Chair Lucy Miller called the meeting to order at 9:30 a.m. In attendance were Martha
Pando, Betty Jane Hofstader, Evelyn Weiss, Ruth Samuels, Gary Guertin and members of
the public.

Upon MOTION by Mrs. Miller /Mrs. Weiss, the following sets of minutes were
approved.

NEW BUSINESS
Interview of Candidates, the Board interviewed Beverly Knight, David Spodak, Rachel
Scala-Pistone and Judi Asselta for the open seat, applications attached hereto. MOTION
• was made to select Beverly Knight for the open seat on the Beaches & Shores Advisory
Board. The Beaches & Shores Advisory Board will present their selection to the
Commission at the next Town Commission meeting on August 7, 2007
Results for the selection of the Beaches & Shores open seat are as follows:
1. Beverly Knight

3. Rachel Scala -Pistone
4. Judi Asselta
The Following issues were discussed:
- Town Manager Dale Superman spoke re: Codes on selection of a Board member.
The Board is a recommending body Commission has final say in the selection of a
Board member. Dale Superman also suggests that the ordinance be rewritten, what
equals a clean beach as a standard, how often the beaches are cleaned, how will the
stricter standards be maintained and enforced?
- Enforce Rules & Regulations for the beach.
- Get Commission to agree what the standards are for the beach. It is vital for the
beaches to be cleaned and maintained.
- How often should property owners clean their beaches and what are we going to do
to enforce these standards?
- Dune restoration

PUBLIC COMMENTS
John Parro - It is important that the Commission understand what our beaches mean to
us.
Simon Calle - If you leave the cleaning of the beaches to the property owners, they will
not follow through with the cleaning of the beaches.
Judi Asselta - We must have a detailed list of regulations and what is included in a beach
cleaning contract.
Rachel Scala- Pistone -Report on Milani Park, suggestion to use park as an educational
park as opposed to a beach. The police should not be used as a crossing guard to get to
and from the beach.

The next meeting will beheld on July 18, 2007 at 9:00 a.m. -Workshop

Attached you will find my application for review and consideration for the Beaches & Shores
Board vacancy.
Since I have been self-employed for many years, {have not attached a "resume". However,
I have attached a small part of my real estate presentation that introduces me to potential
clients, that may be helpful to you and the commission regarding my background.
With politics aside, I'd like to believe that the Board and the Commission can make the best
decision for the community of Highland Beach, for the betterment and preservation of our
beautiful sea shore. After all, it is our greatest asset, and it is certainly number one in my

When growing up in the Maryland suburbs of Washington D.C., my
parents couldn't drive pass a "model row" of new homes without my
relentless insistence to stop and tour them. Oh, the excitement! The
cleverly-designed furnishings, the manicured lawns, flowers and trees,
the active on-site sales office with the little model neighborhood under
glass. When most girls were collecting Barbie Dolls, I had a collection

Well, some things never change...

Timing is Everything,
Bev successfully completed college, with honors, in 1977 by way of
Pittsburgh, and with a B.S. in Advertising & Design, set up shop in Fort
Lauderdale, managing her own design firm "Aluise Design" (Bev's
maiden name). Well, timing is everything, isn't it? It was the height of
the real estate boom! Brand new developments, extravagant gated
country clubs, the new "Just-bring-your-toothbrush" era of "turn-key"
furnished waterfront mansions of the 80's. What fun! So, for the next
20 years, Aluise Design designed and produced local, national and
international award-wining marketing materials, brochures, floor plans,
clever advertising campaigns and on-site sales offices, for the growing
number of distinguished clients and firms involved the industry from
Miami to Palm Beach, where she honed her business, design and
people skills.
Bev's many clients were the innovative builders and developers of
"brand neW' high-end country clubs and waterfront communities in
the "go-go-80's" including The Sanctuary, St. Andrews Country Club,
Polo Club of Boca Raton, Boca West, Boca Grove Plantation, Admiral's
Cove, Seasons, The Colonnades, Frenchman's Creek and Jonathan's
Landing. And many of her original clients are still building today,
Addison Development, The Siegel Group and Tradewinds Development.
A Smooth Transition for a Second Career.
For the new millennium, after leaving the design world in 1999, Bev
returned to her passion of sales and marketing, of another kind. This
time, she decided to sit on the other side of the table, to assume the
responsibilities of a Licensed Real Estate Professional. Still excited by
fine architecture, interiors, and luxury properties, and wanting to share
the enthusiasm with buyers and sellers, it was a natural transition.

No boat shall be parked upon land visible from any public road within the town unless sheltered
from view or placed in an enclosed garage, except for the express purpose of loading and unloading
such boat.

Sec. 5-4. Rules, regulations for use of beaches.
(a) All persons using the beaches within the town shall comply with and abide by the following
rules and regulations:
(1) No person shall dress or undress on the beach except in taking off or putting on
dressing robes and shoes.
(2) No person shall dress or act indecently or be attired in indecent apparel.
(3) No person shall use loud, boisterous or profane language.
• (4) No person shall place or deposit on the beach any loose paper or other trash or
refuse, but shall deposit same in receptacles.

(5) No motor vehicle shall be driven upon the beaches without the previous written
consent of the town commission.
• (b) The violation of any of these rules and regulations shall constitute an offense against this
Code.

Sec. 5-5. Removal of sand, earth from beach.
It shall be unlawful for any person to take or remove from the ocean beach within the limits of
the town any sand or earth.

Sec. 5-6. Unlawful deposit of glass, crockery, etc.
It shall be unlawful for any person to throw, cast, lay or deposit a glass bottle or piece of
crockery or any glass or glassware, or any part thereof, on any beach, whether the ocean beach or
Inland Waterways Canal, or other part of the waterfront.

Sec. 5-7. Living aboard boats.
No person shall live aboard a boat within the corporate limits of the town. This prohibition shall
apply whether the boat is located in any waterways or canals or upon land within the corporate limits of
the town.

Sec. 5-8. Anchoring of watercraft in the navigable waters of the town; registration of
watercraft.
(a) No person may anchor any watercraft in the navigable waters within the corporate limits of
the Town of Highland Beach, with the exception of watercraft fastened to shore based docks.
(b) Violations of this section shall be subject to enforcement by the code enforcement board of
the town.

Sec. 5-9. Littering.
(a) Definitions. The following words, terms and phrases, when used in this section, shall have

the meanings ascribed to them in this subsection, except where the context clearly indicates a
different meaning:
• Beaches means that area abutting the Aflantic Ocean consisting of predominantly sand,
whether below or above the mean high water mark.
(b) Prohibited. No person shall leave or deposit any trash, refuse or debris on any beach. Any
such trash, refuse or debris shall be placed, when available, in a container clearly marked by
the town for such purpose. If there is no receptacle, or if the receptacle is full, all trash or refuse
must be removed from the beach.
(c) Private beaches. In regard to that portion of the beach determined to be private property,
no person shall place or deposit on any such beach any trash, refuse or debris. Further, the
owner of the private property shall not allow trash, refuse or debris to remain on his property for
a period of time greater than seven (7) days after notification by the town. Any such trash,
refuse or debris located upon private beachfront property shall be properly disposed of in a
manner otherwise provided by the codes and regulations afthe town.
(d) Violation. Any private property owner found to be in violation of this section shall be subject
to the jurisdiction of the town's code enforcement ordinance, and subject to penalties prescribed
by the code enforcement board for each day a violation is determined to exist.

Sec. 5-10. Beach rakers.
Alt beach rakers are to place identification and phone numbers on their tractors. All beach
rakers are to be registered with the town.

Nuisance means any condition or use of premises or of building exteriors which is detrimental
to the property of others or which causes or tends to cause substantial diminution in the value of other
property in the neighborhood in which such premises are located. This includes, but is not limited to,
the keeping, the maintaining or the depositing on, or the scattering over the premises, of any of the
following:
(1) Lumber, junk, trash or debris;
(2) Abandoned, discarded, unused or stored objects or equipment, whether operative
or inoperative, such as automobiles, boats, trailers, furniture, stoves, refrigerators,
freezers, cans or containers or the like.
This definition does not limit the meaning of nuisance in section 17-3.
Property means any real property within the town which is not a street or highway.

Sec. 17-4. Nuisances on private property.
No person owning, leasing, occupying or having charge of any premises shall maintain or keep
any nuisance thereon, nor shall any such person cause diminution in the value of the other property in
the neighborhood in which such premises are located.

Sec. 17-5. Enforcement.
Enforcement of this chapter may be accomplished by the town in any manner authorized by law.
In addition, any person who by reason of another's violation of any provision of this chapter suffers
special damage to himself different from that suffered by other property owners throughout the town
generally, may bring an action to enjoin or otherwise abate an existing violation.

department. Each day in which any violation occurs or continues shall be deemed a separate and

make further repairs or to maintain the property and does not
create any liability against the local governing body fcrr-art}r-
damages to the property if such repairs were completed in good
faith. If a finding of a violation or a repeat violation has been
made as provided in this part, a hearing shall not be necessary
for issuance of the order imposing the fine. If, after due notice
and hearing, a code enforcement board finds a violation to be
irreparable or irreversible in nature, it may order the violator to
pay a fine as specified in paragraph (Z)(a).
(Z}(a) A fine imposed pursuant to this section shalt not exceed
$250 per day for a first violation and shalt not exceed $500 per
day for a repeat violation, and, in addition, may include alt costs
of repairs pursuant to subsection (1 ). However, if a code
enforcement board finds the violation to be irreparable or
irreversible in nature, it may impose a fine not to exceed $5,000
per violation.
(b} In determining the amount of the fine, if any, the
enforcement board shalt consider the following factors:
1. The gravity of the violation;
2. Any actions taken by the violator to correct the violation; and

BOARD APPOINTI~tEIYT POLICY
The filling of Board vacancies is the exclusive obligation and responsibility of the
Town Commission. It is the policy of the Town Commission of Highland Beach to
appoint qualified candidates to town boards.
When a vacancy occurs and the incumbent is not eligible for reappointment, the
Town Commission will nominate candidate from the Talent Bank who have
indicated a preference for the board in question. The candidates will be asked to
attend the next Regular or Workshop MdCting where they will be interviewed.
Meanwhile, Town Commission members may iattrview any of the candidates
personally and/or consult with the board involved.
When considering a candidate's qualifications, the Town Commission may consider
the following additional factors:
1. Experience
2. Education
• 3. Length of time on the talent bank waiting list
4. Past service to the Town
5. Whether the candidate has a significant amount of time left in a term on
another board
New Candidates
The Town Clerk shall maintain a Talent Bank comprised of those persons who have
indicated a desire to serve as members of a town board. Applications shall have an
active life of one gear, but may be reactivated for one additional year if so desired by
the candidate. Copies of such Talent Bank applications shall be:

Provided to the Chairman of the specific board or boards for which the
applicant has expressed a preference, or
Provided to the Chairmen of all town boards in the event that no preference
has been shown by the applicant

Currently Seated Candidates andlor Members for Reappointment
The Town Clerk shall advise the Town Commission of the a=piration dates and
length of service of members of town boards. Inasmuch as said candidates andlor
members are already known to the Commission through their service, no further
interviews or recommendations shall be necessary or desirable. Absent objection
from any Commissioner or the Board Chairman, board members eligible for
reappointment at -the end of their term may be reappointed (without having to be
interviewed), by majority vote of the Town Commission, provided that the candidate
desires to be reappointed.
Upon formal appointment of any candidate by the Town Commission, each
appointee shall:
1. Be notified in writing by the Town Clerk with a copy of said letter
' being provided to the respective board chairman; and
• 2. Be supplied with a copy of those portions of the Town Code which
delineate the responsibilities and duties of the particular board
membership.

BOARDS AND COMMITTEES
BOARD OF ADJUSTMENT -Hears appeals to decisions of administrative
officers relating to the Zoning Ordinance. Meets quarterly and as needed when a
Petition for Variance is submitted. Membership: 7 Members (3 year term)
CODE ENFORCEMENT BOARD -- Enforces all technical codes in force in the
Town of Highland Beach including, but not limited to, occupational licenses, fire,
building, zoning and sign codes. Meets monthly. Membership: 7 Members
(3 year term)
Fttd-ANCIAL ADVISORY BOARD -Assists the Town Manager and Finance
Department in preparation of budget and reviews matters as requested by the
Town Commission. Meets as needed. Membership= 5 Members (3 year term)
PLANNING BOARD -Recommends to the Town Commission on all matters
involving Town planning including, but not limited to, the Comprehensive Plan,
development plans, site plan reviews and special exception plans. Meets
monthly. Membership: 7 Members (3 year term)
BEACHES ADVISORY BOARD -Addresses beach cleanups, assist sea turtle
program, review ordinances re. beaches and turtles, address appropriate
vegetation on dunes, address violations and citations within confines of the
beach. Makes recommendations to the Town commission, Membership: 7
Members (3 year term)
CULTURAL BOARD -Arranges for local artists, musicians and speakers to
provide cultural enrichment to the residents of Highland Beach. Also arranges
traditional celebrations in honor of national and local holidays. Membership: 7
Members (3 year term)
AD HOC COMMITTEES ~ From time to time the Town Commission appoints Ad
Hoc Committees and/or persons to assist or represent the. Town in various
special matters. These committees are usually short-term appointments
established for specific studies or evaluations.

Board vacancy.
• Since I have been self-employed for many years, I have not attached a "resume". However,
I have attached a small part of my real estate presentation that introduces me to potential

Bev says, "As long ago as I can remember...
When growing up in the Maryland suburbs of Washington D.C., my
parents couldn't drive pass a "model row" of new homes without my
relentless insistence to stop and tour them. Oh, the excitement! The

the active on-site sales office with the little model neighborhood under
glass. When most girls were collecting Barbie Dolls, I had a collection

Timing is Everything,
Bev successfully completed college, with honors, in 1977 by way of
Pittsburgh, and with a B.S. in Advertising & Design, set up shop in Fort
Lauderdale, managing her own design firm "Aluise Design" (Bev's
maiden name). Well, timing is everything, isn't it? It was the height of
the real estate boom! Brand new developments, extravagant gated
country clubs, the new "Just-bring-your-toothbrush" era of "turn-key"
furnished waterfront mansions of the 80's. What fun! So, for the next
20 years, Aluise Design designed and produced local, national and
international award-wining marketing materials, brochures, floor plans,
clever advertising campaigns and on-site sales offices, for the growing
number of distinguished clients and firms involved the industry from
Miami to Palm Beach, where she honed her business, design and
people skills.

Bev's many clients were the innovative builders and developers of
"brand neW' high-end country clubs and waterfront communities in
the "go-go-80's" including The Sanctuary, St. Andrews Country Club,
Polo Club of Boca Raton, Boca West, Boca Grove Plantation, Admiral's
Cove, Seasons, The Colonnades, Frenchman's Creek and Jonathan's
Landing. And many of her original clients are still building today,
Addison Development, The Siegel Group and Tradewinds Development.
A Smooth Transition for a Second Career.
For the new millennium, after leaving the design world in 1999, Bev
returned to her passion of sales and marketing, of another kind. This
time, she decided to sit on the other side of the table, to assume the
responsibilities of a Licensed Real Estate Professional. Still excited by
fine architecture, interiors, and luxury properties, and wanting to share
the enthusiasm with buyers and sellers, it was a natural transition.

Delray Beach fights non-native plant invasion

Seaside cities such as Delray Beach are tackling the same invasive
plant species city planners planted on beaches and coastal property.
The city has focused on scaevola, or Hawaiian seagrape, and
Australian pines and Brazilian pepper.
The eradication of
scaevola and other non-
natives is nearly
complete, save for a
small area at the end of
Atlantic Avenue, which
protects sea turtle
nesting and hatching.
"I don't know what the
solution will be there.
We're doing the entire
beach in a slow,
calculated way, and
that's kind of next on
the list," said coastal
dune biologist Robert
Barron, a consultant
who was the city's
beach superintendent
from 1980 to 1987.
"Delray Beach doesn't
necessarily have a

The city is getting estimates from contractors on the trees it wants to
remove and replace with trees such as coconut and royal palms.
"Brazilian peppers do spread quite rapidly if you don't control them,
and they have the tendency to choke out other vegetation," said Lee,
who wants to have the eradication completed within the fiscal year,
which ends Sept. 30.
Boca Raton is focusing on Australian pines and Brazilian pepper trees
along its beaches as part of the ongoing effort to replace pest plants
with native species.
One project involves removing the Australian pines 40 feet off the
interior roadways at Spanish River Park at a cost of $110,000, said
Keith Noelk, the city's parks superintendent.
"The Australian pine is a pretty brittle tree in hurricanes, and limbs
break off without warning. We have pictures of damage where a limb
just cracked aff and dropped onto a car," said Noelk, who has been
working on eradicating non-native plant species for the city since
1990.

William Wilsher oversees the county's maintenance of natural areas for
Palm Beach County Parks & Recreation. The county is responsible for
the vegetation on beachfront parks, including South Inlet Park in Boca
Raton, Guff Stream Park, the Ocean Ridge hammock and Ocean Inlet
Park in Lake Worth.
"We periodically go through and try to get rid of the true exotics on
the beaches," Wilsher said. "If there is a large-scale exotic invasion,
like an Australian pine area, we keep tabs on it, and when they`re
developing, we try to remove it."
The county completes its eradication and replanting work with a
natural resources crew of seven workers paid by the general operating
budget and headed by Greg Atkinson, parks resources supervisor.
"Our exotic removal is ongoing," Atkinson said. "At Gulf Stream, we
replaced some scaevoia with native sea oats. With the Australian pine,
we try to be as selective as possible, because the trees are providing
shade, and we understand when removing them that nothing naturally
grows that tall in coastal parks."

Depending on the location, Atkinson's crew replaces the Australian
pines with green buttonwood and coconut palms to eventually provide
some kind of protection to beachgoers and picnickers. Closer to the
waterfront, where Australian pines contribute to erosion and are a
nuisance to nesting sea turtles, Atkinson plants native seagrape, also
known as coccoloba uvifera.
"It helps to catch sand with its large leaves and renourish the dunes.
It's a beneficial plant that also provides a food source for migrating
birds," Atkinson said. "The seagrape height helps to shade out any
street lamps and helps protect the turtle that way."
