Mayor Joseph A. Bau1ay called the Regular Meeting (recessed from
January 02, 1991) of the Tawn Commission of the Tawn of Highland
Beach, F1 or•i da, to order i n the Commission Chambers at Tawn Hal 1
at 1:30 F.M. Others present were Vice Mayor Bi11 Paul, Commis-
sioners P4ar•vin A. Waldman, Betty Jean Ste~~~art and Har1old C.
Chambers.

Mayor Bout ay Hated that Dr•. Pat Gleason of ._i. M. Montgomery, the
Town's Engineers, was instructed at the January 02, 1991 Regu1ar•
h9eeting to return to this Recessed Meeting with an amended Status
Report of the Long Term Water Supply Plan which is to be submitted
to the South Florida Water• Management District with regard to the
ToEAin's Irlater• Use Permit. The Towr1 Commission, having received the
.amended report in advance of this Recessed Meeting, Alas unanimous
in its support of said .amended Status Report. COMMISSIONER
STEWART MOVED that the 1etter• submitted by Dr. Gleason, Hydro-
gea1agist far J. M. Mantgomer'y with the attached Status Report of
the Lang Term Water Plan {which was the final submission received,

Vice Mayar• Paul reported that recent single family billing from
the Cable T. V. Company reflected an increase and a call to the
Company resulted in the Cable Company placing full responsibility
an the Torun far said rate increase . The Vice Mayar• suggested the
Town Manager write to the Cable Company to request they explain
the rate increase to the residents rather than b1 amp the Town far
said increase. It was further suggested that i nfar•mati on r•egar•d-
ing this rate increase be included in the next Town Newsletter.

~wommi ssi onpr Chambers r•epar•ted that, with regard to the fire/
rescue situation, the Public "afety Services Acivisary Board met
with Boca and Delray as well as the County. The Commissioner
noted that, following a meeting with Boca's Fire Chief and
Assistant City Manager Witker, it was suggested that the next step
was far the Taarn of Highland Beach to go before the 6oca Council
to request negotiations with Baca staff for• fire/rescue services.
Commissioner Chambers reported that Baca opted not to negotiate.
Camrni ssi anpr Chambers further r•epar•ted that he had a goad mppting
this morning aii th Del ray City P9anager David Harden and Del ray af-
fered to place a 596 annual cap on cost increases, which would
serve the Town of Highland Beach well if initial costs could be
kept under control. The Commissioner advised he ~aauld like to
continue negotiations with Delray Beach for• a contract document
• which would r~equir•e appr•ova1 of bath the Delray Beach and Highland
Beach Commission. It was noted that if Highland Beach is to opt
out of the County Contract, it must be done by Febr•uar•y q1, 1991.

h9ayar Boulay commented that he would want to maintain at least the
same level of service presently enjoyed by the Town Miithaut any
additional cost to the residents, and perhaps, at even ~ lessee
cost. Then it was gUeStlaned if the Delray Staff has the blessing
of their Council to proceed with such negotiations, Commissioner
Chambers indicated that City Manager Harden represented to the
Commissioner that he does have the Council's blessings.
Town Manager Mariano reported that, at this morning's meeting of
the Fublic Safety Services Advisory Board, it was indicated that
the Town Manager had interfered with the Baca negotiations by
meeting with the Baca City Manager prior to the Highland Beach
pr•esentatian before the Boca City Council. Far the record, the
Town Manager advised she did not meet with anyone or discuss this
matter with any Baca City Staff Member.

P9ayor• Bou1ay noted that he commented at a previous Town Commission
Meeting that perhaps the matter of t_he park behind Town Ha11
• should tae placed {in a non-confusing farm} an the March 12, 1991
h9unicipal Election ballot to give all the residents a chance to
vote an the proposed park. The Mayor further Hated that he would
like the ballot referendum to include a price {or cap) on the
amount of money far• said park as wel 1 as hoHr this proposed park i s
to be funded. The Tawn Attorney was instructed to draft a
pr-•eliminary ballot question which would be reviewed at the January
29, 1 991 4dorkshap Meeting { i t 1M1 1 1 be an Agenda item} .
Mayor Bou1ay informed the Town Commission that board of Adjustment
Vice Chairman David Augenstein is recovering nicely fallowing
surgery an Friday, January 11, 1991.
Mayor Baulay invited the Commission Members and residents to join
in the March of Dimes Walk-a--thou which is scheduled to take place
in April, 191.
~_~pan questioning, it was Hated that the bike path improvement bids
mill be opened by the Town's Engineers {Gee & Jenson) an February
15, 1991. The Town will then review all proposals submitted.
REPORT - TOWN ATTO
Town Attorney Sliney reported that the Amendment to the Inter•1oca1
Agreement between Baca Raton and Highland Beach, executed by Mayor
Baulay, was submitted to the City of Boca Raton for signatures.
The Toarn Attorney advised that the Settlement Agreement regarding
Concordia and the Town of Highland Beach was submitted to the
