September 11, 2007 9.30 A M Chair Lucy Miller called the meeting to order at 9:30 a.m. In attendance were Vice Chair Martha Pando, Betty Jane Hofstadter, Evelyn Weiss, Ruth Samuels, Gary Guertin, and Beverly Knight. APPROVAL OF MINUTES Upon MOTION by Chair Lucy Miller and Mr. Guertin, the following sets of minutes were unanimously approved, 9/12/06 -Regular Meeting • 11/14/06 -Regular Meeting 11/28/07 -Regular Meeting 1/9/07 -Regular Meeting • 1/23/07 -Workshop Meeting 2/13/07 -Regular Meeting 2/27107 -Regular Meeting 3/13/07 -Regular Meeting 3/27/07 -Workshop Meeting 4/10/07 -Regular Meeting NEW /OLD BUSINESS There was a lengthy discussion re the draft letter to the Commission as well as how we would present this presentation to the Commission. Upon MOTION by Mr. Guertin /Mrs. Weiss the final draft letter to the commission was approved. MOTION carried unanimously. PUBIC COMMENTS Dale Sugerman -Town Manager spoke to the Board about the deadline. To get the presentation to the Commission for the September 25, 2007 Commission meeting the Agenda deadline will be September 12, 2007 at 12:00 p.m. • :~ • Beaches & Shores Advisory Board Page 2 of 2 9/11/07 Bill Moore spoke re trash receptacles, no cans have been ordered at this time. We currently have 9 trash receptacles on the beach; the town empties these 3 times a week. Ruth Samuels will ride with Bill Moore along the beach and see where to place the additional trash cans. Possibly have the Town of Highland Beach logo placed on these trash receptacles. Bill Moore will need a listing of where to place these trash cans with authorization from the homeowners to place them on their property. Ruth Samuels will take over the trash can responsibility. Per Stan, Beaches 8~ Shores Advisory Board does not have a budget. I have been told by Stan and Dale Sugerman that I can run the copies you need as well as bind them in our binding machine and make the color copies as well. Otherwise, the Kinko's cost etc would come ftom your own pockets. So, if there is anything I could help you do ftom this end to keep the cost down I will be happy to do so. Bev, you and David were going to work together on the pictures and getting the booklet together with a final draft of booklet being shown at the Oct 9~' meeting or the Oct. 16~' workshop correct? Please let me know if this something you want to do. The turtle pictures would just be a color copy on paper, not sure how you all feel about that? I had originally checked out the prices for the printing of the photos (or blow ups) and no one thought it was going to be effective, and was going to cost too much. But now that you have researched the equipment and the need for transparencies (the oki-fashioned way), we need to re-visit this, or figure out a way to still do the PowerPoint (Martha, any suggestions?). Digiplot in Boca off Dixie (347-1005), can blow up a digital file any size up to 11 x 14 for $5 per color photo. It would be costly to transfer digital photos to transparencies and not a very powerful presentation. I am looking into what I need to make a power point presentation. But that might be overkill for a ten minute show. I like the idea of material that can be permanent and dispersed without the need for technology. Rather than a packet, how about making nice booklets at Kinkos that the commissioners can keep and also be passed around. Of course, there would be some cost. Is there a budget to do this? This was a nest that nature covered with a lot of sand 8~ debris after the mom layed the nest back on June 18th in front of 4117 (Tulin residence). Yesterday we saw only 2 turtle trax and when we dug down, we couldn't find the nest. Today, after more babies got out, we dug again and this time there was a huge piece of fiberboard buried there way down from when Hurricane Wilma took roofs apart two years ago. I remember seeing that stuff around Boxwood's destruction, all over the beach! Well, it created a shelf, stopping all these turtles from getting out (see pixy. 63 total would have died. There were 90 empty (hatched) shells so we know that 27 turtlers got out OK on their own. And there were 6 unhatched eggs that we reburied. Lucky we found them. Neat, huh? Highland Beach, in Zone Two, had the only Hawksbill hatching in the entire State of Florida. It has been documented and recorded. Here are a couple of photos. There were only 5 last year in the entire state. I took a "Hawksbill Birthing Video" and as soon as I can get if down in megabyte size (it's 51 mb), I'll email that, too. Hawksbills look similar to Loggerheads, so it is important to note that they have 4 "scutes" instead of five scutes down the side of their shells. Scutes are the little square-like designs on the bads of their shells. And Hawks are "chocolate" in color, top 8 bottom. Please print out copies of this evidence of the danger of beach garbage on the turtle population. Ask Barbara James to send a copy of this to Megan as evidence of interference with turtle nesting. Copies of this and all other evidentiary material needs to be compiled for presentation to the Commissioners with our request for beach standards. I agree that asking the turtle volunteers to gather pictures of anything that is intertering with the turtles nesting or hatching is desirable so we can compile the information to present to the Commissioners. She was not ony wedged in, but her right flipper was also wrapped around the rectangular chair leg, into her armpit. It is the type of chair where the legs are continuous and go all the way around and she went right into this metal circle. It was awful. And she may have been there all night trying to get out, as she was exhausted. She had already finished her nest underneath the stairs. They can't survive in full sun and she would have died, or would have tried to take the chair with her into the ocean and she would drown. We almost called Dr. Kirt at Gumbo Limbo. But... Our Zone 2 turtle crew (Amy, Suze, Bill 8~ I, and Coty, our dog) worked our butts off to get her out before the hot sun came up. And after awhile we did it! And once free, she turned on a dime and hi-tailed it to the ocean. We didn't think she could go that fast, but she took off, flippers flapping, due east. We could hardly keep up with her to get these pictures. • I've also attached a picture of a baby Green so you can see how tiny they start out, in comparison to how big they get! Whenever a beach area starts to erode, local politicians just throw sand - or a pitiful,. muddy excuse - at the prob- letn, hoping that it will go away. The problem is that each time ' they do that, they are throwing away taxpayers' money in the ocean while they destroy valu- able public trust resources such as reefs and surfuig areas. Right now, even though the. beach sn'tcritically~roded, the town of Palm Beach is seeking a permit froth. the U S. Army Corps of Engineers for what local surfers, anglers and divers have dubbed the "Reach 8 Dredge and Dill Project." Con- tractors hired by the town would dredge and fill the entire shore- line from approximately the par- 3 golf course in Palm Beach to about one-third of a mile south of `the Lake Worth Pier. Have we not learned from our past experiments with this. practice in Southeast Florida? Are we going to strip-thine the continental shelf of every grain of sediment vaguely resembling sand, no matter how close it lies to a coral reef, until it is all exhausted? These projects per- form so poorly that they require frequent maintenance, despite rapidly if not totally diminish- ing sand resources left on the continental. shelf - There's asimple reasonwhy .they perform so poorly Thee material is much lighter and of a different shape and dear sity than natural beach sand. The dredging silts over coral reefs next to the "borrow areas" (read. dredge sites), and` then the silt from the material. used in these projects smothers the nearshore hardbottom. SMITH, chairwoman, Palm Beach County Chapter of Surfrider Foundation .Ocean Ridge • STANDARDS FOR BEACH CLEANLINESS AND MAINTENANCE The Beaches and Shores Advisory Board wishes to bring to the attention of the Town Commission the concern of the citizens of the Town regarding the cleanliness and conditions of the beach. The members of this advisory board have received more complaints about this subject than any other. To date there are over 400 "Clean Beaches for Highland Beach" petition signatures from private home owners, condo owners, turtle volunteers etc. during the months of June, July, and August. Many citizens will be returning to our Town in October and November and we estimate at least a considerably higher number that will sign. Hundreds of residents want the beaches clean. New owners have expressed their dissatisfaction with having purchased an expensive residence in a town that does not consider beach cleanliness of vital importance. Realtors have complained to us of having lost sales as a result of the poorly maintained condition of the beach. Probably our most important group of citizens who are concerned about the cleanliness of our beaches are the Turtle Volunteers. These 25 or so volunteers who daily work our beaches from March through October can testify to the poor conditions they encounter such as broken glass, metal pipes, splintered wood and hypodermic needles which are revealed; often scraping the hands of our volunteers as they go about the task of excavating sea turtle nests. They report weekly how dangerous it has become for them as well as the hatchlings while excavating turtle nests. To date we rely on property owners from private homes to large condos and Palm Beach County to clean and maintain our beaches on a daily basis. The Town of Highland Beach defines beach cleanliness as follows. Sec. 5-4 Rules regulations for use of beaches: (4) No person shall place or deposit on the beach any loose paper or other trash or refuse but shall d~osit same in receptacles. Page 1 • Sec. 5-6 Unlawful deposit of glass, crockery etc: It shall be unlawful for andperson to throw, cast, la~posit a glass bottle or piece of crockery or any lag ss or glassware, or an~part thereof on any beach, whether the ocean beach or Inland Waterways Canal, or other part of the waterfront. Sec. 5-9 Littering: (a.) Definitions. The following words, terms and phrases, when used in this section shall have the meanings ascribed to them in this subsection, except where the context clearly indicates a different meaning: Beaches means that area abutting the Atlantic Ocean consisting of predominantly sand, whether below or above the mean high water mark. (b.) Prohibited. No person shall leave or deposit any trash, refuse or debris on any Beach. Any such trash, refuse or debris shall be placed, when available in a container clearly marked by the town for such purpose. If there is no receptacle, or if the receptacle is full, all trash or refuse must be removed from the beach. ~ (c.) Private beaches. In regard to that portion of the beach determined to be • Private property no person shall place or deposit on any such beach and refuse or debris. Further, the owner of the private property shall not allow trash, refuse or debris to remain on his property for a period of time rg eater than seven (7) days after notification by the town. Any such trash, refuse or debris located upon private beachfront property shall be properlyposed of in a manner otherwise provided by the codes and regulations of the town. (d.) Violation. AnYprivate property owner found to be in violation of this section Shall be subject to the jurisdiction of the town's code enforcement ordinance, and subject to penalties- prescribed by the code enforcement board for each day a violation is determined to exist. The ordinances specifically refer to beach cleanliness, but the town's "Nuisances" ordinance (Chapter 17) is the overall ordinance in which town cleanliness is defined and enforced. Page 2 w_ t An informal survey of beachfront properties conducted by the Beaches and Shores Advisory Board in January 2007 showed that beach clean-up methods, and frequency of cleaning are at best inconsistent and at worst non-existent. Our investigation into the possibility of enforcement of cleanliness codes was disappointing. It is well known that three (3) beach cleaning companies work our beaches and that the methods of cleaning, use of equipment, etc. is inconsistent between the three, giving different results from the standpoint of cleanliness and beach preservation. The Beaches and Shores Advisory Board believes the current situation should not continue. We request your approval to proceed with a 4 part action plan toward "cleaning up" our beaches: 1. While some of the current (old) ordinances should be maintained, they should be expanded upon and strengthened to include more specific standards. 2. Cleaning of beaches should be studied from a "town" perspective rather than a "Private owner perspective". 3. Professional beach cleaning services standards need to be tightened to include ~ ~ more consistent methods of cleaning. 4. Enforcement of whatever direction is taken needs to be determined.
