Chair Burnich called the Regular Meeting to order at 9:30 a.m. Roll call was taken by
Deputy Town Clerk Gaskins followed by the Pledge of Allegiance.

MOTION: Vice Chair Gill moved to approve the minutes of December 15,2015,Regular
Meeting as amended. Member Stern seconded the motion,which passed unanimously.

Chair Burnich—asked everyone present at this meeting that will testify,stand and be sworn
in. Deputy Town Clerk Gaskins administered the oath to all those who would testify for
this item.
Member Kelvin—I noticed that the Town has submitted evidence that Ms.Roy owns the
property. There is a notice from the post office that a notice was delivered to her. I noticed
several other bits of evidence including two photos of the boats. I do not see any evidence
of sworn testimony as to who took the pictures or when the pictures were taken. Also,I
do not see any identifying numbers on the photos that were taken. I do not see any evidence
from the State Marine Board with regards to who owns the boat. I do not understand how
the Code Enforcement Officer can issue a violation when he does not know who owns the
boat.Chair Burnich—Member Kelvin the Code Enforcement Officer is here to make his
presentation and then we can ask questions. Member Kelvin-My point is that we are not
to consider anything on this board unless it is presented. There is no evidence as to who
owns the boat or when the pictures were taken;therefore we should postpone this meeting
until such time the Town can provide evidence as to who owns that boat and when the
pictures were taken. Chair Burnich—This hearing is to allow the Code Enforcement
Officer to make his presentation, then the board members can ask questions and the
individual that is here for the violation hearing submits their responses. At that point,the
board members can ask questions and make a decision. Discussion ensued with regards to
documentation relevant to the owner of the boat.

Town Attorney Rubin—I am aware that Ms.Roy sent a packet to all the board members.
It would be appropriate to disclose any ex parte communications whether you received or
read the packet. If you reviewed the packet,please affirm that you will base your decision
on the evidence that is presented during the course of this hearing.
Member Gehman—I did receive the packet and read some of it. I brought the packet to
the Town Clerk to let her know that I received it.
Member Stern—Yes,I did receive and read the packet. It will not affect anything in this
hearing today.
Vice Chair Gill—Yes,I did receive and read the packet. It will not affect my decision
today.
Member Kelvin—I did receive and read the packet. Unless it is received today,I will not
consider it.
Chair Burnich—I did receive the packet but I did not read it. I turned it into the Town
Clerk.
Orlando Rodriquez,Code Compliance Officer—I observed the violation on July 28,2016,
and subsequently issued a Notice of Violation,which required compliance no later than
five(5)days from receipt of the certified letter. On August 8,2016,the Notice of Violation
was issued via certified mail and regular mail to the address listed in the Tax Collector's
records. Code Section for the violation is 30-68(g)(1)(b),which states that"accessory
marine facilities shall be used only by residents or their guests, and shall not be rented or
leased to nonresidents or any other person other than owners or residents of the principal
dwelling or dwellings." I have the boat owner's information from the United States Coast
Guard. On July 28,2016,the Notice of Violation was sent to Ms.Ann Roy. On August
11,2016,I hand delivered the Notice to Appear—Notice of Hearing to Ms.Roy. I have
new photos that were taken this morning showing that the violation still exists on the
property.
Chair Burnich—Do we have proof of the individual that owns the boat is not a resident of
Highland Beach?
Code Compliance Officer Rodriquez—The individual is not a resident of 4301 Tranquility
Drive. I believe the individual is a resident of Highland Beach.
Member Stern—How did you discover the violation? Code Compliance Officer Rodriquez
—The building department had a list of violations for the Bel Lido Isles area.
Vice Chair Gill—You were notified by our building department;and how did the building
department get notified? Code Compliance Officer Rodriquez—That is correct. I am not
sure as to how the building department was notified. I review the list of violations and go

out in the community to check to see if the violations are valid. Vice Chair Gill—Is there
a representative from the building department at this meeting?
Member Kelvin—How did you receive notification of the owner of the boat? Code
Compliance Officer Rodriquez—The information the building department received from
the United States Coast Guard is being distributed to the board members. It has the name
of the boat owner.
Deputy Town Clerk Gaskins — I will contact the Building Department to see if a
representative from that department can come to this meeting.
Town Manager Beverly Brown—One of the town commissioners received complaints from
a resident in Bel Lido Isles about code violations in that area. I referred the complaint to
the Building Department for the code enforcement officer to investigate.
Member Kelvin—Who supplied the marine licensing division with the boat registration
number? Code Compliance Rodriquez—The United States Coast Guard provided the
license information. The information is obtained through the name of the boat,and it is
then submitted to the United States Coast Guard. That is how we get the information.
Discussion continued with regards to how the name of the boat was obtained by the
Building Department.
Ann Roy,Property Owner of 4301 Tranquility Drive,Highland Beach,Florida—I have
been an owner of this property since 1973. Ms.Roy read letters dated August 30,2016,
August 20,2016,and August 6,2016,into the records.See Exhibit"A",Exhibit"B"and
Exhibit"C". She gave handouts to the board members-Exhibits A and B.
Chair Burnich — Building Official Desorcy is here. Deputy Town Clerk Gaskins
administered the oath to Mr.Desorcy who would testify for this item.
Discussion ensued about the boat owner's information and the evidence presented at this
hearing.
Member Kelvin—The Town of Highland Beach Code of Ordinance reads,"Accessory
marine facilities shall be used only by residents or their guests." What does that mean and
does it take into account joint ownership. If two people own the boat do both of them have
the right to dock at the facility?
Town Attorney Rubin—The board has to enforce the Code of Ordinances as it is written.
As long as the two people own the boat and they are residents of Highland Beach,they
have a right to dock their boat.
Chair Burnich—Is Ms.Roy correct about being grandfathered in under the 1972 Code of
Ordinances? Town Attorney Rubin explained the use of the term"grandfathered in",and
the provisions of the Town's Code of Ordinance relevant to non-conformity and
abandonment.

Member Gehman—Ms. Roy, how long has the boat been at your dock. How many
continuous years?
Ms.Rov—He brought the boat in January. His boat has been there since January 2016.
Member Gehman—The Code of Ordinances from 1972 and 2000 are identical. It says for
residents or guests. Discussion ensued about the similarities/differences of the language in
the 1972 and the 2000 Code of Ordinances.
Member Kelvin—Reading further,"rented or leased to nonresidents or any other person
other than owners". My question is,if Mr.Karban sold a percentage of his boat to Miss
K.would he be allowed to park there? Ms.Roy—I do not want that responsibility.
Town Attorney Rubin—If she was part owner of the boat. Yes,then it would be partly her
boat and it could be parked there,or if he part owner of the resident conversely. If she had
an ownership interest in the boat,they would jointly own the boat.
Vice Chair Gill—You are not an owner of the boat in any way? Ms.Roy—No.
Chair Burnich called for a motion on this issue.
MOTION: Member Stem—Moved to approve that there is a violation of the Town's
Code of Ordinance as presented today. Vice Chair Gill—seconded the motion.

Town Attorney Rubin called for a motion as to a compliance date to correct the violation

Chair Burnish—Town Attorney Rubin can we table this portion of the item until we see
what the Town Commission is going to do about the Code of Ordinance. Town Attorney

ORDER FINDING VIOLATION
THIS MATTER having come before the Code Enforcement Board on August 31,2016, and
having heard the testimony of the parties,and having considered the evidence presented by the parties,
and having been fully appraised of the circumstances,does find as follows:
FINDINGS OF FACT
1. The Respondent is the owner of the property located at 4301 Tranquility Drive,Highland Beach,
Florida,as described above.
2. By Notice of Violation dated July 28,2016 and Corrected Notice of Violation dated August 18,
2016,Respondent was advised that a recent inspection of the Property was performed by the Town and
that she was in violation of Section 30-68(g)(1)b of the Town Code of Ordinances.
3. Respondents failed to comply with the Code requirements by the dates indicated in the Notices
of Violation,and the Town issued a Notice of Hearing.
4. All notices were served in compliance with Section 162.12,Florida Statutes,and Section 2-106
of the Town Code of Ordinances.
5. The testimony and photographs presented at the hearing demonstrated that the violation remained
on the Property as of the date of the hearing.
CONCLUSIONS OF LAW
1. By reason of the foregoing,Respondent is in violation of Section 30-68(g)(1)b of the Town Code
of Ordinances and is therefore subject to the provisions of Article V, Chapter 2, of the Code of
Ordinances of the Town of Highland Beach,under the authority of Chapter 162 of the Florida Statutes,
as both may be amended from time to time.

2. The Findings of Fact support,by a preponderance of the evidence,that Respondent violated and
remains in violation of the Code section cited above.
COMPLIANCE
1. IT IS HEREBY ORDERED that Respondent shall comply with the above section of the Town
of Highland Beach's Code of Ordinances as follows:
a. Respondent shall bring the Property into compliance with the Town Code on or before
September 30,2016. Upon compliance, Respondents shall request an inspection by contacting the
Town's Building Department at(561)278-4540 or the Town's Code Enforcement Officer at(561)254-
5935.
b. Should Respondent fail to bring the Property into compliance by the date specified above,
a fine in the amount of$250.00 shall be assessed against Respondent for each day the Property remains
in violation past the date set for compliance.
c. No further action shall be required for the entry of such fine.
2. Should Respondent violate the same code sections cited herein,such reoccurrence may subject
the Respondent to a repeat violator fine of up to $500.00 per day for every day of violation, plus
administrative costs in enforcing the action,pursuant to Chapter 162,Florida Statutes.
3. Respondent may submit a written request for a hearing to challenge this Order prior to its
recordation as a Lien provided the Respondent does so within thirty(30)days from the date of this Order.
If Respondent fails to comply with the Town Code within specified deadline and timely request such a
hearing in writing to the Town,the Town may record a certified copy of such Order in the Public Records
of Palm Beach County,Florida,and thereafter the Order shall constitute a Lien against the real and/or
personal property owned by Respondent. If such a hearing requested, the Town shall notify the
Respondent of the hearing date by regular and certified mail. Respondent is not entitled to a rehearing
of the case,and there shall be no presentation of evidence as to the existence or non-existence of the
violation_ Instead,Respondents shall Show Cause why this Order should not be recorded as a Lien in
the Public Records of Palm Beach County,Florida.
DONE AND ORDERED this 31'day of August,2016.

Re:The Notice of Violation I received regarding my boat dock:
In addition to my previous information,I am providing you with the following:
1. In addition to Dr.Karbin's previous letter,this additional one is to familiarize you
with his character, For you to consider.
2. I would appreciate your providing me with the name of the person who contacted
the Code Enforcement Board to complain about my continuing to use my boat dock
to bring me pleasure and treasured boat outings and I was assured it could be used
that caused my late husband and Ito purchase our property in 1973 under the 1972
code to build our home and dock based on the assurance we were given and then
allowed to use for decades and thus grandfathered into.
3. I would like you to also consider my response to the Commissioners at yesterdays
Town Commission meeting that suggested the current year 2000 code be rewritten
to be more compassionate and reasonable. My response was that if and when they
do as they suggested rewrite it they consider the legal consequences;re:neglecting
to address the residents who spent their money to build their homes and docks based
on the prior 1972 Code. I also suggested they consider what I believe is a flaw in
the wording in the Code that was rewritten in the year 2000 that should be
addressed,since it refers to a"Guest"needing to"Reside"in home for not more
than 60 days. If one is"residing"in the home then they are a"Resident"and not a
"Guest." They are either one"or"the other,a"Guest"or a"Resident."
If and when the Code is rewritten,I believe the legal consequences should also be taken into
consideration as to who is responsible for the loss of enjoyment,quality of life,pursuit of
happiness and money to reimburse residents for their years of investment that are left with a
home and dock they are suddenly told,after decades of being allowed,they can no longer
continue to use their property as it was lawfully built and allowed to be lawfully used and
enjoy under the 1972 Code,thus by precedent and grandfathered into but will be breached,
seems to me to be unreasonably harsh,lacking in compassion,or any positive reason,
except,at today's Town Commission Meeting it was mentioned it could present a parking
problem as to where the boat owner would park,to which my answer is"simply"where any

guests should and always parked,in my case,in my driveway! Without ever having caused
traffic jams.
I believe if that's a concern,instead of imposing unreasonable limits on our decades old
boat dock,owner in our beautiful wateifiont community;preventing traffic jams would be
better addressed by limiting the over abundance of high rises being allowed,instead of
restricting the use of decades old boat docks to make up for the traffic the high rises cause
and mining the beautiful,serene,waterfront Town,which we once were,which boats and
docks added to the beauty,not the traffic.
I again,thank your for your service to our community and this opportunity to be heard and
again request your compassionate and reasonable decision to please cancel the code
violation dated June 28,2016.

Re:The Notice of Violation I received regarding my boat dock:
My answer for my hearing before the Code Enforcement Board is as follows:
I I am aware of and understand the need for Codes and the Board's service to our
residents to enforce them is necessary to pnutwt our residents from undesirables,
harm to protect our safety and quality of life and appreciate your service for this.
2. As a Master Peer Counselor,I am also aware and understand that there are people
who obtain their self-worth and esteem by filling their lives by minding and
unnecessarily interfering with other people's lives,happiness and well-being without
bothering to find the facts that would support their complaint as in my case. While I
ant able to sympathize with such people who need to fill their lives in this way,I
need to point this out since it is relevant to how I will summarize this response.
Since I have been assured I can expect this Board's Members are reasonable,I am
providing you with the information and facts to support my position that Dr.
Karbin's boat remaining at my dock is not a violation in my case in the hope your
decision will in all fairness acknowledge this when hearing my reasoning to prevent
it becoming a costly Federal case. I respectively ask you to please consider the
following:
a.) Please review my letter of August 1st to Mr.Rodriguez also provided at the
August 2"d Town Commission Meeting. See Exhibit"A."
b.)My position remains that legal precedent has been established in my case that I
am"grandfathered"into the Code adopted in 1972 regarding dock usage that
both the Town and myself have been abiding by for decades;which I have
complied with and the Town continued to allow my son,friends,relatives and
guests to keep their boat docked at my home under that 1972 code which has no
time restrictions on or requirement that they must reside in my home

Based upon the Town's assurance and codes we purchased our property in
March 1973;built on it and for decades I have enjoyed the boat outings this has
provided which adds to the quality of my life,happiness and enjoyment which I
rely on beim able to continue being bound by the and set by the 1972 Code
precedent aforementioned that legally entitles me to continue and which I have
an interest in continuing to do without being stopped by the latest Code,which
by precedent is not the Code I am bound by,in my case. See;Exhibit"C.".
3. Please consider the following definitions to support my being exempt from the 2000
Code regarding docks and by law am bound by precedent to continue to be bound
only to the 1972 Code as some of the following definitions of'PRECEDENT"

B.)Preceding-Prior
C.)A Habitual Practice of an Individual
D.)Law-a Common Practice of Usage so long Established that it has the Force or
Validity of the Law
E.)To Become Accustomed-to-Law-Customary
F.)Synonymous-as Usual,Based on Custom or Tradition rather than written law or
contract.
4. I ask that it be taken into consideration that both Dr.Karbin and myself are long-
time law-abiding residents who are assets to our town and humanity,whose
lives are dedicated to improving the quality and well being of others,serving
humanity and making the world a better place,not the undesirables the Code was
meant to prevent
Not for the purpose of impressing you,but to substantiate that my life is dedicated to
volunteer work and my purpose is to be a mother and asset to humanity I am
providing just some of the countless awards I have received over the last couple of
decades which I stress is not for the purpose of patting myself on the back,but is
relevant to the point I will make when I summarize my position. I am providing the
following:
A,) My Volunteer of the Year Award in 2001 from the Palm Beach County Mental
Health Association. See Exhibit"D."

facilitated for awhile and I am considering Martha's request that I start it up again.

D.)2001 letter from Rep.Susan Bucher,U,.S.House of Representatives
congratulating me for my"hard volunteer work that benefits the whole community"
and offering her help if I ever need it."See:Exhibit"G,"
E.)Certification of Appreciation from N.E.Focal Point Community Center in
Deerfield Beach for which over 11 years I have been one of the Florida Kamiana
Hula Dancers and raise money for their Alzheimer's patients. We perform all over
and have raised money for the military and other causes. See:Exhibit"H."
5. Certificate of Appreciation,Re:Boca Raton's Addison Mizner Elementary School
for counseling children which I did for over 11 years. See:Exhibit"I."
6. Certificate of Appreciation for my being instrumental to the morale and welfare of
our troops deployed in harm's way. See:Exhibit"J."
7. From the 11 years I counseled children at Boca Raton Addison Mizner Elementary
School,I have enclosed an envelope containing some of the many"thank you"notes
from the children,their parent and teachers which I condensed into the envelope
marked"Exhibit L"
8. Please also consider Dr.Karbin was also a homeowner in Bel Lido on Intracoastal
Drive who was simply keeping his boat safe from the wake on the Intracoastalby
keeping it at my home.
He remains a Highland Beach resident at his new"Intracoastal"home on AlA
where there is no dock to accommodate his boat What difference does it make,his
home or my home? This is simply an"accommodation"to protect a resident's
ply.
I ask that it be taken into consideration that by acknowledging the precedent established in
my case that grandfather's me into being bound only by the 1972 Code would not confer on
me a privilege that would entitle other owners a special privilege to ignore the Code from
the year 2000 that would apply to them.
Please also consider how ironic it would be if a decision would instead of protecting the

quality of life for us two long-time,law-abiding "residents"who do no harm to anyone and
are dedicated to improving the quality of other people's lives would have their own quality
of life adversely affected,contrary to the Codes would be purpose would instead encourage
troublemakers who harass,interfere with and mind other people's business without
bothering to avail themselves of the facts and circumstances before making accusations
adversely affecting other residents quality of life instead of protecting us from undesirables.
In conclusion,I respectfully ask this Board to make their decision as if it were they
themselves in my position and to recognize the established precedent that grandfather's me
by law to be bound only by the year 1972 Code in my case. Please cancel the Code
Violation of 7/28/2016.

My response to your letter I just received is as follows:
We purchased our lot in Bel Lido Isle in 1973 when my husband was still alive with the
intentions of owning a boat for which we attended and passed a boating course. In 1989 I
took a refresher course and passed the U.S.Coast Guard course but being alone I never

We built our home in 1980 and familiarized ourselves with Town codes and ordinances.
Over the many years I have been a resident I have had several boats at my dock since I was
given permission and was assured that as long as I was not renting the dock,my son,family,
friends and guest,although not residing with me were allowed to and have always over the
years kept their boats here from time to time.
Under the circumstances,I would appreciate knowing the date the code your letter refers to
was written and if it can retroactively replace what was in effect and which I have complied
with for decades.
To prove I am complying with the code I have been accustomed to and complied with and
allowed for all those years,l am providing your with my neighbor and friend,Dr.Karbin's
letter to prove lam not renting my dock He just recently sold his home down the street on
Intracoastal Drive and moved into his new Highland Beach home on Al A. Because he is a
friend I am being a good friend in which I pride myself so I am letting him dock his boat
and includes living up to my reputation for being a compassionate,generous human being
whose senior years is dedicated to volunteer work and giving to others. I am providing you
with some of the many awards from the county and towns,etc.in the hope you will
understand and allow me to continue to comply with the code as originally presented to me
and allowed and precedent thus set for decades.

5 ZONING § 5
(5.3) Accessory uses and structures.
(a) To be on same lot as principal use;exceptions.Acces-
sory ncas and structures shall be located on the same
lot as the principal use or structure or on a contiguous
lot in the same ownership, provided, however, that
where lots or portions of lots in the same ownership
are divided by a street,and are immediately opposite
to each other,the board of adjustment may permit,as
a special exception, appropriate erre gory uses or
structures on such noncontiguous lots or portions of
lots.
(b) Accessory bw2dings prohibited in required yards; ex-
ceptions.Accessory structures other than those allow-
able under the yard definition at section (5.12.(a))
shall not be permitted in any required yard,provided,
however,that the board of adjustment may permit,as
a special exception, the construction of garages, tool
sheds,boat houses,and the hike(but not structures for
the housing of persona) in required rear yards or wa-
ter yards other than the water yard required adjacent
to the natural vegetation line of the beach. No saeh
construction cha11 be permitted in a manner or loca-
tion likely to cause objectionable impediment to de-
sirable views from adjoining properties.
(c) Spacing. No separate accessory building shall be lo-
cated within five(5)feet of any other building.
(d) Noncommercial docks, piers, launching facilities and
• mooring devices. Uncovered noncommercial docks,
piers, ramps, mooring, lifting and launching devices
are permitted as accessory uses to dwellings in all dis-
tricts except TR. No such structure shall extend into
any waterway more than five (5) feet,nor shall any
structure be located closer than twenty-five (25) feet
to adjoining residential property, provided that the
board of adjustment may permit, as a special escep
tion, location nearer to the property line if there are
substantial reasons why such location would be.advan-
tageous.Such facilities shall be used only by residents
on the property or their gum.

b.Swimming pool decks must be set back at least 20 feet from the front property
line and at Iast four 4 feet from rear or side tot lines.
c.Screen enclosures must comply with the setbacks established herein for
swimming pools.
d.If the rear property line borders a public body of water,the pool deck or decks
may extend to not less than five feet from the right-of-way line or bulkhead
line,whichever is further landward.
(2) Buffering. Swimming pools in front yards shall be concealed from view from
public rights-of--way.
(3) Cabana. Cabanas associated with swimming pools,or ocean bathing,shall
comply with the following limitations:
a.single story;
b.not exceeding 150square feet;
c.facilities for independent living,cooking,eating,or sleeping are prohibited;and
d.watt,electricity,and facilities for sanitation are pe€mitted.
(4) Preldbited Swimming Pools. Swimming pools not installed in the ground as a
paces sonata or installed above ground as part of a multifamily dwelling
are prohibited. Pools with a capacity of 200 gallons or less are excluded.
G. Accessory Marine Fatties.
(1) Ancessory use. Accessory marine facilities,including docks,piers,benching
facilities,and lifting and mooring devices am permitted as an accessory use in
all residential zoning districia.
a.Accessory marine facilities shall not be used far commercial purposes.

b.Accessory marine facilities shall be used only by residents or their guests,and
shall not be muted or leased to nonresidents or any other person other than
owners or residents of the principaldwelling or dwellings. For the purpose of 1
this Section,the term guest shall man a person or persons residing in a
dwelling unit for a limited period of time,not to exceed a period of sixty(60)
days within one calendar year,at the invitation of the owner or resident of the
dwelling.
e. Accessory marine facilities shall not be a hazard to navigation.
