT OF ~ ~pOO=` WITHIN TEN (I O) DAYS FOLLOWING THE END OF EACH MONTH DURING THE TERM OF THIS AGREEMENT. IN THE EVENT OF HURRICANES, TROPICAL STORMS OR HEAVY OIL ACCUMULATIONS AND WITH PRIOR CONSENT OF THE OWNER, AN ADDITIONAL CHARGE MAY BE NEGOTIATED BY UNIVERSAL DEPENDING UPON THE CONDITION OF THE BEACH AND THE TIME AND EQUIPMENT NECESSARY TO COMPLETE THE CLEANING. 4. ACCESS. THE OWNER AGREES TO PROVIDE UNIVERSAL WITH FREE AND FULL ACCESS TO THE BEACH PROPERTY WHICH IS THE SUBJECT OF THIS AGREEMENT AND NOT TO INTERFERE WITH THE PERFORMANCE OF THE SERVICES HEREIN CONTRACTED FOR. • 5. ATTORNEY'S FEES. IN THE EVENT SUIT IS BROUGHT BY EITHER PARTY 4 • RELATIVE TO THIS AGREEMENT, THE PREVAILING PARTY SHALL BE ENTITLED TO COLLECT ALL REASONABLE COSTS AND EXPENSES OF SUIT, INCLUDING, BUT NOT LIMITED TO, REASONABLE ATTORNEY'S FEES. 6. LIABILfTY INSURANCE. UNIVERSAL, DURING THE TERM OF THIS AGREEMENT, AGREES TO AT ALL TIMES MAINTAIN PUBLIC LIABILITY INSURANCE RELATIVE TO ITS BUSINESS OPERATIONS WITH LIMITS OF NOT LESS THAN ONE MILLION INDlViDUAL,/ONE MILLION AGGREGATE COVERAGE. UNIVERSAL FURTHER AGREES TO INDEMNIFY, SAVE AND HOLD THE OWNER HARMLESS FROM ANY AND ALL DAMAGES TO THIRD PARTIES RESULTING FROM UNIVERSAL'S NEGLIGENT PERFORMANCE OF THE SERVICES HEREUNDER. 6A. WORKERS COMPENSATION. UNIVERSAL SHALL PROVIDE WORKERS COMPENSATION INSURANCE AND SHALL SHOW PROOF OF THIS FACT TO THE OWNER. 7. CONDUCT AND STANDARDS. UNIVERSAL ACKNOWLEDGES THAT THE • OWNER'S PROPERTY IS AN EXCLUSIVE, FIRST CLASS RESORT. THE CONDUCT OF UNIVERSAL AND ITS EMPLOYEES SHALL BE OF THE STANDARD WHICH THE OWNER REQUIRES OF ITS OWN EMPLOYEES AND MANAGEMENT. 8. TERMINATION. THIS AGREEMENT MAY BE TERMINATED BY THE OWNER UPON THE OCCURRENCE OF ANY OF THE FOLLOWING: A. THE FILING FOR BANKRUPTCY BY UNIVERSAL. B. UNIVERSAL'S FAILURE TO PERFORM ITS DUTIES REQUIRED PURSUANT TO THIS CONTRACT; PROVIDED, HOWEVER, THAT UNIVERSAL SHALL BE ENTITLED TO JUDICIAL REVIEW OF SUCH DECISION. 9. ASSIGNABILfTY.
