Mayor Jim Newill, CPA called the Workshop Meeting to order in Commission Chambers at
1:30 P.M.
CALL TO ORDER:
Roll Call: Members present: Mayor Jim Newill, CPA; Vice Mayor Miriam S. Zwick;
Commissioner John J. Sorrelli; and Commissioner John J. Pagliaro. Absent -Commissioner
Doris M. Trinley. Also present: Town Attorney Tom Sliney; Town Manager Dale S.
Sugerman; Town Clerk Beverly M. Brown; and members of the public.
Pledge of Allegiance: The Pledge of Allegiance was given, followed by a minute of silence in
honor of members of the military, both living and deceased.
Civility Pledge: The Civility Pledge was recited by the Town Clerk.

Mayor Newill presented a Proclamation to Michael and Judith Lupella recognizing their
100' birthday celebrations and their 80~' wedding anniversary.
2. PUBLIC CONIlVIENTS AND REQUESTS
Jack Halpern - 4511 S Ocean Blvd. Milani Park - my research discovered that back on
12/7/1999, Mayor Reid and the Commission made a presentation to the County
Commission. In that presentation it was brought out that there was no beach in this
vicinity. Requesting that the Town Commission once again make a presentation to the
County Commission.
Steve Glanze -Tranquility Drive Concerned about the police force. We have a wonderful
police force here. Please do not get rid of them. There is a lot of crime in Palm Beach
County and so far it has not affected this Town.

• Joe Yucht -Boca Hi lands a) My wife is looking for knitters to make hats that will be
filled with goodies to be sent to the troops in November. b) Request that the agenda be
changed to have the presentation before the public comments. It is hard to make comments
regarding an agenda item if you have not heard the presentation. c) I attended that
presentation made by the Town on 12/7/1999. The County Commission was very
inattentive. Most disgusting thing I ever observed of politicians. D) Sheriff's proposal
taking over the police department. The Sheriff's office is a political office. The squeaky
wheel gets the attention. There is nothing wrong with our police department. It will not be
worth whatever savings the sheriff states.
Sharon Stein - 2343 Tranquility Drive Both personally and as President of Bel Lido
Homeowners Association -against outsourcing the police department. What is the
impetuous behind this? What arrangements have been made with the Sheriff's Office?
Have some emails from residents of Bel Lido that cannot attend:
Cram Almsteader, MD -The police department take personal issue with our homes.
Patrol regularly. Keep the Highland Beach Police Department.
Barbara Strong and Ron Roy - In New Jersey and cannot attend meeting. Feel very
strongly that we need to keep our own police force. The frequent patrols keep the crime
down.
Shane McCarens -Feel very safe with the police department located right down the street.
Peggy & Ron Brown - We have nothing against the sheriff's department, but we are happy
with the service we receive from the Highland Beach Police Department.
• Jason Finkle - 4600 S. Ocean Blvd. Traffic light at the fire house. Originally the motion
was passed unanimously to install a traffic light, ten days later it was voted down. The
time it takes the fire men to stop traffic and then put on their equipment might be all that is
needed to save a life. Requesting the Commission re-consider the vote. Last year the
Mayor said he was going to send out a questionnaire. Hope he will consider doing this.
All I am asking is that you do something about a light.
John Rand -Bel Lido Have not seen the proposal from the Sheriff's Department, is there
any worthwhile savings? This proposal should not be considered while so many of our
residents are away. The Commission should vote according to how the majority of the
residents feel.
Commissioner Sorrelli -How many residents are in Bel Lido? Reply - 200.
Arlen Voress -4403 Bel Lido Strongly oppose transferring the Highland Beach Police
Department to the .Sheriff. Was the issue brought up because of cost or management?
Palm Beach County is the largest County in the country - 45% of it is incorporated and
55% is unincorporated. The sheriff provides services for all the unincorporated areas.
Since it is an elected office, the Sheriff reports to the County Commission. He is always
being criticized for his budget. If the Town Manager has a problem with the administration
in the police department -what is he doing about it? If we get rid of the police department,

• that will be a 40% reduction in the number of employees of the Town. If the Town
Manager's job is cut, so should his salary.
Mayor Newill -Cannot change the agenda format, as it will only cause problems. If there
is only 30 feet of beach at Milani Park, I wonder how many turtle nests. Lucy Miller -
Chairman of Beaches Advisory and a turtle volunteer. Last year there were 7 on that piece
of land and a total of 47 in zone 1. Jack Halpern -This morning there were a total of 12
nests on that piece of beach.
Mayor Newill -The Commission is elected by the residents to make decision, not to have a
referendum on every question. Recently spent a day and a half going over the figures
regarding the police contract, will share them with the Commission later.
Town Attorney Sliney -Referendum's are generally held on economic issues.
Dr. Wiener -Have lived here for 20 years. A couple of years ago there were a number of
burglaries in our area and we were considering forming a "Neighborhood Watch." We
visited the Palm Beach County Sheriff's Department, Boca Raton Police Dept. and the
Delray Police Dept. The people at the Sheriff's Department did not know that Highland
Beach was in Palm beach County. If the Town wants to give up our own police department
then they need to look on either side of us. Not to do so would be negligent.
Vincent Trolitano - 4314 Tranquility -When we moved to Highland Beach, the police
department were the first people to stop and introduce themselves. The personal
• relationships and bonding that residents have with the police cannot be measured in dollars
and cents. It will never be the same if you go with the sheriff's department.
Harold Ha elmann -former Mayor -While Mayor, I never received anything but the
highest comments from the residents regarding our police department. The residents of
Highland Beach are special, and so is our police department. In the event that the
Commission considers going to the County, we would also have to give them all of our
property. Please reconsider.
Jerry Marshall - 1088 Bel Lido -Agree with everyone that has spoken about the Highland
Beach Police Department. This is a special place to live and we pay a special price to live
here. Dale Sugerman you have failed us. Why are you considering going to the Palm
Beach County Sheriff's Department. We do not have violent crimes in Highland Beach.
Do not need to go to the sheriff's department.
Mayor Newill -Please refrain from pointing fingers.
Peter Carales - 44 Highland Drive - We like what we have here. Condos have security
gates; single family houses have the Highland Beach Police Department. We all moved
here, knowing that it was going to cost us more.
Beverl~Knig_ht - 4023 S. Ocean Blvd. - I sell real estate in the town. Prospective buyers
• like the fact that we have our own police department when they are buying houses on the

water. Not convinced that we should be a small fish in a large pond. Have had my run ins
with the police department, but they are co-operative. Need a strong chief. Do not give
them up.
Susan Hiles - 4324 S. Ocean Blvd. - I am a turtle volunteer in Zone 1, and as of today we
had 107 nests. 25 of them in Milani Park. Last week Boca had quite a problem with kids
and their turtle nests. The police department in Highland Beach worked right along with
us.
George Barlow - 1084 Bel Lido Drive
Like other people before me, against turning over police department to Palm Beach County
Sheriff's Department. Please do not approve this proposal to go with the county.
3. PRESENTATIONS
• Police Chief Carlo An elillo introduced Police Officers Jeffrey Kaplan and Deborah
McCray. Office r Kaplan began with the police department on October 2, 2007,
bringing to the Town 16 years experience as an officer and 8 years as a sergeant.
Deborah McCray began her career with the Town on February 13, 2008, bringing with
her 14 years experience, with 8 years as a sergeant.
• Major Michael Vecchio of the Palm Beach County Sheriff s Department
• The sheriff's office does not solicit mergers, we respond to request for information. Do
not understand fears and concerns. Your police department will operate under the
sheriff's office with different uniforms, but will provide the same services. It is
redundant to have a duplication of services, but the real savings will be in workers
comp claims. If the sheriff's department was to take over, we would inventory all your
equipment, and put a fair market dollar value on it. If you chose to opt-out sometime in
the future, this market value will determine the amount of money that the department
would return to you. The Town Manager is the liaison with the sheriffs department,
there is no loss of home rule.
Vice Mayor Zwick -Looking at the draft proposal, it indicates that you would be
adding on a sergeant but eliminating the detective position. With the possibility or
probability of Milani Park, we will need to address the policing of that area. Our
concern is that we are going to have to put additional patrolman on to police that area.
Plus we have an obligation to our present employees. We need a guarantee that they
will be kept. Mayor Vecchio - If we began to have problems with the proposed Milani
Park, we have the availability of shifting deputies from another area as an additional
resource.
Commissioner Sorrelli -During my meeting withthe Sheriff Bradshaw, he told me that
we would save $600,000.00 if we went with the sheriff's department. Last week the
Manager told me we would realize a $300,000.00 savings. Major Vecchio -The
reduction in the savings is due to the need to purchase more cars. Comm. Sorrelli -Are

you going to keep all of our officers? Reply - If we let anyone go, it would be due to a
problem.
Commissioner Pa lg iaro -This is not a time to be modest. It is fair to say, the town
does not want to lose its autonomy. What can you give us? Major Vecchio -You will
have the vast resources of the sheriff's department, especially after a hurricane. Nor
would you have to deal with issue of training, employing, general liability; employee
behavior, and workman's comp.
Mayor Newill - I spent quite a few hours going over your draft. He distributed a copy
of the draft with his results indicating that there would be an additional cost to the town
by going to the sheriff's department rather than a savings.
Mayor Newill polled the Commission to see if they wanted to receive a draft contract
from the Sheriff's Department:

5. PROPOSED ORDINANCES AND RESOLUTIONS
• A) RESOLUTION N0.08-005 R
A RESOLUTION OF THE TOWN COMMISSION OF THE TOWN OF
HIGHLAND BEACH, FLORIDA, RELATING TO-THE STATE REVOLVING
FUND LOAN PROGRAM; MAKING FINDINGS; AUTHORIZING THE LOAN
APPLICATION; AUTHORIZING THE LOAN AGREEMENT; ESTABLISHING
PLEDGED REVENUES; DESIGNATING AUTHORIZED REPRESENTATIVES;
PROVIDING ASSURANCE; PROVIDING FOR CONFLICTS, SEVERABILITY
AND EFFECTIVE DATE.
Town Mana e~ r Su erman -The issue before the Town Commission with this Resolution is
to authorize the Mayor to apply for and also to approve entering into a loan agreement with
the State of Florida for $4,400,000.00 in replacement debt. This will be to pay off the
Bank of America short-term loan which carries an interest rate of 3.414% and will replace
it with a 20 year loan with an interest rate of 2.79%. By doing so, we will save $80,817.20
over the life of the loan.
Will be included on 8/5/2008 consent agenda.
B) ORDINANCE N0.08-0010
AN ORDINANCE OF THE TOWN OF HIGHLAND BEACH, FLORIDA ADDING
TO THE TOWN CODE, CHAPTER 29 ENTITLED "WATER SYSTEM,"
SECTION 29-25 THRU SECTION 29-31 ENTITLED CRO5S CONNECTION
CONTROL PROGRAM," AND PROVIDING FOR AN EFFECTIVE DATE.
Town Mana eg r Su eg man -The Palm Beach County Health Department is mandating that
all public water supply systems adopt a Cross Connection Control Program. The Town of
Highland Beach is mandated to follow the new requirement. Cross Connection Control
Programs are established to protect the public water supply system from contaminants
getting into the system. Although previously, the Town did not mandate back-flow
prevention devices, it is now required with new construction. The law is changing now,
and all public water supply systems are going to have to put aback-flow prevention (cross
connection control) program in place for all customers. The proposed draft ordinance
authorizes the Town's Public Works Director to mandate that customers that do not already
have back-flow prevention devices install such a device when they are notified of the same.
We are doing a complete inventory of our system to find out how many customers maybe
impacted by this new mandate. We are going to get ahead-count of how many devices
need to be installed throughout the system, and we maybe proposing to undertake the
system-wide installation as part of the transmission main project.

• 6. NEW BUSINESS
A) Review of Engineer's Estimate of Construction Costs for the Replacement of the
Water Transmission Line on SR AlA and Consideration of Placing the
Approval of the Installation of the New Water Line on the November 4, 2008
Ballot.
Town Mana eg r Su eg rman -Earlier this year, the Town Commission authorized a design
engineering contract with Mathews Engineering to provide design drawings for the
construction of a new 10" parallel water transmission main along SR AlA to replace the
existing combination 6" and 8" line that is close to 55 years old. Mathews has finished
50% of their design work, and at this point in their process they have a fairly good handle
on the estimated construction cost to install the line. At 50% of design, the engineer knows
all of the quantities, all of the materials to be used and has a pretty good idea of exactly
how the project will be constructed As can be seen from the Engineer's Cost Opinion, the
total base bid for the project is nearly $3.4 million dollars. Putting the project's various
alternative bid items into the estimate and an additional 7.5% contingency for the
unknowns, the total project cost estimate should be set at $3.94 million dollars. The first
step would be to get voter's approval and the second step is to identify a funding source as
water rates will not fund these projects.
Commissioner Sorrelli - Is this really necessary? How often do the pipes break - 2/3 times
• a year? Mana er Su eg rman -The pipes are over 50 years old and are too small in some
places. Can we patch it for a while? Yes. Public Works Director Lee -The life
expectancy for these pipes are 50 years, and they need to be replaced. We have reduced the
water pressure going through these lines to prevent breakage. The Commission discussed
this a couple of months ago and decided not to put it off, as inflation costs make the final
cost rise. The engineers feel we could save about 15% if we do it now. Will pipeline fail
in two years? Do not think so. The existing pipeline is undersized. Once we increase the
size of the pipes, the insurance costs will go down.
Mayor Newill - If one of the large condos have a fire would the reduced water pressure
create a problem for the fire department? Mana eg_r Su e~ - It is conceivable if we have
a fire above the third floor, the additional water pressure will create a break. But, we could
isolate the area and use our connection with either Delray or Boca.
Vice Mayor Zwick -The residents just came before us and stated that they are willing to
pay more for services. The infrastructure has not been maintained over the years. If we
say money counts, we have to be a little bit more far sighted. Protection of our residents is
paramount. It is not a burden but a necessity.
Town Attorney Sliney -The Town Manager and I will put together a proposed resolution,
with funding coming from ad valorem taxes.

• B) Consideration of Placing the Approval of the Payment of $7,500,000 of
outstanding Water Fund Debt Service on the November 4a' ballot.
Town Mana eg r Su eg_rman - At the June 3, 2008 regular meeting, the Commission adopted
ordinance No. 07-003 O which put into place a new set of water rates effective 8/1/2008.
As part of the decision to put these new water rates into effect, the Commission also
discussed placing a referendum on the November 2008 ballot, asking the voters if they
would be willing to approve the use of new ad valorem taxes to serve as a source for
paying off the remaining outstanding debt service of the Water Fund. If new ad valorem
taxes were approved by the voters in November, those taxes would begin to flow into the
Town in December of 2009, and the water rates could be adjusted accordingly in January
2010. But the first step in this process of using ad valorem taxes for Water Fund debt
service is to place the question on the November ballot. In order to place the issue on the
November ballot, the Town Commission must adopt a resolution calling for a referendum
election. Unfortunately, the final resolution has not been completed. However, we wanted
to give the Commission some sense of how the Resolution will look in order to place the
referendum on the November ballot.
Resolution will be included on 8/5/2008 consent agenda.

C) Review of Modifications to the Employment Agreement between the Town and the
Town Manager
Mayor Newill - In preparation, I had the Town Clerk check with three or four other towns
in the area and make a comparison with the contracts of their town managers. I requested
the following two items be included: 1) the car not leave the State of Florida; and 2) under
Professional Activities there should be a maximum number of days.
Town Mana eg r Su erman -The proposed modifications include: 1) from an indefinite
term to an agreement with one three-year term and three one-year renewals; 2) clarifying
that outside teaching and consulting are only allowed after normal working hours; 3)
remove the title of Town Manager from the Town pay plan; 4) reducing the annual merit
increase that can be earned from 7% to 5%; 5) adds 3 months severance and 6 months of
health insurance if the Employee is terminated; 6) provides for an additiona160 days of
notice by Employee in the event of a resignation; 7) authorizes the leasing of a Town
vehicle at a cost not to exceed $500.00 per month (with an additional $100.00 if it is a
hybrid) along with fuel, maintenance, and insurance. Employee is limited to 12K miles and
eliminates the current $500.00 per month car allowance; 8) clarifies the language in
professional association business meetings and committee. Balance of contract will remain
the same.

Commissioner Sorrelli -Have you put any numbers on these changes? Mavor Newill -
The changes are minimal. It will only affect the retirement plan, fuel, and car insurance.
Did not do a number to number approach. Comm. Sorrelli -Wrong thing to do at this
time. Would like to see it held off for another year.
Vice Mavor Zwick - In reference to "international" assemblance of meetings. We
previously reviewed this once before, and limited it to meetings in the United States. Have
qualms about allowing traveling to international conferences. I do not think that should be
out stance at this time.
Commissioner Pa lg iaro -Have come to the conclusion that we are lucky to have Dale. I
think it is important that when we have someone with talent, we not discourage his opinion
and abilities. He offers a lot to this community and is not asking for a lot.
Mavor Newill -The only problem seems to come with the international travel and the use
of public funds. The Commission passed a Resolution stating that they would no longer
donate to charitable interests. Have a problem with spending taxpayer's money to do
business with some other country.
Mana er Su erman - I will pay all those expenses myself, but would like to have the time
off as administrative leave. Mayor Newill -Your offer is acceptable to me. Vice Mavor
Zwick- Willing to speak for myself, and I find I acceptable. Commissioner Pa liaro -
Agree with the Vice Mayor -that is generous. Commissioner Sorrelli - I would like to see
the contract re-written.
D) Consideration of Purchasing the Town's Employee Health Insurance Coverage
from Blue Cross/Blue Shield of Florida Effective September 1, 2008; Dental
Insurance from MetLife Dental and Vision Insurance from VSP Vision Care.
Town Mana eg r Superman - As part of the 2008-2009 budget process, the Town staff went
to the market place to see if we could find alternative sources for Town employee health,
dental and vision coverage. We have found insurance coverage that is broader than we
currently provide to our employees, and we have found it for less cost. Town Clerk Brawn
has provided a memorandum outlining what she has found, as well as comparative charts
demonstrating the enhanced benefits and the reduced costs. Assuming the Town
Commission would find this recommendation acceptable, the overall net savings to the
Town would be $165,594.72 annually.
Mayor Newill -The corporate world is eliminating benefits. What are the other towns
doing? If employees pay part of the cost, they would feel the cost when something goes
up.
Commissioner Sorrelli -Has this been discussed with the employees? Town Manager
Superman - We have not discussed this with the employees.

E) Review of Format and Establishment of a Schedule for the Milani Park Special
Exception Application from Palm Beach County
Town Mana er Su erman - At the June 24, 2008 Town Commission Meeting, the Chair of
the Planning Board presented to the Town Commission their report and recommendation
on the Special Exception application from Palm Beach County for their proposed Milani
Park. That report and recommendation was made based upon a series of three workshop
meetings and three public hearings held on the matter. The Planning Board has
recommended approval of the project with 31 conditions. It is now incumbent upon the
Commission to move this item forward. Special exception applications are governed by
Sections 30-21(b), 30-67, 30-12, 30-36, and 30-46 of the Town Code. Particular attention
should be given to Sections 30-67 and 30-36 of the Code as they specifically regulate the
application from Palm Beach County for the Milani Park project. I would suggest at a
minimum that the review of the 31 Planning Board recommendations be discussed at the
workshop meeting of August 26~' and that the outside consultants be invited to present at
the September 29 workshop. These workshops will not be held in conjunction with any
other meeting or business.
Town Attorney Sliney -Agree with the Town Manager, It is essential that the Town
Commission has its owns experts. I agree with the Town Commission scheduling its own
workshops. The County was out of line with their letter telling the Commission how to
S proceed.
Commissioner Pa lg iaro -Has the County responded to any of the 31 conditions set by the
Planning Board? Will they have their own consulting experts? Mana eg r Su eg rman -The
County has not, but they wanted to know what the Commission was looking for before they
proceeded. Commissioner Sorrelli -Requested to see a copy of the traffic report. Manor
Newill -Need to schedule workshops in order for Commission to receive information from
the consultants that the town hired.
Mana er Su erman -The Commission needs to determine the sequence: 1) Response
from County on the 31 items and 2) reports from our professional consultants

The County would like you to hear from our expert witnesses before yours. We request
that it be done in aquasi-judicial public hearing rather than a workshop. All testimony
given is on the record.. Requiring witness to take an oath and be cross examined. The
County does have a response to the 31 items, and would like you to set a specific meeting
date.
Mana er Su eg rman - I would like to know when we are going to receive the clean set of
Milani Park plans so that our consultants can review them and return them to the
Commission with their comments.

Amy Patrick -Assistant County Attorney
• Formally objecting to the Commission holding workshops. This is a "Special Exception
Permit' and must be heard in a quasi judicial proceeding. Information should not be given
unless it is under oath. You would be violating our "rights of procedural due process" by
holding workshops.
Town Attorney Sliney - I disagree with your statement. Please send me the case law that
you are referring to. Purpose of a workshop is to have orientation of information that is
going to be presented. I do not remember any objection from the Counyt when the
Planning Board held their workshops.
Moor Newill -Where do we go from here? What about "home rule?"
Mana eg r Sugerman -Workshops meet the "Open Meetings" requirements. A notice and
agenda are posted, minutes are taken, and everything is put on the record.
Town Attorney Sliney -Agree with the Manager. We were not aware that the County was
going to object to something that they have not previously objected to before. Until I
review their objection, should not set a specific meeting date.
Collene Walter - We would like to set a date for the public hearing. We don't believe that
it will take your consultants very long to review our responses to the 31 issues.
• Town Attorney Sliney -Under "special exception" in the Code, the Town Commission can
approve or deny. The 31 condirions are suggestions by the Planning Board.
Mana eg r Superman - May I suggest that the agenda item be carried over as "Items Left
Over." If there is something from the Town Attorney before next meeting -fine. If not,
we can table the item until the next meeting. Town Attorney Sliney agreed.
F) Adoption of the 10-Year Water Supply Facilities Work Plans as part of the
Comprehensive Plan of the Town of Highland Beach as Required by the 2005-
2006 Lower East Coast Water Supply Plan Update (Section 163.3177 (6)(c)
Florida State Statutes).
Town Mana eg_r Su eg rman -As a public water supply utility, the Town has an obligation to
demonstrate that we have carefully thought out and planned how we are going to meet the
water needs of our customers, while at the same time insuring that we comply with the
overall balance of water resources available here in SE Florida. The Town must adopt both
a Water Supply Work Plan and amend the Town's Comprehensive Plan by making sure
that what we say are going to do as a utility and what we actually do as a public water
supply system is not in conflict with the plan adopted by the South Florida Water
Management District, Palm Beach County, and the State of Florida. With the assistance of
the Bell David Planning Group, we are presenting to the Commission a proposed Water
• Supply Work Plan and Water Supply Amendments to the Town's Comprehensive Plan.

Once these items are reviewed and approved by the Commission, we will send them off to
• the Department of Community Affairs in Tallahassee, South Florida Water Management
District and Palm Beach County asking them to comment on what we have proposed. At
some point in the future, we will have to adopt final plans and amendments.

8. REPORTS -TOWN COMMISSION
• Commissioner John Pagliaro - Wanted to thank Sergeant Carl for his assistance with
the turtle light violators.
• Commissioner Sorrelli - No report.
• Vice Mayor Zwick -Thank the Town Clerk for the new microphones.
• Mayor Newill -The recent "Coffee with the Mayor" was very successful. There were
about 45 people in attendance; it was scheduled from 9:30 - 11 AM and had to ask
them to leave about 12:10 P.M.. Subjects discussed -police department, water rates,
bicycles, tree plantings, parking on swales and the fire house light. Have tentatively
scheduled another one for late October.

• No Report
Mayor Newill -What can we do about the bicyclists taking over the road? Mr.
Sliney -will look into it.

Joe Yucht -Boca Highlands
Would like to suggest that the Commission pay for the Mayor's Coffee rather than the
Mayor. It was well attended, informative, and received some good answers. Milani Park -
The Planning Board submitted 31 issues. If you look at the Code of Ordinances, 19 of
them are mandated. The surveys submitted had not been updated since 2002. The
Commission should ask for updated surveys. Also hope you delay the public hearings
until the winter resident's return. Recently read an article printed by the Sun Sentinel
1/9/1990 regarding this park, and all the issues are still the same.
Harold Ha elmann -Boca Highlands
Good meeting. We live in a wonderful town and the residents want to keep it that way.
We need a light at the firehouse. Thought Mayor Newill wanted to send out a
questionnaire.
Mayor Newill -Please let me clarify that last statement. Last year as a Commissioner
proposed sending out a questionnaire with 10 questions. The Commission voted it down.
There will be no questionnaire mailed out.
